Supreme Court Allows Georgia Inmate on Death Row to Die by Firing Squad

The US Supreme Court ruled in favor of an inmate on death row choosing a firing squad as per his request.

In another ruling released today, the Supreme Court decided to allow a death row inmate a firing squad.

The Supreme Court ruled Thursday in favor of allowing a Georgia death row inmate to alter his execution method from lethal injection to firing squad .

In a 5-4 decision authored by Justice Elena Kagan , the high court ruled that inmate Michael Nance’s medical aversion to the use of lethal injection is well within his constitutional rights under the Eighth Amendment , which prevents cruel and unusual punishment.

“A prisoner must identify a readily available alternative method of execution that would significantly reduce the risk of severe pain. In doing so, the prisoner is not confined to proposing a method authorized by the executing State’s law; he may instead ask for a method used in other States,” Kagan wrote.

Justice Amy Coney Barrett lead a dissent joined by Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch. Her argument was that the only manner in which to perform capital punishment in the state is by lethal injection. She said the state doesn’t allow for a firing squad and to do so would go against the state law on the matter.

Tyler Sanders dead at 18: ‘9-1-1: Lone Star’ actor was an Emmy nominee

Tyler Sanders, a former child star who appeared on “9-1-1: Lone Star” and “The Rookie,” died Thursday at his home in Los Angeles. He was just 18.

Reps for the young actor confirmed his passing on Friday.

“The cause of death is unknown and currently being investigated. We can’t comment further beyond this,” his talent agent Pedro Tapia told The Post. “Tyler was a talented actor with a bright future. He comes from a wonderful family and we ask that you respect their privacy at this time.”

An autopsy is reportedly set to be performed in the next few days.

Sanders entered show business at the age of 10. In addition to his role on “9-1-1: Lone Star” opposite Rob Lowe, he starred in projects such as “The Rookie,” “Fear the Walking Dead” and the Amazon Prime series “Just Add Magic: Mystery City.”

The young performer, who also studied improv and stand-up comedy, received a 2021 Daytime Emmy nomination for his role as Leo in the “Just Add Magic” spin-off, and has a pair of independent films currently in postproduction, according to his IMDb.com profile.

The Post reached out to Sanders’ reps for comment.

Sanders was active on his social media pages, including his Instagram with more than 12,000 followers, on which he frequently shared photos of himself with his co-stars, friends and other nature-filled adventures.

Sanders’ cause of death is currently listed as “deferred,” Radar Online reported, meaning the medical examiner is “requesting more investigation into the death, including additional studies. Once the tests/studies come back, the doctor evaluates the case again and makes the cause of death determination.”

🦍📡🇺🇸✴️✴️✴️✴️👁👁🤬 Philadelphia is ending its indoor mask mandate, city health officials said Thursday night, abruptly reversing course just days after telling people in the city they had to start wearing masks again.

The Board of Health voted Thursday to rescind the mandate, according to the Philadelphia health department, which released a statement that cited “decreasing hospitalizations and a leveling of case counts.”

The mandate went into effect Monday. Philadelphia had ended its earlier indoor mask mandate on March 2.

The health department did not immediately release data to back up its reversal on masking, but the acting health commissioner, Dr. Cheryl Bettigole, told the Board of Health at a public meeting Thursday night that hospitalizations had unexpectedly gone down 25 percent in a matter of days.

“We’re in a situation that we really had not anticipated being in this soon but it is good news,” she said, according to a transcript of the meeting. “So I’m really very happy … to say it appears that we no longer need to mandate masks in Philadelphia and that we can actually move to simply a strong recommendation.” Philadelphia had become the first major U.S. city to reinstate its indoor mask mandate, but it faced fierce blowback as well as a legal effort to get the mandate thrown out.

Few masks were worn at the Philadelphia 76ers’ home playoff game on Monday even though they were required under city rules.

City officials said the mandate would be lifted Friday morning.

When the city announced April 11 that mandatory masking was coming back, Bettigole said it was necessary to forestall a potential new wave driven by an omicron subvariant. She said Philadelphia had crossed the threshold of rising cases at which the city’s guidelines call for people to wear masks indoors. “If we fail to act now, knowing that every previous wave of infections has been followed by a wave of hospitalizations, and then a wave of deaths, it will be too late for many of our residents,” Bettigole said at the time.

Cases and hospitalizations continued to rise at least through Monday, when the health department reported 82 patients in the hospital with COVID-19 — up nearly 80 percent from a week earlier — with confirmed cases up 58 percent over that same span to 224 per day.

However, those numbers were a fraction of what the city endured during the wintertime omicron surge.

Bettigole told the Board of Health on Thursday night that hospitalizations had since drifted down to 65.

The restaurant industry had pushed back against the city’s re-imposed mask mandate, saying workers would bear the brunt of customer anger over the new rules. Several businesses and residents filed suit in state court in Pennsylvania seeking to overturn the renewed mandate.

The Board of Health’s vote to rescind the mandate came after board members met in private to discuss the lawsuit.

“We were very pleased to see Philadelphia make the correct decision to rescind the mask mandate,” said the plaintiffs’ lawyer, Thomas W. King III, who was among those involved in last year’s successful legal challenge to the statewide mask mandate in schools.

Shortly before news broke that the mandate was ending, the issue came up during Thursday night’s debate between the three leading Democratic candidates seeking the party’s nomination for Pennsylvania’s open U.S. Senate seat.

Notably, two of them, Lt. Gov. John Fetterman and state Rep. Malcolm Kenyatta of Philadelphia, came out against the mandate.

“We have to move past COVID,” said Fetterman, adding that “we have to live with this virus, and I don’t believe going backwards with a mask mandate or with closures is appropriate.”

U.S. Rep. Conor Lamb of suburban Pittsburgh said he hated wearing masks but thought Philadelphia officials were “trying to do what’s best for everybody.”

Most states and cities that still had masking requirements dropped them in February and early March following new guidelines from the U.S. Centers for Disease Control and Prevention.

The Justice Department, meanwhile, said it is appealing a judge’s order that voided the federal mask mandate on planes and trains and in travel hubs.

The CDC asked the Justice Department to appeal the decision handed down by a federal judge in Florida earlier this week.

“Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate,” U.S. District Judge Kathryn Kimball Mizelle, who was appointed by former President Donald Trump, said in her ruling. https://t.me/RichLDNRDGorillaBroadcast

Blake Masters has a double-digit lead over his opponents in Arizona’s Republican primary for U.S. Senate, a poll from Public Policy Polling (PPP) shows.

The poll, released Wednesday, asked: “The Republican candidates for US Senate include Mark Brnovich, Jim Lamon, Blake Masters, and Michael McGuire. If the election was today, who would you vote for?”

Masters, – President of the Thiel Foundation named for its founder, billionaire Peter Thiel – drew 29 percent of poll participants’ support, placing him 14 points ahead of Brnovich, who garnered 15 percent. Ten percent of respondents selected Lamon, while five percent chose McGuire. A large portion of respondents (41 percent) remained “undecided.”

Masters secured former President Donald J. Trump’s endorsement earlier this month, and Trump doubled down on his support of the candidate in a video released by Masters’ campaign Monday. A Trafalgar Group poll, published soon after Trump’s endorsement, showed Masters had secured the top spot among the primary field, up 9.5 percentage points from an April Trafalgar poll that listed him in third place. The latest PPP shows both Brnovich and Lamon have lost ground compared to this month’s Trafalgar poll.

When participants in the PPP poll were asked if Trump’s endorsement had any bearing on their vote, 53 percent of respondents said they were either “much more likely,” or “somewhat more likely” to cast their ballots for Masters. Another 20 percent said they were less likely – in varying degrees – to vote for Masters, and 24 percent said it made no difference.

The poll also gauged the candidates’ favorability rating among voters, with Masters having the highest rating among the field at 39 percent, with another 42 percent unsure if they viewed him favorably or unfavorably. Brnovich faired second best, with 28 percent having a positive view of him and another 48 percent unsure of how they perceived him. In comparison, Lamon’s favorability rating registered at 21 percent, with 55 percent unsure. Ten percent viewed McGuire in a positive light, while another 80 percent did not have a view one way or another.

PPP also found that 75 percent have a favorable view of Trump, while just 18 percent do not.

The poll surveyed 595 likely voters in the Republican primary on June 28. A margin of error was not specified.
