Sorry, I should clarify: the EU doesn't have priority over a given nation's own justice system unless they feel it violates European Law.
The parents did take this to the European Court of Human Rights, but they already went through the Family Division of the High Court, the Court of Appeal and the Supreme Court beforehand. The ECHR likely would have rejected their application to have the ruling reviewed had the case not gotten so much attention.
