Yes they are, at least in the case of the RCC or COE. That's because they're institutions, run by a hierarchy which has unequivocally become "the Church". Institutions are bad, and you have made the Church into one. The true Church of Christ is not some corrupt institution who can change its doctrines on the word of a single Bishop or council, rather it is the body of Christ and all the believers in that. The Roman Catholic Church, despite denying it, has turned the Church into a hierarchical institution with a priestly "class" that gets to Lord over everybody else.

2) He called for "civil unions", not marriages. Church position is no sex for pleasure but for procreation that rules out all sex outside of marriage Hetero or homo, and some sex even within marriage.
Technically, "Civil Unions" are about inheritance laws, civil partnerships, etc and not sex.
As I said, this Civil Union stand of Pope Francis' skirts Church law but I'm not excusing it rather I'm saying what it is. If he meant it to be about law, then the decree is not infallible. If he meant to mislead then he is a bad Pope. If he intends to pontificate that sodomy is not a sin then he is a heretic and not Pope.

There's no heresy in saying that the state should let a guy inherit some other guy's belongings; but to outright say that homosexuals should have the right to a family might be a different issue. I'm not an expert in canonical right, though, if there's one here please clarify it.

That's not the only thing. Back then when a Pope wanted to do some bulls— eventually there were a saint or two to set the record straight and at least force them to dial things down. Starting with St. Peter and St. Paul themselves, the second one corrected the other when he was wrong.
Who stops Bergoglio nowadays? The only powerful man against him is Burke, but he's not enough. He won't listen to reason. The whole "conservative" wing did everything in its power to have him at the very least confront them and either confirm or deny all the random heresies he's been vomiting for so many years. And they didn't even succeed in that.
