eb9131  No.16695383

https://archive.fo/3Jo6U

>A bill looking to make it easy to sue internet users for copyright infringement stands a good chance of being passed in the US Congress.

>But further facilitating such claims, as the CASE Act proposes, could boost copyright trolling and have negative effects on free speech says the Electronic Frontier Foundation (EFF).

Here's that linked article: http://archive.fo/E9sxM

>The bill's goal is to introduce a so-called copyright small claims court, to make sure copyright holders suing on infringement grounds don't have to bring costly federal cases each time.

>Instead, the EFF noted in its criticism of the planned legislation, a quasi-court would be set up within the Copyright Office – which is not an impartial participant. The digital rights group is now warning that the CASE Act would remove many protections currently afforded to internet users, and expose them to copyright trolls.

>Even though the bill caps the fines at $5,000 – $15,000 per work – that's still high enough to financially ruin many Americans, where the average annual income is $57,652. And this is particularly true because the new process would leave those accused of infringement “without many of the traditional legal safeguards or rights of appeal [US] justice system provides.”

>To make suing people in this way even easier – and no doubt more appetizing for copyright trolls – the bill states that a copyright holder would be able to sue even if the work they claim had been infringed was not registered with the Copyright Office.

>That would produce a catastrophic situation. “Nearly every photo, video, or bit of text on the Internet can suddenly carry a $7,500 price tag if uploaded, downloaded, or shared even if the actual harm from that copying is nil,” the EFF warned, calling on internet users in the US to contact their senators and oppose the legislation.

>As for the danger posed by the CASE Act to free speech, the organization said it would turn the Digital Millennium Copyright Act (DMCA) notice “into a long-term censorship tool.”

>Namely, the bill would allow copyright holders to request that content be removed from online platforms, and at the same time bring their case before the new small claims court. The platforms would no longer be under obligation to act on a counter-notice and repost the content within 14 days.

>This could then turn into many months of effective censorship, the EFF is warning.

They stole all the back up currencies, they're downsizing and partially collapsing capitalism, they are using migration warfare to destabilize any form of resistance, they use the media to spread fear and outrage propaganda in an attempt to create hatred, violence and wars, they use crypto to destroy the physical money, and every money making scam in the book to steal every last penny from the working class. The jews want to end money and the class system and replace the former with a cashless currency, a social credit system and universal income, and the latter with slavery to a 100% jewish fiat economy.

The jews are in full blown war mode against the entire western civilization.

I think there's an underlying misunderstanding of big corporations. You don't need to make a new internet from scratch, you need to make the place inconvenient for those who want to profit off of it.

One big way is to target "content creators" that get money from making shitty clickbait and reviews. If you spread them too thin over the whole interwebs, corporations will have no reason to target individuals - they want to make sweeping attacks, that's why they like youtube so much compared to other platforms.

In addition to that, the internet is too sanitized. Convince normalfags to just flee and go somewhere else. Use the Pepe the Frog approach, which turned an innocuous frog into a symbol people don't want to be associated with. Store every and any information that you care about on multiple places, online, offline, whatever, as long as you back it up somewhere safe for yourself it can't die.

Don't give a shit about new releases for a while. It's not that hard, most new games and media are shit anyhow.

Any time you see some cool project online, pressure the people behind it to release its source ASAP or grab it yourself, they're 9 out of 10 times reddittors or faggots who will bow down to their corporate overlords once the chips are down, or they'll just put more niggers and trans to appease those you dislike.

Make alternatives, populate alternatives, doesn't matter if the content is stale, as long as there's even a few users it's a resounding success.

Most importantly, CREATE. If you own the IP, you own the means of using it. The copyright shit is a double edged sword, while corporations can do whatever the fuck they want the court will still side with you if they're infringing on YOUR OWN copyright - so you can pick and choose who gets to use it. Most people just want to make money off the internet and don't understand its intended use as a communication tool for niches like ours.

Consider accelerating shit though. Flag important jewtubers into obscurity. Flag them non stop for copyright. Flag Kikeberg pages too, if the JIDF can get posts taken down, there's no reason why you can't do the same. People will only begin fighting for your cause when they feel threatened, never forget it. Make it look like you're more numerous than your opponents.

>>16695463

And always, always recognize Divide et Impera shills like the one right here. Some may just be retards trying to stir shit up, just ignore them and concentrate on what's important.

>>16695513

If you want to be successful against them, you'll need to learn how to make strategic alliances. /pol/ has only ever worked when they found a common enemy with some other party. Same with /gamergate/ and other similar online movements. You can't fight a battle by ideology and willpower alone. You don't take on an entire system if you can't destroy it from within. America is not the only country in the world that can host stuff.

Wow it's almost as if money is speech and a system that allows an unaccountable aristocrat class to accumulate obscene amounts of wealth will inevitably lead to an aristocracy. It's almost as if the invisible hand of the free market is just another wacky ideology with no basis in reality. It's almost as if economic conservatives are actually short-sighted inbred hicks who think they're economic gurus because they took econ 101.

The problem isn't that the aristocratic class can accumulate wealth. The problem is that the aristocracy can purchase legislators to get laws tailor made to fit their intrests at the expence of everyone else, especially their competition. The problem is and always will be the government. Even if we were a socialist utopia you would still have an unaccountable elite class divorced from the rest of society making decisions and pulling strings to make society march to the beat they like.

Its not the invisable hand of the free market that has failed us. How is it invisiable? We can see clear as day who is manipulating the system and why they are doing it. How is the market free when an overarching all powerful entity is interviening and picking winners and losers?

If the econemy were a game of basketball would you consider it a fair game if the referees had a favorite team and every time their opposition got ahead they stopped the game and changed the rules to benefit their favorites. If the game was slowly changed over and over again to the point that only a couple teams can ever win would you call it fair? Could you even call it the same game anymore after being so thourogly changed and manipulated? If not than how can you claim what we have is a free market. Maybe you can't, maybe true capitalism is as real as true socialism I dont know. What I do know is that this wouldn't happen without the government acting as enforcers for a cloistered elite class but really, when in human history has government not done that.

This will certainly face the same backlash as when the RIAA was suing grandmas and children (sue unnamed defendant without their knowledge, win default judgment, subpoena ISP to get info on person behind IP address, sue person with acquired info).

>further facilitating such claims, as the CASE Act proposes, could boost copyright trolling

as always 'critics' are controlled opposition. Regardless of any 'copyright trolling', the main fucking issue is they're gonna sue lots of innocents, as they have no fucking way of knowing which person 'infringed' (1 IP =/= 1 person). Moreover, any asshole could get someone sued by getting on their network and intentionally downloading something from a honeypot.

This bullshit is yet another shakedown scheme from the copyright lobby and a clear attack against people's rights (fair use, criticism, reporting, etc.). It will lead to incidents like pics related (same case, 1st appeal and final appeal), and all money will of course go to the lawyers and execs, not artists.

Capitol Records, Inc. v. Thomas-Rasset was such a shitshow, but that some 2 million was reduced drastically in later trials. She never even ended up paying them because lawsuits like these are mostly voluntary and the suit went on for so many years that they eventually stopped caring.

Most of these infamous cases were filed in the 2000's, I don't think I've seen any since 2008 or 2009? Every case went on for 5+ years and gained extremely negative press for the plaintiffs, in the end they decided it wasn't worth the effort. They spent way more in lawyer fees than they could ever have realistically recouped.

<1. Copyright doesn't protect, it grants a MONOPOLY to the exploitation of a work. Patents grant a monopoly to the exploitation of an invention/technical process. Trademarks are supposed to prevent others from using your marks

<2. Patents are garbage because there's no multiple discovery defense, plus you see non-novel and obvious Inventions being granted patents all the time. Patents thickets greatly raise barrier to entry

Patents and copyright are also shit because you can just sit on your ass and refuse to license anything, preventing people from improving upon the works of the past (for 120/70+ years). Then there's also rent-seeking and patent/copyright trolling. And also remember orphan works which sit on a shelf collecting dust.

<3. Trademarks are supposed to address consumer confusion. However, they're being abused by corporations to exert control over a franchise/product with an iron fist (e.g. TTC shutting down Tetris clones, King.com pursuing people for using the word 'Saga'). They're basically Copyright 2: Electric Boogaloo.

Because of this retarded "green energy" bullshit electricity prices are already through the roof, and now they want to abandon coal too, AND get more people to buy electric cars, AND completely cripple Joe Bluecollar's mobility with carbon-taxes? Won't end well.

Also, the roads and internet infrastructure are literally third world tier, but our EU-subsidize are used to build Singapur-like wi-fi in Romania.

tl;dr and because fuck wiiiiiide screencaps, it is a nebulous term that lumps in 3 totally different concepts: copyright, trademarks and patents. Each one has different rationale for existence, and different rules. Trademarks unlike copyright actually expire, but are worse in that they cover general ideas, not just one implementation.

For a time the only way to (legally) distribute LAME was as an "implementation" (read: source code) compiled versions were out. Thankfully those patents have long since expired. No patents was a key point to Google and other big names developing VPX because MPEG have historically caused a lot of friction with things like H.264, and now H.265.

No, they don't. Trademarks exist for as long as the person/company keep renewing it. Meanwhile, both patents and copyrights expire after a certain point in time (20 years for the former, currently up to 120 years for the latter).

>but are worse in that they cover general ideas, not just one implementation.

That's patents, and they have to cover a specific idea in it's implementation, or else the entire case can be thrown out of court.

Just look at the name. It's just "copy right". The right of the creator to determine under what conditions the work may be copied. No more, no less. Without copyright, nobody could possibly make any profit off their work. You are using some really selective reading to interpret those acts. The point is that it promotes the progress of Science, Learning, and the Useful Arts through remuneration of the authors. That's how "promoting progress" works in the first place in a capitalistic system.

As a small followup, how do you expect that a creator could possibly survive off of their work without the existence of copyright? If anybody could fully copy a work and distribute it for free (or even for their own personal profit), how would the original creator ever earn anywhere near the amount of money to justify making it in the first place? How do you seriously propose any creative output would be worth undergoing in the first place without any system of copyright?

Seriously, I can't fathom it. Please give me an idea how a copyrightless system could possibly actually function.

Then make it last 5 years. If a game didn't make its money back by 5 years it was a commercial failure anyway. Also consider:

>1. relying on the sale of non-excludable, non-rivalrous goods is a terrible business model

btw, SaaSS (turning everything into streaming or always-online services, and "gaming as a service") is not a solution

>2. BILLIONS PER YEAR in tax payer money in the US alone are wasted in courts handling copyright cases

You could give grants to authors with all that money.

>3. What is the Tragedy of the Anticommons? What are orphan works (e.g. abandonware)? It's insanely hard it is to clear the rights to something, especially if you can't find out who the fuck has the rights

Copyright is supposed to let prospective authors acquire licenses for stuff, but the system is so convoluted, time-consuming, and costly any sane person would rather avoid it. This is really bad given new stuff builds on what came before.

As an addition to what that guy said, if you're making some OC for an alternative media site like Vidlii, Gab, Newgrounds, etc. for the love of God, do NOT repost it to Youtube or something simply because you want more exposure. If you want an alternative to become popular, you need to give people reasons to visit your place instead of staying in the Jew's playpen. If you really must, make an advertisement video saying "Click the link in the description to see the full version" and make it clear you're focusing your content fully on the alternative.

Normalfags are sedimentary – the biggest question they ask is "If I can view this on Mr. Zuckergoldberg's site, why would I go through the effort to go to a different site?". They won't leave familiar places unless you give them a reason to. Force and threats are one thing, exclusivity is another.

I'm saying this because there's a good number of faggots who try to do the fence-sitting "I'll post on both sites" approach, realize they get more of an audience on the Normalfag-central rather than the alternative, and end up just focusing. >After the expiration of Watt's patents, not only was there an explosion in the production and efficiency of engines, but steam power came into its own as the driving force of the Industrial Revolution

>The key innovation was the high-pressure steam engine — development of which had been blocked by Watt's strategic use of his patent. Although developed earlier these innovations were kept idle until the Boulton and Watt patent expired. None of these innovators wished to incur the same fate as Jonathan Hornblower.

>By the same token, until 1794 Boulton and Watt's engines were less efficient they could have been because the Pickard's patent prevented anyone else from using, and improving, the idea of combining a crank with a flywheel.

I don't agree with relying on copyright to make living at all, but if you want a compromise give a creative work 5-7 years, after which it enters the public domain. Copyright should act as an incentive to produce, not a mechanism to collect rent, like it currently is. The bill in the OP is yet another example of it.

Copyright law also affects derivative work, not just the work itself, such as user modifications (especially if EULA of the game's map editor, or whatever provided tools declares whatever user mods created as derivative work), or general fanworks that have varying degrees of originality.

These creators make content despite being explicitly prohibited by copyright law from taking compensation for their work because it is infringing copyright. What stops them from being sued ordinarily is releasing their work for free because:

>they can better defend themself with Fair Use in case of litigation

>the corporate lawyers weigh the cost and effectiveness in pursuing a court case, and something released non-commercially is not worth an expensive copyright court case

4306bd  No.16698348

>>16697876

I don't think you're fully considering the scope of copyright law and what it affects.

For example, people who make mods understandably invest their time into creating a mod, and seek donations. If they had the option to make more money, they'd take it. You can see this in the case with Steam and Bethesda back when paid Skyrim mods were controversial.

I.e, you could essentially sell what someone else made— it could be reasoned that rights to the mod were of Valve and Bethesda's the entire time, and not the modmaker. Ergo publishing something you didn't make on Steam Workshop was with authorization of Valve and Bethesda anyways. This goes back with mods being made from other people's mods, and so forth.

Nowadays, people conflate the web (http/https) with the internet. No one is suddenly going to use shit like gopher just because the web is becoming uniformly anti-user even though sites on gopher don't have js.

Your point being? If you think it was thanks to patents and copyright, you put up an awfully weak argument.

>For what reason would they have had to make a steam engine?

To attain higher efficiency and effectiveness than using manual labor, and decrease costs, and thus increase profits? Inventing something solely to get a patent is retarded. People invent stuff to solve problems first and foremost. Patents would be like an 'extra' at best, not the driving reason (though regrettably today if something's not patentable and 'monetizable' it's not getting funding).

Patents supposedly act like incentives to encourage inventors to make their knowledge public in exchange for a temporary monopoly. However, the system is horribly broken as has been repeatedly observed.

>>they can better defend themself with Fair Use in case of litigation

Not a lawyer, but the system works more or less like this:

<making derivatives of/taking stuff from/reproducing stuff from any work under copyright without permission is illegal, period

<nothing's actually fair use until a judge says so

<receiving money (even if you're non-profit) makes your case even harder to defend (commercial use), though it doesn't necessarily preclude fair use

<people making stuff for free usually don't get sued because it's more trouble than it's worth, plus heaps of bad publicity and public backlash. Nothing more

4306bd  No.16698357

>>16697577

I know this is just a kneejerk reaction, but consider the current case of copyright nonenforcement in the case of user mods, works, and dojinshi. E.g Touhou where there's a load of derivative works that technically infringe the original copyright. Or wiki(a)s which not only contain copyrighted material and sometimes spoil the story, but also generate ad revenue or ask for donations (which is still legally commercial use unless entity asking for donations has non-profit status).

There is no reason to believe patents would change the market of a product, a dumb funny engine to open doors.

There is nothing to say that patents would push it past that point.

The Ancient Greeks had a flying machine: https://archive.fo/ChacD

And the Ancient Chinese had hot air balloons: https://infogalactic.com/info/Sky_lantern

It took 15 hundred years until either were taken with real consideration and turned into a practical application. Do you not find it a bit peculiar that "age old ideas" were finally taken with serious merit, as well as significantly advance the technological levels of society, during the same time that people started to make money off of their creations?

They have the exact same social values as communists. They differ on minor economic issues sometimes, but the fact that they share the same social values across the board is what clearly shows that they are indeed communists. The only reason /leftypol/ says otherwise is to try to hide the fact that their 'revolutionary working-class ideology' is in fact the same ideology as the rulers of the society and almost all corporations.

Viruses and malware that spread through removable media have existed since Microsoft first made the asinine decision of having media autorun enabled by default with Windows 95.

Infections such as Stuxnet are totally fault of retard sysadmins and IT support monkeys that still refuse to force disable autorun via registry and gpo settings for all kinds of removable media and network drives, in every on-site machine. Something I've been doing since 2009 or 2010. Nowadays I have made custom install.wim images that among other things already have autorun fully disabled by default.
