Houston-area man convicted for role in $35M COVID-19 relief fraud scheme

WASHINGTON — A Houston-area man was convicted Feb. 8 for his role in a scheme to fraudulently obtain and launder millions of dollars in forgivable Paycheck Protection Program (PPP) loans guaranteed by the Small Business Administration (SBA) under the Coronavirus Aid, Relief, and Economic Security Act.

The investigation was conducted by Homeland Security Investigations (HSI) Houston, the SBA’s Office of Inspector General, the Federal Housing Finance Agency’s Office of Inspector General (FHFA-OIG), the Federal Deposit Insurance Corporation’s Office of Inspector General (FDIC-OIG), and the Treasury Inspector General for Tax Administration (TIGTA).

A federal jury convicted Abdul Fatani, 57, of Richmond, Texas, of one count of conspiracy to commit wire fraud, one count of wire fraud and one count of unlawful monetary transactions (money laundering). He is scheduled to be sentenced on May 8. He faces a maximum penalty of 20 years in prison for conspiracy and wire fraud and 10 years in prison for money laundering. A federal district court judge will determine his sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

According to court documents and evidence presented at trial, Fatani conspired with others to submit fraudulent PPP loan applications by falsifying the number of employees and the average monthly payroll expenses of the applicant businesses. In total, the co-conspirators sought over $35 million through more than 80 fraudulent PPP loans. Fatani distributed over $500,000 in fraudulent loan proceeds to his co-conspirators and himself using bogus payroll checks and laundered a portion of the proceeds by transferring the funds from one of his bank accounts to another bank account he controlled.

In addition, 15 other individuals have pleaded guilty to their involvement in the loan fraud scheme.

Assistant Attorney General Kenneth A. Polite, Jr. of the Justice Department’s Criminal Division; U.S. Attorney Alamdar S. Hamdani for the Southern District of Texas; Special Agent in Charge Mark B. Dawson of HSI Houston; Inspector General Hannibal “Mike” Ware of the SBA-OIG; Special Agent in Charge Catherine Huber of the FHFA-OIG; Acting Inspector General Tyler Smith of the FDIC-OIG; and Inspector General J. Russell George of TIGTA made the announcement.

Trial Attorneys Kate McCarthy, Spencer Ryan, Della Sentilles and Louis Manzo of the Criminal Division’s Fraud Section and Assistant U.S. Attorney Rodolfo Ramirez for the Southern District of Texas are prosecuting the case.

“The challenges posed by a global pandemic do not allow a federal agency to exercise power that Congress has not conferred upon it. At the same time, such unprecedented circumstances provide no grounds for limiting the exercise of authorities the agency has long been recognized to have,” the top court wrote in its opinion.

Supreme Court Ruling for Requirement Applicable to Health Care Workers

In a Jan. 13 decision, the Supreme Court allowed the federal Centers for Medicare & Medicaid Services to require COVID-19 vaccination for health care workers at Medicare- and Medicaid-certified providers and suppliers.

Under the federal health care vaccine requirement, hospitals and other health care facilities must ensure their staff are fully vaccinated or risk losing Medicare and Medicaid funding. The requirement applies to about 10.3 million workers employed by 76,000 health care facilities, including ambulatory surgery centers and nursing homes. The federal requirement was implemented in November 2021.

In a survey of more than 1,000 physicians and clinicians, approximately a third disagreed with the vaccine requirements at the time.

“Neither CMS nor the Court articulates a limiting principle for why, after an unexplained and unjustified delay, an agency can regulate first and listen later, and then put more than 10 million healthcare workers to the choice of their jobs or an irreversible medical treatment,” Alito wrote in his own dissent.

Justices clash over OSHA's public health authority

The other decision, regarding the Occupational Safety and Health Administration’s (OSHA’s) large employer mandate, came to a 6-3 vote with Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan dissenting.

Here, the majority acknowledged the “billions of dollars in unrecoverable compliance causes,” “hundreds of thousands” of jobs at risk of walk-offs, thousands of deaths and “hundreds of thousands” of preventable hospitalizations cited by those for and against the requirement.

However, the court said that it is “not our role to weigh such tradeoffs” and instead considered whether Congress had “indisputably” provided OSHA with the power to regulate broad public health.

“OSHA has never before imposed such a mandate. Nor has Congress,” the court wrote. “Indeed, although Congress has enacted significant legislation addressing the COVID–19 pandemic, it has declined to enact any measure similar to what OSHA has promulgated here.”

In a dissent co-penned by Breyer, Sotomayor and Kagan, the liberal justices said that the court’s decision ignores COVID-19’s spread through person-to-person contact incurred in “nearly all workplace environments.” As such, OSHA acted under its charge in addressing workplace safety by mitigating infection risk, they wrote.

Practically speaking, Trump's emasculated the DS by prohibiting the CIA or any other governmental agency or department, from exercising its former carte blanche use of U.S. Special Forces for its clandestine operations. In essence, Trump defanged and declawed the Deep State by removing its primary operational asset, both in terms of force, lethality and speed, in carrying out its clandestine operations. Though Brandon allegedly had the power to reverse this game-changing move, he failed to do so. Instead, Brandon merely ordered that SOCOM report to a deputy Secretary of Defense rather than Austin himself. This slight change likely had more to do with Austin than anything else.

This is a critical fact to consider when attempting to analyze the byzantine operations of Western spooks and operators with boots on the ground in Ukraine, or anywhere else in the World. It is also an embarrassing "tell" for the rest of the World's Intelligence Community, that the World's most feared bully, the CIA, has finally received its long overdue comeuppance. More important, it clarifies who has come up on top in the internal civil war which has been quietly raging over the last 6 years.

Anecdotally, due to Trump's evisceration of its operational assets and resources, the Deep State has been forced to hire its own private operators primarily comprised of former SFs operators who were either dropped from U.S. Special Operations Command, or who retired/jumped ship to earn a more lucrative, but highly risky career, as a Deep State operator. Risky because these former "hunters" have now become the "hunted" as the covert civil war, mentioned above, is quickly becoming a one-sided affair.

In an interview with Fox News’ "American Reports" on Wednesday, former University of Kentucky swimmer Riley Gaines, who tied with transgender University of Pennsylvania swimmer Lia Thomas at the 2022 NCAA championships, recalled being exposed to Thomas’ "male genitalia" in a women’s locker room after a swim meet.

"We were not forewarned beforehand that we would be sharing a locker room with Lia. We did not give our consent. They did not ask for our consent. But in that locker room, we turned around and there's a 6’4" biological man dropping his pants and watching us undress and we're exposed to male genitalia," Gaines recalled.

Thomas was seen rocketing through the women’s swim ranks last year during Thomas’ first season competing in the women’s division. Previously, Thomas had competed on the male swim team.

Thomas’ season culminated in qualifying for the NCAA championships, where Thomas won the 500-yard freestyle race, and tied with Gaines in the 200-yard freestyle race.

While on the podium for the race, Gaines, who tied with Thomas for fifth place, was told that Thomas would be given the fifth place trophy to hold, and she would receive the sixth place trophy to hold on the podium. Her fifth place trophy was to be sent in the mail.

"Not even probably a year or two years ago, this would have been considered some form of sexual assault, voyeurism. But now, not even are they just allowing it to happen, it's almost as if these large organizations are encouraging it to happen," Gaines continued.

"Of course, after NCAA championships, the NCAA then nominated Thomas for NCAA Woman of the Year. So we're celebrating this movement. This isn't something that happened by chance on a one off basis. They're encouraging men to compete in women's sports," she added.

America Reports host John Roberts noted that after graduating in May of 2022, Gaines had hoped to go to dental school. In the aftermath of Lia Thomas though, Gaines has decided to put dental school on hold to advocate for women’s sports remaining a place for biological females.

Roberts questioned why more women weren’t speaking out against the inclusion of biological males, to which Gaines said, "you know, people are terrified, especially speaking from my experience of talking to other NCAA swimmers specifically, Lia Thomas’ teammates even."

"They're told their school has made their stance for them. They're told that if they feel uncomfortable seeing male genitalia in the locker room, then they should seek counseling resources. They're told that they will never get into grad school if they speak out. All of these terrible awful things that aren't true. They're told of course, they'll be called a bigot and hateful and transphobic," said Gaines.

"But it doesn't make you any of those things to acknowledge that there are two sexes. You cannot change your sex and women deserve respect and equal opportunities," Gaines concluded.

Luxury fashion house Balenciaga has announced it will partner with a children’s advocacy group after facing backlash over advertisements accused of ties to child abuse and child pornography.

On Wednesday, Balenciaga and the Kering Foundation announced they would be entering a three-year partnership with the National Children’s Alliance (NCA), a nonprofit based out of Washington D.C.

The program will focus on three main goals: Supporting National Children Alliance Mental Health Institute helping children heal from trauma by facilitating a significant increase in access to Trauma-Focused Cognitive Behavioral Training (TF-CBT), providing education for Balenciaga about child protection and actions adults can take to promote the safety and well-being of children, and raising public awareness on child abuse and child protection and promoting a happy, healthy childhood.

The press release for the partnership claims that support from Balenciaga will allow the NCA to train almost 2,000 child abuse professionals and could provide benefits to around 55,000 children receiving mental healthcare.

“We were confronted with the reality and magnitude of childhood trauma during our listening tour where we engaged with several leading organizations and experts in the field of childhood trauma,” Balenciaga President and Chief Executive Officer Cédric Charbit said in a statement.

He added that the experience has enabled Balenciaga to learn and affirmed the company’s commitment to have a positive and lasting impact on kids and their future.

The NCA serves as the national association and accrediting body of Children’s Advocacy Centers (CACs) and serves 386,000 children a year across the U.S.

In 2022, the NCA created the Mental Health Institute to increase access to “evidence based, trauma focused mental health treatment” for kids.

The announcement comes after Balenciaga apologized for two concurrent controversies surrounding imagery found in their advertisements.

In an advertisement for the Balenciaga Adidas bag collaboration, the product was placed atop a desk covered in documents. One of the documents contained text of the Supreme Court case United States v. Williams, a case focused on the distribution of child pornography.

“We apologize for displaying unsettling documents in our campaign,” a brand statement published on Instagram read. “We take this matter very seriously and are taking legal action against the parties responsible for creating the set and including unapproved items for our Spring 23 campaign photoshoot. We strongly condemn abuse of children in any form. We stand for children safety and well-being.”

Balenciaga also apologized for a separate ad campaign that featured photos of child models holding teddy bears dressed in bondage gear.
