Justice Department Participates Virtually at G7 Meeting with Security Ministers

On Sept. 8-9, 2021, U.S. Attorney General Merrick B. Garland and Deputy Attorney General Lisa O. Monaco met remotely with G7 and EU Security Ministers, along with the Secretary General of INTERPOL, to discuss responding to the rapidly evolving events in Afghanistan, as well as countering racially and ethnically motivated extremism. They were joined by Deputy Secretary John Tien of the Department of Homeland Security, who attended the London meeting in person. The Department of Justice and the Department of Homeland Security joined in a series of G7 ministerial commitments on emerging security risks and transnational crime issues. The Ministers committed to work together on:

Countering violent extremism and terrorism;

Addressing criminal conduct on the internet;

Ensuring economic security is not undermined by the threat of serious and organized crime;

Supporting global action to confront emerging issues affecting national and border security; and

Impeaching Joseph Robinette Biden, Jr., President of the United States, for high crimes and misdemeanors.

That Joseph Robinette Biden, Jr., President of the United States, is impeached for high crimes and misdemeanors and that the following articles of impeachment be exhibited to the Senate:

Article of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Joseph Robinette Biden, Jr., President of the United States, in maintenance and support of its impeachment against him for high crimes and misdemeanors.

Article I

The Constitution provides that the House of Representatives shall have the sole Power of Impeachment and that the President shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. In his conduct of the office of the President of the United States—and in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed—Joseph Robinette Biden, Jr., has abused the powers of the Presidency, in that:

Using the powers of his high office, President Biden colluded with Afghan President Ashraf Ghani on a phone call on July 23, 2021, to mislead the American people and our Nation’s allies about the status of the war in Afghanistan. In the transcript of the call, he explicitly stated, … as you know and I need not tell you the perception around the world and in parts of Afghanistan, I believe, is that things aren’t going well in terms of the fight against the Taliban. And there’s a need, whether it is true or not, there is a need to project a different picture..

His action to falsely portray the progress in the fight against the Taliban directly undermined our national security, the safety of our men and women in uniform, our allies, and the Afghan people. Furthermore, this false narrative led to the hasty and poorly planned withdrawal of United States forces from Afghanistan that resulted in the death of 13 servicemembers and wounding 18 ser­vice­mem­bers in the attack at the Kabul airport on August 26, 2021, and the stranding of an estimated 100–200 Americans in the Taliban-controlled country.

In all of this, President Biden abused the powers of the Presidency by perpetuating a false perception that the Afghan security forces were winning the war against the Taliban in an effort to manipulate the American people to support his foreign policy objectives and raise his political capital.

Wherefore, President Biden, by such conduct, has demonstrated that he is a threat to national security and the Constitution if allowed to remain in office, and has acted in a manner grossly incompatible with self-governance and the rule of law. President Biden thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States.

Article I

Antony John Blinken, in his conduct while Secretary of State, engaged in a pattern of conduct that is incompatible with his duties as an Officer of the United States, as follows:

Secretary Blinken took an oath to defend and secure our country and uphold the Constitution when he was sworn in as Secretary of State on January 26, 2021. Article II of the United States Constitution tasks the executive branch with ensuring the laws passed by Congress and signed into law by the President are faithfully executed.

Secretary Blinken has failed to faithfully uphold his oath and has instead presided over a reckless abandonment of our Nation’s interests, security, and values in his role in the withdrawal of American forces and diplomatic assets from Afghanistan.

On April 14, 2021, President Biden announced that all United States troops will begin withdrawing from Afghanistan starting May 1, 2021, and that the removal of troops would be completed by September 11, 2021.

On April 24, 2021, Pentagon officials, national security advisers, and Secretary Blinken, in a meeting with President Biden at the White House, indicated their belief that they could withdraw the remaining 3,500 American troops from Afghanistan by July 4, 2021.

During this same meeting, it was reported that the State Department articulated its ability and intention to keep the American Embassy in Kabul open and operational with more than 1,400 Americans remaining in country.

On April 27, 2021, in apparent acknowledgment of the dangers posed by a resurgent Taliban, the American Embassy in Kabul ordered nearly 3,000 members of its staff to depart.

On May 11, 2021, the Taliban—in furtherance of its speedy and sweeping campaign to recapture control of much of Afghanistan—captured the Nerkh district immediately adjacent to Kabul.

On May 15, 2021, Embassy officials sent an urgent warning to remaining Americans in the country that the U.S. Embassy strongly suggests that U.S. citizens make plans to leave Afghanistan as soon as possible..

On July 2, 2021, the American military vacated Bagram Air Base—the central United States military post in the country, including the prison on site housing over 5,000 Taliban and suspected terrorist prisoners. The hasty evacuation left these prisoners as well as significant stockpiles of American weapons and equipment unguarded resulting in the eventual liberation of prisoners and seizure of weapons and equipment by Taliban forces.

On July 8, 2021, President Biden stated there’s going to be no circumstance where you see people being lifted off the roof of an embassy of the United States from Afghanistan. It is not at all comparable..

On August 12, 2021, State Department spokesman, Ned Price, serving under the authority of Secretary Blinken stated The embassy remains open, and we plan to continue our diplomatic work in Afghanistan.. Ross Wilson, the acting United States ambassador to Afghanistan who was on the call, said the staff still needed 72 hours to leave.

On August 15, 2021, the American Flag at the United States Embassy in Kabul was taken down.

On August 15, 2021, Kabul and the Green Zone—the heart of the American diplomatic presence in Afghanistan—was recaptured by the Taliban and remains under its control.

On August 25, 2021, American citizens were still attempting to navigate through Taliban blockades, and widespread chaos on the streets of Kabul to Hamid Karzai International Airport in order to leave Afghanistan.

On August 26, 2021, Secretary Blinken’s failure to execute his duties to safely and efficiently evacuate of all United States government personnel, dependents, and private United States citizens when their lives are in danger directly gave rise to a dangerous scenario at the Kabul airport enabling terrorists to execute a deadly attack that killed eleven marines and a Navy medic and further undermined his abilities to execute his duties under 22 U.S.C. 4802(b).

Secretary Blinken’s actions, including ignoring critical intelligence received from the embassy in Kabul and United States intelligence agencies, have left American property, military equipment and weapons in the hands of enemies of the United States, left American citizens stranded in life threatening situations in dereliction of his duties as Secretary of State (22 U.S.C. 2715; 22 U.S.C. 4802). These actions have eroded American interests and security as well as our credibility and relationships amongst our closest allies. In failing to uphold his responsibilities of his office, Secretary Blinken has failed to ensure the protection of the United States Government to American citizens, property, and interests in foreign countries.

Wherefore, Antony John Blinken, by such conduct, warrants impeachment and trial, and removal from office.

Article II

Antony John Blinken, in his conduct while Secretary of State, engaged in a pattern of conduct that is incompatible with his duties as an Officer of the United States, as follows:

On August 10, 2021, as the crisis in Afghanistan was evident and worsening, Secretary Blinken’s spokesman, Ned Price, stated that the United States continues to have leverage … and the Afghan Government has tremendous leverage.. An assertion now proven obviously erroneous constituting the provision of false information to the Congress and American citizens.

On August 15, 2021, the Taliban captured Kabul, the capital of Afghanistan. Over one week later, on August 25, 2021, Secretary Blinken gave his first public briefing or interview since the collapse of Afghanistan. This is in direct violation of his statutory duty to keep the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives fully and currently informed with respect to all activities and responsibilities within the jurisdiction of these committees (22 U.S.C. 2680(b)).

On July 13, 2021, nearly two dozen American diplomats, still remaining in the Kabul embassy, sent a memo directly to Secretary Blinken through the State Department’s “dissent” channel. The cable, first reported by the Wall Street Journal on August 19, 2021, urged that evacuation flights for Afghans begin in two weeks and that the administration move faster to register them for visas.

Five days prior to Secretary Blinken receiving the cable through the dissent channel from Kabul, President Biden stated that the Afghan Government was unlikely to fall and there would be no chaotic evacuations of Americans similar to the end of Vietnam. Upon receiving the dissent cable from the Embassy, Secretary Blinken had a moral duty and was statutorily obligated to inform the Congress and American public (22 U.S.C. 2680(b)) that President Biden’s remarks needed to be clarified to prevent any confusion at home and abroad.

Throughout the month of July and into August, prior to the collapse of the Afghan Government, the United States Intelligence Community warned President Biden and his top advisors, including Secretary Blinken, that the situation in Afghanistan was worsening, the Afghan military was ill-prepared to deal with the Taliban, and a preemptive removal of American troops was ill-advised.

In direct conflict with the intelligence and advice provided by his own diplomats and the intelligence community, Secretary Blinken failed to advise and counsel the President accordingly and did not inform the Congress nor American citizens at home and abroad of the dangers posed by the advancing Taliban of which he was explicitly aware.

As a result, the Afghan Government collapsed in the month of August 2021 and American forces have been struggling to retrieve American civilians and allies, and a humanitarian crisis has erupted at Hamid Karzai Airport in Kabul. Secretary Blinken has not informed the American public nor Congress of what actions will be taken to ensure the safety of all Americans and American allies in Afghanistan.

Wherefore, Antony John Blinken, by such conduct, warrants impeachment and trial, and removal from office.

“Child predators are using more cunning and persuasive techniques and technologies to lure and exploit innocent children,” said Acting U.S. Attorney Muldrow. “The individuals who prey upon children are becoming bolder and more violent and must be stopped. As a community, we also must educate ourselves and raise awareness on how to best protect our children against these threats. We are thankful to the men and women who investigate, prosecute, and seek justice for these victims.”

Child exploitation, any form of it, is a moral abomination, and within this category of evil is a particular kind of depravity that shocks the conscience. It comes packaged in online images of children being subjected to the most vile and violent treatment. These images—images that, unfortunately, each of you has to investigate on a regular basis—contain some of the most unspeakable violations one individual can perpetrate on another. This is some of the most difficult work in law enforcement, and you are the ones doing it. Thank you.

Many in this field are part of the 61 Internet Crimes Against Children task forces supported by our Office of Juvenile Justice and Delinquency Prevention. More than 4,500 federal, state, local, and tribal law enforcement and prosecutorial agencies nationwide are working under the ICAC umbrella to combat technology-facilitated child exploitation, and we are pleased that their collaboration has yielded and continues to yield impressive results.

When it comes to protecting children, there is, regrettably, always a new challenge just around the corner. In recent years, one particular menace has been devastating American communities, with an outsized, collateral impact on our kids. Drug abuse, and in particular opioid abuse, is tearing apart families, destroying communities, and putting law enforcement officers and first responders at grave risk.

Children are particularly vulnerable to the ravages of drug abuse. Studies suggest that anywhere from a third to two-thirds of child maltreatment cases involve caregiver substance abuse. And the children of addicts are being removed from parental custody at alarming rates; with the skyrocketing deaths comes skyrocketing and permanent additions to the foster-care system. According to a recent story in The New York Times, the number of children in foster care since 2010 has doubled in Montana, and has increased by eighty percent in Georgia and forty-five percent in West Virginia.

The line between drug abuse and child maltreatment is short, direct, and well documented. It has always been the case that in homes where there are drugs, children suffer. But with opioids, the problem seems particularly pervasive and menacing—and like an aggressive malignancy it is metastasizing across the nation. We need to be prepared for the predators who will take advantage of these vulnerable, abandoned children—the opioid orphans.

AMBER Alert is a centerpiece of our child protection efforts and one of the most valuable public safety tools we have at our disposal. Thanks to a strong network of law enforcement partners, transportation officials, and state coordinators, and an ever-expanding secondary distribution system of Internet providers and wireless carriers, the AMBER Alert program has helped to recover more than 920 abducted children.

It would be easy to feel overwhelmed by these numbers. A single case involving a missing or exploited child can be complicated, time-intensive, and resource-draining. Multiplied into the thousands, the problem can seem hopeless.

But it isn’t. The professionals we’re honoring today have shown what an enormous difference a well-constructed investigation can make – in the life of one child, a dozen children, scores of children in a single case. These skilled detectives epitomize the tenacity and resolve of investigators across the country – federal, state, local, and tribal officials working together to find missing and exploited children and bring them home to safety.

Addressing the problem of online child exploitation requires that all of civil society work collaboratively – including law enforcement, non-governmental organizations, private industry, and individual citizens. As we will hear today, journalists also play an essential role in educating the public and telling the stories of brave survivors like our panelist Sarah Cooper, who has come forward to share her experience. I am fortunate to be followed by a distinguished panel that includes leaders who have done amazing work to inform the public and to keep children safe.

When I say online child exploitation, I am referring to the use of social media platforms, apps, and electronic devices like computers and smart phones to victimize children via the Internet. Most are you are likely familiar with the scourge of online child abuse images – properly referred to as Child Sexual Abuse Material or CSAM. Every year, individuals produce and share millions of photos and videos depicting the abuse of minors, which are spread around the world using encrypted technologies and the dark web.

Moreover, exploitation and abuse that begins online in the virtual world often leads to abuse in the real world. In an all-too-common scenario, a predator can use social media to make contact with a child, spend time grooming her to build trust, and then attempt to meet in person to engage in abuse. Predators can also use social media and other platforms to coerce minor victims into sharing explicit images of themselves, and then blackmail the victims into paying money, producing more explicit content, or engaging in sexual acts. This is referred to as “sextortion,” and those cases are on the rise.

The reality is that these types of crimes are not rare – they are occurring in our communities throughout the country on a daily basis. The National Center for Missing & Exploited Children or NCMEC, which operates a centralized reporting system for online child exploitation, received 16.9 million reports of suspected abuse last year alone. Those reports included over 69 million photos, videos, and other files related to child sexual exploitation, many of which involved children younger than 10-years-old. Over the years, NCMEC analysts have done the harrowing work of reviewing more than 312 million images and videos of potential abuse, and, as a result, law enforcement has identified more than 18,900 child victims to date. Unfortunately, there are many more who have not been identified.

Because of school closings, shutdowns, and the cancellation of many in-person activities and events, children are spending more and more time online. Many children are now using webcams – some for the first time – to participate in remote learning and to communicate with loved ones. This increased familiarity with sharing personal images online can lull children into a false sense of comfort. At the same time, kids are often less supervised because parents and guardians must leave for work or spend their time at home teleworking. We are fortunate to have advanced technology that provides us the means to stay connected with friends and family, to learn and work remotely, and to participate in virtual events like this one. However, that same technology also provides predators with pathways into our homes that can be used to target children for sexual exploitation.

The good news is that the Department of Justice and our state and local partners have a long track record of successfully investigating and prosecuting child exploitation crimes.

Methamidophos, sold in Mexico under the trade names Metaldane 600, Tamaron or Monitor, is one of the most acutely toxic organophosphate pesticides and is similar to a class of chemicals that were originally manufactured as chemical warfare nerve agents.

Furadan contains the cancelled pesticide carbofuran, which is a highly toxic insecticide that affects the central nervous systems by the same mechanism as chemical warfare nerve agents. It is highly toxic to birds, fish and mammals and is classified by the EPA as Toxicity Category I, the highest category, based upon its lethal potency. Monitor contains the cancelled pesticide methamidophos, which is one of the most acutely toxic organophosphate pesticides, also related to chemical warfare nerve agents. Rodentox contains zinc phosphide, an extremely toxic rodenticide. Ingestion of 7 drops to one teaspoons of zinc phosphide would likely kill a 150-pound person.

After it is ingested, the zinc phosphide reacts with acid in the stomach, producing phosphine gas, which blocks cells from making energy, killing the cells. Phosphine gas can also be produced in the stomach if zinc phosphide dust is inhaled and swallowed after clearing from the lungs. The use of these chemicals poses a danger to humans and wildlife that might come in contact with them, as well as cannabis users who ingest products treated with them. Moreover, these chemicals are known to have injured law enforcement officers engaged in the eradication of illegal marijuana cultivation sites in California.

Agents raided Newell’s home, truck and law office, and said they found a hard drive in his den that contained numerous videos of naked young men showering. Newell was captured on the footage setting the camera up and in one clip, could be seen searching a naked young man for ticks, the Sun reported.

Newell denied setting up the camera — but investigators said they caught him trying to chew up and swallow a memory card when he was first confronted with the allegations.

As alleged in the affidavit in support of a criminal complaint, Zaidi offered his services to the Supreme Leader of Iran in or around July 2015 and said that he could serve the “Islamic Republic in the socio-political or another field.” The complaint alleges that Zaidi traveled to Syria in or around June 2018 and that, while there, flew to an active war zone in an armed Iranian military or intelligence aircraft. The complaint alleges that Zaidi had access to bases under the command of Iran’s Islamic Revolutionary Guard Corps (IRGC) while in that war zone, including a “Sepah Qods” (IRGC Qods Force) base. The IRGC was designated as a terrorist organization by the U.S on April 4, 2019. Qassem Soleimani, a major general in the IRGC, was commander of the Qods Force until he was killed in a U.S. airstrike on Jan. 3, 2020.

According to the complaint, in December 2018, Zaidi and other members of an organization known as “Islamic Pulse,” including Chawla, received the permission of the Supreme Leader of Iran to collect khums, a religious tax, on the Supreme Leader’s behalf, and to send half of that money to Yemen. The complaint alleges that permission was formalized on or about Feb. 28, 2019, in a letter confirming the permission of the Supreme Leader of Iran and another Ayatollah to spend khums money in Yemen.

Based on the complaint, in or around July 2019, Islamic Pulse released a video soliciting donations for its purported Yemen campaign that showed money moving from the United States and other Western countries to Yemen through Iran. The complaint alleges that Chawla replied to donors’ concerns about how the campaign was able to get money into Yemen by stating that the matter could not be discussed over email. The complaint further alleges that Chawla sought U.S. dollars specifically, stated that Islamic Pulse could not accept electronic transfers, and admitted that Islamic Pulse was not a registered charity.

The complaint alleges that after the United States placed sanctions on the Supreme Leader of Iran in June 2019, Zaidi told Naqvi that the action was a “straight hit on khums.” The complaint alleges that in summer and fall 2019 Zaidi and Naqvi continued to collect U.S. currency in the United States and have it transported it to Iran, sometimes via Iraq, structured in such a way as to avoid reporting requirements. After a group of 25 travelers carried money destined for Iran on behalf of Zaidi and Naqvi in October 2019, Zaidi and Naqvi discussed the screening the travelers underwent at the airport and Naqvi’s hope that none of the travelers would confess to authorities upon their return.

The complaint alleges that, during his current stay in the United States, which began in June 2020, Zaidi has exhibited behavior that is consistent with having received training from a foreign government or foreign intelligence service, such as the government of Iran or IRGC. According to the complaint, that behavior includes a reluctance to discuss matters over the phone, or even over encrypted applications, because Zaidi claims that doing so could be dangerous.

The charges in criminal complaints are merely allegations, and every defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt. The maximum penalty for a violation of 18 U.S.C. § 951 is 10 years, and the maximum penalty for a violation of the International Emergency Economic Powers Act is 20 years. The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes.

The investigation into this matter was conducted by the FBI’s Washington Field Office and Houston Field Office. The case is being prosecuted by the National Security Section of the U.S. Attorney’s Office for the District of Columbia, along with the Counterintelligence and Export Control Section and Counterterrorism Section of the National Security Division of the Department of Justice.

Tuscaloosa Man Sentenced to 600 Years in Prison for Sexual Exploitation of Children

BIRMINGHAM, Ala. – A federal judge today sentenced a Tuscaloosa man for sexually exploiting two young children, announced U.S. Attorney Prim F. Escalona and FBI Special Agent in Charge Johnnie Sharp, Jr.

Chief U.S. District Judge L. Scott Coogler sentenced MATTHEW MILLER, 32, to 7,200 months in prison for producing child pornography. Miller was charged in a 20-count indictment for enticing two children under the age of 5 to engage in sexual explicit conduct for the purpose of producing a visual production of such conduct. A search warrant was obtained for the defendant’s electronic devices. The forensic examination of those devices revealed 102 pornographic images that the defendant had produced of the children. Miller pled guilty to these charges in October 2019.

“Child predators seek out and victimize those that are the most innocent and vulnerable - children,” Escalona said. “The sentences imposed today and yesterday in local child exploitation cases reflect the commitment of law enforcement in this district to prosecuting to the fullest extent of the law those who commit crimes against children.”

“The crimes for which Miller has admitted guilt are not only disturbing, they are sickening, and his actions robbed these children of their childhood,” Sharp said. “I am proud of the work of the FBI on this case, and I applaud the sentence handed down today, as Miller will spend the rest of his natural life behind prison bars.”

FBI Child Exploitation and Human Trafficking Task Force investigated the case, along with the Tuscaloosa County Sheriff’s Office Violent Crime Unit. Assistant U.S. Attorney R. Leann White prosecuted the case.
