1931年12月公布的《中华苏维埃共和国劳动法》宣布实行八小时工作制，规定最低工资标准，实行劳动保护、社会保险和失业救助，确定工会的法律地位。刘少奇认为《劳动法》的左倾错误严重，提出了灵活执行劳动法的措施，于1933年10月修改了部分条文
他在1933年“二七”全总召集的各省青工部长会议上说：“个人的利益要服从团体的利益，团体的利益要服从国家的利益。工人在自己的政权下不能罢工，罢工是对国民党，对帝国主义，对资本家的斗争方式。”
