Talking from prior software civil cases. You need to have proof that clear chunks of codes were ripped out of the original. Close plagiarisms can only make a case if their original contracts indicated the end product to be 1) trademarked, or 2) upheld as a trade secret. Otherwise, the only clear cut way to quantify plagiarism is that the chinks forgot to scrub out the original programmer's signatures and comments in the code.
>the one who cannot equate the obvious and incredibly suspicious correlations between the two
Except that's not how courts work at all. While circumstantial evidence works quite well in criminal cases due to legal precedents, it really doesn't in civil and corporate cases. For the people, it has to be airtight and beyond doubt. For the government, it depends on your skin colour, media and if someone shat in the judge's weetabix that day.

Fortnite has been around for a long time the original game is a FPS tower defence, the battle royale game mode was something they threw together in a few weeks when they saw the success of PUBG despite how shitty it is.
Battle royale is literally just deathmatch with respawn disabled.
>Red Dead 2 sweeps in with it's Battle Royal and kills them both
Thats unlikely, Fortnite's success is largely due to how well it runs. What Epic was showing off at GDC wasn't what new hats they were adding to Fortnite but instead all the various improvements to the game engine the best was the netcode tech which allows almost flawless replays of the entire match to be captured, its a game made by engineers rather than marketers. Epic is a company of engineers since their main product is a game engine, R* is a company full of marketers since their product is hype.

>I doubt it's that simple, especially when it was a client/customer relationship that made them privy to the information to copy their clients product.
It really is. As long as your case isn't airtight, in the case of software it means copyrighting certain mechanics, functions and code arrays, you have no grounds to stand on it court unless someone screws the pooch someplace else like demonstrably having chunks of identification codes in the source or comments that belong to the original author. Plus while the public can say that epic copied from pubg after helping them develop the engine to support a battle royale format, most contracts in the industry that I am aware of always reserves general technical knowledge to be domain of the provider in the case of cooperative relationship if said knowledge isn't good enough to be considered the client's trade secrets. What can be protected are tracts of code which can be signatured, marked or even registered as an IP if it is a novel way to provide for a function (which I doubt PUBG's source comes even close to novel). Having Epic help work on PUBG has effectively cause Epic to be stakeholder (not a shareholder) in the project and no court will uphold them using knowledge learned from said project to generate their own product given that PuBG itself doesn't qualify as a novel IP.
