Reformist District Attorney Larry Krasner Argues Pennsylvania Death Penalty Is Unconstitutional

Philadelphia District Attorney Larry Krasner, who campaigned in 2017 as an unequivocal opponent of the death penalty, asked the Pennsylvania Supreme Court in a legal filing Monday night to declare the state’s death penalty system unconstitutional.

The death penalty as it stands “cannot survive the state Constitution’s ban on cruel punishments,” Krasner wrote in a brief he submitted to the state’s high court. He cited a study, conducted by his office, that revealed a startling 72 percent of Philadelphia death sentences were overturned during post-conviction review between 1978 and 2017, often due to ineffective legal representation. In a justice system rife with racial disparities, that 37 of the 45 people from Philadelphia currently on death row are black adds even more cause for concern, Krasner argued.

While grassroots opposition to the death penalty has grown with increasing evidence of wrongful convictions, it is rare for prosecutors themselves to call for its end. Krasner joins a small group of prosecutors who have called for their states to end the death penalty — where it still exists — including Boulder County District Attorney Michael Dougherty in Colorado, King County Prosecuting Attorney Dan Satterberg in Washington, and former Washoe County homicide prosecutor Thomas Viloria of Nevada.

Krasner’s declared opposition to his state’s death penalty comes after a week during which his office was embroiled in a high-profile controversy with Attorney General Josh Shapiro, whose office was recently granted authority by the legislature to prosecute some gun crimes in Philadelphia — a move that was viewed as an attempt to undermine Krasner’s prosecutorial reforms. Shapiro says he did not ask to have jurisdiction over gun crimes in Philadelphia County alone. On Friday, under pressure from activists, he said he would support a repeal of the new law.

The reformist district attorney’s filing once again pits him against Shapiro’s office, which defends state laws that face legal challenges. Last summer, the attorney general opposed a request by the Philadelphia federal defender’s office that the state Supreme Court declare the death penalty unconstitutional. Shapiro argued that, if the Supreme Court agreed to do so, it would be overstepping its authority by setting policy from the bench.

Day-long confab brings senior admin officials, experts together to combat Jew hatred

The Trump administration is working on multiple fronts to investigate and combat a rising tide of anti-Semitism in America that top officials warned is spreading across the country via a network of far left, anti-Israel activists, who seek to mainstream hatred against Jews at the nation's college campuses and elsewhere.

During a daylong conference, the first of its kind for this administration, senior administration officials from across the government gathered with legal experts and scholars to address the growing threat of anti-Semitism, which has resurged in America and across the globe in recent years.

Officials provided disturbing information about the uptick in anti-Jewish violence across the U.S.

"Far too often, Jews and Jewish communities in America suffer outside the spotlight," Attorney General William Barr said as he kicked off the event. Illegal Aliens Released from Local Custody Commit More Crimes—Honduran Freed 10 Times

Following a Judicial Watch lawsuit, the Department of Homeland Security (DHS) has reinstated a reporting system that informs the public about illegal immigrants who commit crimes after being released from state or local custody. The offenders are shielded by sanctuary policies that ban local law enforcement from honoring Immigration and Customs Enforcement (ICE) detainers placed on illegal aliens who have been arrested on local criminal charges. If the detainer is honored ICE takes custody and deports the criminal rather than release him or her back into the community. When law enforcement agencies fail to honor immigration detainers and release serious criminal offenders, it undermines the federal government’s duty to protect public safety.

To pressure municipalities that protect illegal aliens, the Trump administration published weekly Declined Detainer Outcome Reports highlighting state and local governments that did not comply with ICE’s detainer program. The troublesome logs included details of illegal aliens who committed all sorts of atrocious crimes after local authorities let them go and identified the law enforcement agency that released them. Published on ICE’s website, the reports ignited outrage among open borders groups and their mainstream media allies, who complained that the information was controversial and discriminatory. One mainstream media outlet actually reported that “immigration advocates also criticized the list for singling out the criminals among undocumented immigrants without acknowledging the contributions of the broader population to their communities.”

DHS caved into the pressure and temporarily suspended the informative weekly Declined Detainer Outcome Reports. Judicial Watch immediately launched an investigation, requesting records from the agency under the Freedom of Information Act (FOIA) and subsequently suing for the information. Sanctuary cities violate federal law and put the public at risk. In the last decade Judicial Watch has also gone to court to fight sanctuary policies nationwide, including in Arizona, California, Illinois, the District of Columbia and Texas, to name a few. In California alone, Judicial Watch has sued several municipalities for protecting illegal immigrant criminals. Among them are San Francisco, Los Angeles and Pasadena, though practically the entire state shields illegal immigrants from the feds, including serious criminals.

A friend of mine recently commented that if the current trend to reduce the study of history in schools to easily digestible politically correct soundbites that are being successfully pushed by social justice warriors continues, we will soon be limited to discussing how horrible slavery was, the Stonewall Inn riots and the so-called holocaust. Indeed, it seems that those who complain the loudest are the only ones listened to and no one complains more often or at greater volume than American Jewish groups intent on preserving the benefits that are derived from always being able to claim their perpetual victimhood.

Recent media accounts from Florida detail how low pandering to Israeli and Jewish interests can go. A high school principal identified as Dr. William Latson was removed from his position after he revealed to a parent that he considered the holocaust to be a belief and not a demonstrated fact. According to statement made by the school district, the action was taken “out of an abundance of concern” for students and staff after Latson had “made a grave error in judgment.” It added that “In addition to being offensive, the principal’s statement is not supported by either the School District Administration or the School Board.”

The story took place in the School District of Palm Beach County. Latson, now the ex-principal of Spanish River High School in West Palm Beach, presided over his school in a heavily Jewish district that includes Boca Raton. Latson is currently being considered for reassignment by the school district though there are have also been recurring calls from county and state legislators to fire him, which will undoubtedly occur.

The tale is somewhat convoluted and there are some disagreements about what actually took place, but it goes basically like this: roughly one year ago a high school parent, unidentified but presumably Jewish, emailed Latson asking him to confirm that holocaust education was a top priority in Spanish River H.S. He responded by email that the school has a “variety of activities” for holocaust education but “Not everyone believes the Holocaust happened. And you have your thoughts, but we are a public school and not all of our parents have the same beliefs.” He added that an educator has “the role to be politically neutral but support all groups in the school… I can’t say the Holocaust is a factual, historical event because I am not in a position to do so as a school district employee.”

Going Quiet: More States Are Hiding 911 Recordings From Families, Lawyers and the General Public

Troy Phillips has tried everything to piece together his brother's final moments and figure out if he received CPR. Rhode Island's secretive 911 laws have gotten in the way.

Troy Phillips was repairing a propane filling station on Cape Cod one afternoon last October when his mother called, her voice frantic.

“Something happened to Scott!”

Phillips’ younger brother Scott had been rushed to the hospital. Troy’s first thought was that Scott, who worked as a truck driver, must have been hurt in an accident. His mother was so upset on the phone that he could barely understand what she was saying.

Then she blurted out, “He died!”

At Rhode Island Hospital, Phillips learned that his 46-year-old brother had stopped for lunch at a Subway sandwich shop, in Cranston, when he collapsed.

The cause of death was hypertensive cardiovascular disease, according to his death certificate.

In the months since his brother’s death, Phillips — a volunteer firefighter and licensed EMT — has been trying to piece together what happened the day Scott died.

“Being an EMT,” Troy Phillips said, “you just want to know, what happened?”

But he keeps hitting a wall.

Rhode Island is one of about a dozen states that prohibit the release of 911 recordings or transcripts without the written consent of the caller or by court order. The goal generally is to protect the privacy of callers in what may be one of the most stressful moments of their lives.

But Rhode Island’s restrictive law also keeps families in the dark about how the state’s 911 system has responded to calls involving their loved ones, and it has left the public oblivious to troubling gaps in how the system is performing, according to an investigation by The Public’s Radio and ProPublica.

In March, the news organizations reported on the 2018 death of a 6-month-old baby in Warwick after a Rhode Island 911 call taker failed to give CPR instructions to the family. The lapse came to light after a family member who took part in the 911 call requested a copy of the recording.

In June, the news organizations reported on the death of Rena Fleury, a 45-year-old woman who collapsed while watching her son’s high school football game in Cumberland last year. Four unidentified bystanders called 911. But none of the 911 call takers recognized that Fleury was in cardiac arrest. And none of them instructed the callers to perform CPR.

The 911 recordings for Fleury were never made public. An emergency physician who treated Fleury testified about what happened during a state House committee hearing in March.

Across the country, recordings of 911 calls for accidents, medical emergencies, mass shootings and natural disasters have provided insight into the workings of public safety systems and, in some cases, revealed critical failings.

After the Pulse nightclub shootings in Orlando in 2016, recordings of 911 calls showed operators whose lines were so flooded they had to disconnect with some of the victims inside the club so they could answer other calls.

After Hurricane Harvey hit Texas in 2017, recordings of 911 calls exposed systemic problems in the 911 center. Information about a woman’s deteriorating medical condition wasn’t communicated from one call taker to another, as required by national guidelines, The New York Times reported.

And in Maine, transcripts of a 911 call made by two teenagers minutes before they were killed by their landlord in 2012 showed that the teenagers had reported the landlord’s “death threats.” Police who responded to the 911 call had concluded it was a “civil matter” and left.

Esper Refuses to Recuse Himself on Raytheon Matters in SecDef Confirmation Hearing

Army Secretary Mark Esper appeared headed to easy confirmation as defense secretary until late in his Senate Armed Services Committee hearing Tuesday morning, when he was confronted by Sen. Elizabeth Warren, D-Massachusetts.

In heated exchanges, Warren demanded to know whether Esper would recuse himself on Defense Department decisions involving Raytheon, decline to seek waivers that would allow him to weigh in on Raytheon matters and agree to refrain from lobbying for four years after he leaves office.

On all three issues, Esper said, "No, I won't."

"This is outrageous," Warren said. "That means you should not be confirmed as secretary of defense."

Esper worked for seven years as Raytheon’s top lobbyist before assuming his current role as Army secretary. When he took the post in 2017, he agreed to recuse himself for two years on Raytheon matters; that agreement expires in November.

Warren cited the example of former Acting Defense Secretary Patrick Shanahan, a former top executive at Boeing, who recused himself from any matters involving the company for the duration of his service at the Defense Department.

"I can't explain why he made that commitment," Esper said of Shanahan.

Warren said, "I'll take that as a 'Yes,' you're not willing to make that commitment."

In a letter to Esper she released Monday, Warren wrote, "I am troubled by your unwillingness to fully address your real and perceived conflicts of interest, and write to ask that you reconsider your refusal to extend your Raytheon recusal [as Army secretary] through the duration of your tenure at DoD."

After Warren left the hearing room, Sen. Jim Inhofe, R-Oklahoma, the committee's chairman, took the unusual step of apologizing to Esper on behalf of the committee. "I apologize for what you had to be confronted with. It was unfair," he said.

Sen. Dan Sullivan, R-Alaska, the next questioner, sought to defend Esper's corporate ties.

Sullivan said that, in Warren's view, "Anybody who comes from the corporate world is corrupt."

He asked Esper: "Have you ever been accused of corruption?"

Esper responded, "No sir, never in my life."

Sen. Rick Scott, R-Florida, later charged that Warren had "demonized" Esper because he had worked in the corporate sector.

"I guess she just needed a moment for her presidential campaign," Scott said of Warren, a contender for the Democratic presidential nomination.

Earlier, Inhofe noted the challenge Esper would face in countering China and Russia under the National Defense Strategy while turning around a military that has been focused on counterterrorism since the 9/11 attacks.

Sen. Jack Reed, D-Rhode Island, warned Esper of the pitfalls ahead in serving as the chief military advisor to an unpredictable commander-in-chief.

He said it would be Esper's duty to give his best advice "even if the president disagrees with your counsel and it runs contrary to his policy goals."

Reed also stressed that it is critical for Esper to end the constant reshuffle of top Pentagon leadership that has taken place since Mattis left.

"I am concerned that the Defense Department is adrift," Reed said in reference to at least 16 top posts at the Pentagon that are either vacant or have officials serving in an acting position.

In later testimony, Esper echoed Reed's concerns, stressing the "need to staff up the top tier of the Pentagon soonest."

It is an inventory and control plan; inventory of all land, water, all minerals, all plants, all animals, all construction, all means of production, all food, all energy, all information, and all human beings in the world.” It’s about moving populations into concentrated city centers and clearing them out of rural areas under “Smart Growth.” Under the guise of “Sustainability,” Agenda 21 is the hijacking of the environmental movement.

Agenda 21 is top-down hierarchy, moving away from current government structure based on elected positions in Federal-State-County-City, to a global-regional-neighborhood structure without elections. Currently hundreds of millions of federal dollars are going to cities to create regional plans to give over control of land, and land use, to corporations. For instance, the federal government gave the Telecom Industry new powers to sidestep over the public right-of-way for the roll out of 5G technology by removing regulatory barriers that might prevent infrastructure.

In an order last year by the Federal Communications Commission (FCC), If Verizon wants to build a 5G network in a city, the local government is limited in how much it can charge in application fees, and is pushed to approve permits quickly.These rules also mean cities are limited in how they can respond to residents who are upset about equipment going up near them. Many local leaders have spoken out against the FCC’s rules, dozens of whom have banded together to file a lawsuit to overturn it, which has advanced to the Tenth Circuit.

“[T]he FCC is forcing cities to race to the courthouse to defend the most basic of local government rights—the authority to manage and seek fair compensation from private users that seek to employ public assets,” Tom Cochran, the CEO and executive director of the U.S. Conference of Mayors, said in a statement.

Israeli minister accuses UK’s Corbyn of Jew-hatred

An Israeli official close to Prime Minister Benjamin Netanyahu accused British Labour Party leader Jeremy Corbyn of Jew-hatred on Tuesday, remarks likely to fuel acrimony in and around the opposition party as it struggles with anti-Semitism probes, reports Reuters.

A BBC Panorama exposes aired last week said Corbyn’s office had interfered in independent party discipline processes aimed at rooting out anti-Semitic conduct. Labour, the main opposition party in Conservative-led Britain, denied this.

Netanyahu’s rightist government has largely reserved comment on the furore over Corbyn – a veteran and vocal pro-Palestinian campaigner – with aides citing reluctance to be perceived as meddling in Britain’s internal affairs.

But two Israeli officials parted from that reticence on Tuesday when asked about the BBC Panorama findings.

Zeev Elkin, a member of Netanyahu’s security cabinet and Likud party, told Israel’s Army Radio in an interview:

We don’t decide for the British who to vote for, of course, but we have to state our position. I think Corbyn has proven himself, more than once or twice, to be a figure who quite hates the State of Israel and hates the Jewish people.

People often try to hide behind this anti-Israeli mantle and say, ‘We are not anti-Semitic, we’re only criticising the State of Israel and its policy’. And the example of what’s happening in the Labour Party under Corbyn shows the extent to which this cover is no true cover.

Israeli Deputy Foreign Minister Tzipi Hotovely said of the BBC Panorama findings: “We certainly see this as a very grave matter”.

“There is no doubt that Labour, in Corbyn’s image, is a very big problem for Israel’s foreign relations,” she told Israel’s Reshet 13 TV.

Asked if Elkin’s and Hotovely’s comments reflected Israeli government thinking, Netanyahu’s office had no immediate response.

Corbyn has long denied being anti-Semitic – an accusation also levelled against him on Monday by the frontrunner to become Britain’s next prime minister, Boris Johnson of the Conservative Party.

The festering controversy has played a part in British Labour’s failure to take electoral advantage of the Conservative government’s turmoil over Brexit.

Israeli settler groups are turning the Israel-Palestine narrative on its head, accusing Palestinians of trying to illegally steal land in the West Bank’s Area C.

Jerusalem — In a move designed to shock Israeli settlers in the West Bank into action, activists from the right-wing settler organization “Regavim” hung Palestinian flags along the main West Bank settler roads last week.

Regavim claims that there is a Palestinian take over of Area C and that the Israeli government is not doing enough to fight it. The organization’s PR stunt, shown in the video below, was in their own words “an in-your-face challenge to the הכנסת (Knesset) to enforce the law and halt the de facto creation of a terrorist state in the heart of Israel.”

Regavim also published, “a comprehensive, in-depth report” titled, “The Roots of Evil, Land Theft in Area C is Creating a De Facto Palestinian State.” In the report, the group claims that it has exposed a “secretive program undertaken by the Palestinian Authority, with massive financial support provided by the European Union, European governments, and other foreign interests.” The secret program, which Regavim has dubbed “The Roots Project,” is allegedly a systematic program of land theft by Palestinians which targets areas placed under full Israeli jurisdiction by the Oslo Accords and international law. The report alleges that the PA is taking advantage of a legal loophole in order to effectively annex territory throughout Judea and Samaria (the West Bank) through seemingly-innocuous agricultural projects.

“Regavim’s report indicates that the response of the Israeli authorities, including the government, the Civil Administration, and the Ministry of Foreign Affairs, has been extremely phlegmatic, and often non-existent. The Civil Administration, which is responsible for the protection of Israel’s land resources in Area C, addresses this illegal activity on a case by case basis, and for all intents and purposes does not take steps to stem the tide of creeping annexation,” the report reads.

UK schools that teach LGBT lessons are neglecting the religious beliefs of parents, a protest activist told RT. Britain’s anti-extremism body has criticized the government for being “too slow” to quell outrage over the issue.

In Birmingham, dozens of Muslim parents are rallying in front of a school that started offering LGBT equality lessons. They demand that teachers stop using storybooks they say proselytize same-sex relationships and a homosexual way of life.

“We need to devise a program with parents, with the schools, with Ofsted [the Office for Standards in Education] and the [Department for Education] to have a program that allows… schools to stop discrimination but not by infringing on parent’s [religious] beliefs,” Shakeel Afsar, activist and protest coordinator, told RT.

Where the schools have gone wrong is that “they have not consulted parents in a meaningful way,” he said.

The men were found in possession of an air-to-air missile and Nazi paraphernalia. In addition to the missile, which has no explosive but “resettable” charge, Digos investigators seized 9 assault rifles, a submachine gun, 7 guns, 3 shotguns, 20 bayonets, nearly a thousand cartridges and many parts of weapons.

The three man are as follows: Fabio Del Bergiolo, Fabio Bernardi and Swiss citizen Alessandro Monti.

Fabio Del Bergiolo is known as having ran for the Italian Senate in 2001 as a candidate for the Forza Nuova party. The Forza Nuova is an extreme right party.

The political party Forza Nuova has denied any current connection with Del Bergiolo.

“If one of the arrested was a candidate of Forza Nuova way back in 2001 (18 years ago!), we affirm that on the contrary none of the people involved have been militants of Forza Nuova – which has nothing to do with the search this morning,” a press officer for Forza Nuova told CNN.

Bergiolo’s lawyer explained that his client was a “weapons enthusiast.” And what self-respecting weapon enthusiast doesn’t have an air-to-air missile in his collection.

“My client is a collector and they sequestered weapons that were in his home. These weapons were not registered, but they were not connected to terrorism,” Moscatelli said.

“There was a misunderstanding with the Nazi paraphernalia, he also had fascist and USSR paraphernalia, but they (the police) only took things with swastikas,” he added.

After all, in some countries in Europe possession and sale of Nazi paraphernalia is prohibited by law. And, to be fair, Italy isn’t one of them.

Bergiolo was arrested for acting as an intermediary in the weapons’ sale, while the other two for the alleged possession and intent to sell the arms.

Now, this is where the story gets interesting:

CNN reported that the three men were arrested as a result of a police investigation of Italians “with extremist ideology” who had fought alongside Russian-backed separatist forces in Donbass, eastern Ukraine in July 2018. Thus, CNN claimed the three men had fought alongside the Donetsk and Luhansk People’s Republics.

As Wall Street Celebrates Rising Stock Prices, Companies Are Literally Shutting Down All Over America

How long can the stock market possibly stay completely disconnected from economic reality? On Monday, the Dow Jones Industrial Average rose just 27 points, but that was good enough to push it to yet another new all-time record high. Investors have been absolutely thrilled by the extremely impressive bull run that we have witnessed so far in 2019, but there is no way that this is sustainable. Wall Street may be celebrating for the moment, but meanwhile all of the hard economic numbers are telling us that we have now entered a new economic slowdown. Just like in 2008, it appears to be inevitable that the party on Wall Street is about to hit a brick wall, but nobody should be surprised when it happens. Everywhere around us there are signs of economic trouble, and right now companies are literally shutting down all over America.

For example, just take a look at what is happening to the trucking industry. I recently warned about the trucking “bloodbath” that was unfolding, and over the past week it has greatly accelerated.

On the 12th of July, we learned that trucking giant LME had abruptly shut down. The following comes from Zero Hedge…

Less-than-truckload carrier LME has reportedly “suddenly and abruptly” shut down its operations, according to FreightWaves.

The company is a regional carrier based in Minnesota that operated throughout the Midwest. The company had terminals in 30 locations across the U.S. and through interline agreements services all of North America. It also worked with major companies like 3M, John Deere and Toro.

The company reportedly included “over 600 men and women” and has been listed as having 382 power units and 1,228 trailers, with 424 truck drivers.

Then today we learned that Timmerman Starlite Trucking suddenly shut down without any notice…

40 year old California trucking outlet Timmerman Starlite Trucking, Inc. is the latest victim in the “trucking apocalypse” and announced that it would be shutting down effective immediately, according to FreightWaves.

30 employees are expected to lose their jobs as a result. The company is based in a mid sized city about 100 miles east of San Francisco and had a fleet of 30 trucks, 150 trailers and 28 drivers.

The company’s owner cited “a tough freight market and environmental regulations” as reasons for the shut down. The company announced the shutdown on its Facebook page.

Of course those two trucking companies are definitely not the only victims of this “bloodbath”. According to Business Insider, ALA Trucking, Williams Trucking, Falcon Transport and New England Motor Freight have also completely ceased operations in 2019.

If the U.S. economy really was “booming”, this would not be happening.
