Lawyers blame ChatGPT for tricking them into citing bogus case law

NEW YORK (AP) — Two apologetic lawyers responding to an angry judge in Manhattan federal court blamed ChatGPT Thursday for tricking them into including fictitious legal research in a court filing.

Attorneys Steven A. Schwartz and Peter LoDuca are facing possible punishment over a filing in a lawsuit against an airline that included references to past court cases that Schwartz thought were real, but were actually invented by the artificial intelligence-powered chatbot.

Schwartz explained that he used the groundbreaking program as he hunted for legal precedents supporting a client’s case against the Colombian airline Avianca for an injury incurred on a 2019 flight.

The chatbot, which has fascinated the world with its production of essay-like answers to prompts from users, suggested several cases involving aviation mishaps that Schwartz hadn’t been able to find through usual methods used at his law firm.

The problem was, several of those cases weren’t real or involved airlines that didn’t exist.

Jumping ahead of a pending judge's punishment, two federal prosecutors volunteered to be reassigned from their posts in U.S. District Attorney Alexander Acosta's Office.

The pair faced stiff penalties for allegedly trying to get an edge on the defense in a malpractice case by eavesdropping on recorded phone conversations between witnesses and the defense attorney.

A federal judge called their actions "flagrant" and had planned to deal with Prosecutor Sean Cronin and his boss, Narcotics Section Chief Karen Gilbert, in a written order.

But Cronin and Gilbert opted to take their punishment in their own hands if you believe Acosta, who probably had a little something to do with the decision.

Gilbert stepped down from her post and Cronin asked to be transferred from the criminal division, according to court records.

Hard to believe the two would give up after showing so much zeal in trying to convict Dr. Ali Shaygan, was acquitted of all 141 counts of writing illegal prescriptions.

The pair arranged for two witnesses to secretly tape record telephone calls with defense attorney David Markus and his investigator. They were ratted out by one of the witnesses on the stand, which prompted an investigation. Acosta said he knew nothing of the plan.

DHS wanted to track internet users with ‘risk score’ – think tank

The ‘Night Fury’ program sought to use automated methods to detect supposedly “pro-terrorist” social media accounts

The US Department of Homeland Security operated a program that sought to automate the designation ofsocial media users as “pro-terrorist” based on their use of certain keywordsand interaction with other targeted users, according to documents obtained by the Brennan Center for Justice and published on Tuesday.

Project Night Fury, apartnership between the DHS and the University of Alabamaat Birmingham, sought to assign potentially “pro-terrorist” accounts a “risk score” that would then affect other accounts they interacted with. The university had agreed todevelop automated methodsto determine whether an account linked to one already under surveillance was itself “pro-terrorist,” using criteria like “keyword set comparisons.” Thealgorithm, not a human, would determine whether a user could be labeled “pro-terrorist”forsimply clicking “like” on a Facebook postor retweeting an account that had already received that label.

Despite the known limits of artificial intelligence when this system was being formulated in 2018, the entire process would have been automated, according to the documents. The university was assigned to build models to “identify key influencers of pro-terrorist thought” and create an automated system to uncover bots “programmatically generated to exert influence” to spread both “terrorist propaganda” and “foreign influence campaigns.” They would thencompile a list of suspect accountsand turn them over to the DHS, along with their names, emails, phone numbers, pictures, and posts.

Missing from the contracts were definitionsfor important concepts like what “pro-terrorist”actually meant – or what a “risk score” would measure, whether it was the risk of becominga terrorist or merely sympathizing with one – or an explanation of how an automated process could make such distinctions absent clear-cut definitions.

It's also not clear how the program would have distinguished between terrorism-adjacent content and material related to drug trafficking and “disinformation,” which it also sought to track. As of the date of the contracts seen by the Brennan Center, the DHShadn’t figured out how to quantify terrorist sympathiesand was seeking assistance from university researchers to “identify relevant attributes.”

TheDHS Inspector General was tipped offto potential privacy violations on Project Night Fury in 2018, and until the Brennan Center’s FOIA request was fulfilled, all that was known about the project came from the OIG’s 2019 report, which found theagentsinvolved with the projectdid not comply with department policiesgoverning privacy and protection of sensitive information.

While the DHS supposedly stopped work on Night Fury in 2019,it’s not known how far along the project was, or whether its assets were transferred elsewhere within the law enforcement apparatus. Customs and Border Protection was recently found tobe using a similar AI-powered tool called Babel Xto snoop through the social media accounts of travelers at the US border.
