The conflation of "free speech" and "1st amendment" is disingenuous. The 1st amendment and free speech are not synonyms.
Free speech is a philosphical concept that information and ideas should spread freely, so that they can be judged by each individual and not by a few gatekeepers.
The 1st amendment is a constitutional provision that prevents the government from passing any law that restricts free speech (beyond a bare minimum). Of course, nowadays when most communications go through platforms controlled by only a handful of corporations, politicians have realized they can circumvent the 1st amendment by pressuring corporations to deplatform critics.
(2)
The equation of "rights" and "rights from the government" is incorrect. A right can be universal and not just in relation to a government entity. The right to free speech is not just the right to not be arrested by a government.
(3)
"Free speech is not freedom from consequence" is also disingenuous. That's like saying people have the freedom to steal, even though they'll be punished for it. Or like saying there is freedom of speech in a dictatorship. People can say "down with the dictator", they'll just have to face the consequences for it.
(4)
Name-dropping historical intellectuals is just an appeal to authority and doesn't actually further the argument.
