In a "free land" of Siberia i was checked once when i walked into metro carrying big ass box with soldering station inside of it. They cannot be sold as spray against humans, because of some outdated law against torture/abuse and that is why they are sold as Tierabwehrspray(antianimalspray) against attack dogs.
However the German law about self defense don't care about that, you are justified to use whatever tool you have at hand or is necessary to defend yourself, as long as it is a real attack.
And since the same law also repeatedly expresses the wish of the state that the people please don't beat up the bad guy too much, the use of gas and pepper sprays are even encouraged because they are less harmful than the alternatives many Germans would take to defend themselves.

Also another thing many people don't get is how the law and police work in general and treat getting charged automatically as getting declared guilty. What the police does is show up to a crime or get informed about a crime, then they search for evidence about ANY law violation and then based on those evidences they find they charge all possible guilty people for these law violations. If they are truly guilty or had an excuse to not follow the law is again later decided in court. In this case the women basically confessed herself to have violated the law, so of course she is getting charged. If she was justified to use the pepper spray and that everything really happened how she reported it will be decided in court based on evidence.
