I'm not sure where you could have any alternate interpretation of those facts. I was only using that as an example about what can happen if lower courts or states push the issue on something. In fact that's likely the reason why states that have outlawed loli typically don't charge people just for loli possession. That's the thing though. In the US cops, prosecutors, and criminal court judges like as many laws to be in the grey area as possible. They like having the ability to arrest someone for something but not be compelled to do so. Typically when people are charged those charges are later dropped because there is the danger that if the accused makes legal protest then it could generate a precedent. Either a higher court could declare it to be legal which means that they cant charge anyone anymore or they could uphold the illegality and which could open the doors for harsher laws targeting loli which would place a burden on the legal system to uphold them. The legal system doesn't have enough resources to protect actual children let along enough to try to protect imaginary children.
