Because it’s an amazing port that captures the game down to the last detail. I’m not a Nostalgiafag, but that’s impressive considering that the Computer is older than the NES itself. It took this guy nearly 7 years of development, and Nintendo took everything but the torrent down in only 7 days. Copyright and Trademark are not the same thing.

The law >>16402834 is referring to is about trademarked names being genericized, like how Americans always say "Kleenex" and "Band-aid" for tissues and plasters, and British people call all vaccuum cleaners "Hoovers". Those are all copyrighted names, but the companies that own them can't stop them being used all over the place because they're now universally accepted as the generic names for those things.

Disney is not going to lose the copyright to Mickey Mouse no matter how many innocent kindergartens paint him on their walls, and Nintendo is not going to lose the rights to Mario if people make fan games.

(Interestingly, in the late 80's/early 90's Nintendo WAS worried about losing their own name, because back then it was becoming a trend to refer to all video games as "Playing Nintendo" - they spent a small fortune on an advertising campaign to try and reverse this trend.)

There's more of a case here. The dev himself said that, because the NES' 6502 is just a modified version of the C64's 6502 processor, he could use original code for the physics, while rewriting the graphics and music. If gone to trial, the dude would most likely lose because he's distributing direct code from the original game. It's how a lot of Mario 64 romhacks avoid takedowns, by using IPS patches instead.

Also, why is anyone surprised, again? It's a high-profile 1:1 recreation of one of their games, one that they continue to sell in at least five different methods that I can think of. Of course they'll take it down.

Even amateur hobbyist projects, like Minecraft server hosting tools, get taken down for using each other's code. That's also what happened to that Skyrim multiplayer thing. Using code directly from a big game is a pretty obvious no-no. I don't see why art exemptions would apply, considering I don't think video games are art in any legal sense, and it's not even close to going to the public domain. Besides, even if video games were art, I don't think you can plagiarize two hundred pages of a Game of Thrones book, change the names of the characters to parodies for the remaining four hundred and release it for free.
