Basically, game ratings are like moving ratings and are based on the worst offenders in the given material. (The most extreme language, sex scenes, violence, etc.) It's not some kind of score they give you like a review. Retailers only care about it because if it's M-rated, they can't sell it to kids and other places won't carry anything higher than M anyway. The most these people could do would to be to try to force some additional descriptor (like 'Violence' or 'Drugs and Alcohol') to the effect of 'Poor Minority Representation' or something.

If they took over the ESRB, this would only affect physical console games. The worst they could do is threaten companies to remove/add X in a game or else they'll give it an adult rating. Even if they held back a game by pending the rating, this would only hold back physical releases in NA. You can have a digital game sell with the rating still pending. With consoles slowly dying off, most devs are moving to PC anyway where they have no control on digital products. That problem solves its self.
Now things could change if they made a new rating that would just ban your game all together.

Actual "hate speech" games (specifically Ethnic Cleansing, the godawful Quake mod made by someone in the late 90s) are already on PC; Microsoft and Comcast (aka NBC) can't do anything about it because if they start arbitrary deciding what can and can't use their software/telcom service then Republicans will hit right back by requiring them to ban certain content (especially content about abortion rights, immigrant rights, and labor rights) which is already happening in parts of the south where only licensed doctors are allowed to give out abortion advice since it's classified as medical advice - a move explicitly done to fuck over Planned Parenthood.
And it would be especially dangerous to do it now that Net Neutrality is dead, giving Comcast carte blanche to blacklist anything that doesn't adhere to their specs, basically MS would have to pay rent to Comcast as a third party supplier in the same way non-Westinghouse landline phone suppliers had to pay rent to Bell. Microsoft especially does not want this neither does AMD/Intel/Apple or anyone else except ISPs who'd be able to gate off most of the web including websites that sell any videogames. You can see how this escalates down a slippery slope, one that the ESA does not want.
Time will tell what happens though, because with NN dead all of this is at least plausible now. It's up to consumers to ensure that ISPs play fair, because if consumers fail to do that then ISPs will simply be able to ban anything they don't like. Although in that case people might just go back to print magazines and newsletters.

Not that I don't agree this is how it should be in theory, but I'm sure the ESA doesn't give a shit at this point. Most supposedly self-interested entities are now just controlled by elites performing to each other. To go far afield for an example, look at Gillette's new commercial, do you think they really thought they would sell more razors with it? For example suppose California and New York both passed laws defining any electronic gaming service as sports betting, this alone would completely destroy almost all videogame publishers as now all modern (2008-present) multiplayer games would have to be consumed within designated, licensed betting parlors during certain hours and with maximum bets/fees that don't take credit cards. Meanwhile if content standards are imposed then any game with even a single nip slip, blood, or creatures dying gets put behind a 21+ paywall that can only be purchased from designated, licensed vendors during certain hours. Stupider laws, for example a total ban on digitally distributed games, would themselves destroy the mobile gaming industry while also forcing ISPs to censor sites like miniclip if they did not take down their flash games.
If it was just about virtue signalling, then the ESA and videogame industry wouldn't last long because everyone from the NRA to Fienstien and Cuomo are looking to cast them as the new tobacco and strike them down. Which is exactly why the ESA doesn't get political or impose political standards in their games, because they wouldn't survive it. The only exemption was/is loot boxes, because there are growing calls for government intervention forcing the ESA's hand.
