Turkey’s Erdogan Joins In on Vilification of Soros

(Bloomberg) – An Istanbul court acquitted prominent businessman Osman Kavala of charges of plotting to overthrow the government during mass protests that shook the country in 2013.

Nine defendants were cleared, and arrest warrants for others living abroad have been rescinded. Others accused in the case include actor Mehmet Ali Alabora and journalist Can Dundar, who have both left the country.

Kavala spent two years in jail while his case was tried. He was the only defendant to be incarcerated.

President Recep Tayyip Erdogan has alleged that Kavala was the “local collaborator” of a foreign conspiracy led by billionaire George Soros to divide Turkey by backing the demonstrations against a planned development in Istanbul’s Gezi Park.

The protests quickly morphed into the biggest challenge to the rule of Erdogan, then a powerful prime minister.

Jailed Wikileaks founder Assange's health improving: spokesman

LONDON (Reuters) - Jailed WikiLeaks founder Julian Assange is no longer being kept in solitary confinement and his health is improving, his spokesman Kristinn Hrafnsson told reporters on Tuesday.

Assange, 48, is in Belmarsh high-security prison in London, fighting an extradition request from the United States where he faces 18 counts including conspiring to hack government computers and violating an espionage law. He could spend decades in prison if convicted.

His supporters had expressed concern about the state of his health after he appeared confused during a court hearing in October, struggling to recall his age and name and saying he was unable to think properly.

Assange was moved from solitary confinement in the medical wing to a different part of the prison with 40 other inmates after his legal team and prisoners complained that his treatment was unfair, Hrafnsson said.

"I saw him about 10 days ago - he has improved thanks to the pressure from his legal team, the general public, and amazingly, actually from other inmates in Belmarsh Prison to get him out of isolation," Hrafnsson said ahead of an extradition hearing that starts next week.

Australian-born Assange made global headlines in early 2010 when WikiLeaks published a classified U.S. military video showing a 2007 attack by Apache helicopters in Baghdad that killed a dozen people, including two Reuters news staff.

WikiLeaks later angered the United States by publishing caches of leaked military documents and diplomatic cables.

Assange has consistently presented himself as a champion of free speech being persecuted for exposing abuses of power. But his critics paint him as a dangerous figure complicit in Russian efforts to undermine the West.

He fled to the Ecuadorean embassy in London in 2012 to avoid extradition to Sweden, where he was wanted for questioning about allegations of sex crimes which have since been dropped. He spent seven years holed up in the embassy until Ecuador decided to stop giving him refuge and he was dragged out last May.

Earlier, a group of doctors representing 117 physicians and psychologists from 18 nations called in a letter for an end to what they described as "the psychological torture and medical neglect of Julian Assange".

His father, John Shipton, said Assange's long confinement indoors had damaged his health and feared that sending his son to the US would be akin to a "death sentence".

"His situation is dire, he has had nine years of ceaseless psychological torture where false accusations are constantly being made," he told reporters.

Julian Assange: Australian MPs call on UK to block US extradition

Boris Johnson should block attempts to extradite Julian Assange to the US, say two Australian MPs who have flown to the UK to visit the WikiLeaks founder.

Andrew Wilkie, an independent federal MP, said the extradition of Assange, who has been charged by the US with conspiring to hack into a secret Pentagon computer network, would set a dangerous precedent.

Wilkie said: “This was information that as clearly published in the public interest and it beggars belief that the country accused of war crimes is the one that wants to get their hands on Julian Assange.” The MP criticised his own government and that of the UK for “going along” with the US.

NSA whistleblower who leaked Russian hacking report petitions for clemency

Supporters of Reality Winner, a National Security Agency whistleblower who leaked classified information about Russia’s interference in the 2016 presidential election, petitioned Donald Trump on Monday for her early release from prison.

Alison Grinter, an attorney representing the former US air force intelligence specialist, announced at a press conference in Dallas that she had submitted 4,500 letters of support to the federal office of the pardon attorney, the division of the Department of Justice that advises the US president on executive clemency decisions.

Winner was sentenced to five years and three months in August 2018 after admitting breaching the espionage act by passing top secret documents to an investigative news website about the Russian hacking of voting software and its efforts to disrupt dozens of local election systems ahead of the 2016 election.

“Our country was attacked by a hostile foreign power,” The Intercept quoted Grinter as saying at the press conference.

“Our national healing process cannot begin until we forgive our truth tellers and begin the job of rebuilding what was taken from us: election security, accountability for those who endeavor to undermine our democracy; and safeguarding the American right to government by and for the people. None of this can begin in earnest while we are still punishing those who tell us the truth.”

The petition states of Winner, 28: “Her continued incarceration is costly, unnecessary to protect the public, burdensome to her health and wellbeing, and not commensurate with the severity of her offense.”

Trump called Winner’s sentence “unfair” in an August 2018 tweet attacking then-attorney general Jeff Sessions, describing her actions as “small potatoes” compared to what he alleged his 2016 opponent Hillary Clinton had done with classified information while she was secretary of state during the administration of Barack Obama.

A three-year state department investigation cleared Clinton of any wrongdoing in October 2019.

Winner said of Trump in a phone interview with CBS News from Georgia’s Lincoln county jail in 2018 that she “can’t thank him enough” for the tweet, which she said confirmed her lawyers’ view that the sentence was unfair.

The Department of Justice did not immediately return a request for comment from the Guardian on Monday.

The government is going to set up seven special tribunals for speedy trials in human trafficking cases as Bangladesh faces risks of US sanctions for not doing enough in combatting the heinous crime.

“Seven special tribunals will be established in divisional cities. They will start functioning from March this year,” Law Minister Anisul Huq told The Daily Star on Wednesday.

The tribunals will surely help speed up the trial process of the human trafficking cases, he said.

Over 4,700 human trafficking cases are now pending, Anisul Huq said, expecting that the tribunals, once set up, will try the human traffickers to check such incidents.

The development comes after Bangladesh was ranked in Tier 2 Watch List for the last three consecutive years in the US Trafficking in Persons (TIP) Report.

As per the US law, Bangladesh is not eligible to remain in Tier 2 Watch List this year, said the US Embassy in Dhaka in an email response to The Daily Star on January 20.

“Either Bangladesh must show significant and increased efforts to meet the minimum standards to eliminate trafficking in persons and achieve a Tier 2 ranking or risk an automatic downgrade to Tier 3,” it mentioned.

Any country ranked in Tier 3 is subject to severe restrictions and even full curtailment of non-humanitarian, non-trade-related assistance as set forth in Section 110(d)(1) of the US Trafficking Victims Protection Act (TVPA), it said.

Additionally, the US president may also withhold funding for Bangladesh government officials or employees for participation in educational and cultural exchanges.

The president can also instruct the US executive director of each multilateral development bank and the International Monetary Fund to vote against, and use his or her best efforts to deny, any loans or other uses of the institutions’ funds to Bangladesh. Only the president himself can waive these restrictions.

However, US foreign assistance to support the people of Bangladesh through NGOs and other civil society organisations is not restricted under the TVPA, the embassy noted.

WHAT’S TIP?

US law defines TIP as recruiting, harbouring, transporting, providing or obtaining a person for labour or services, through the use of force, fraud, or coercion for the purpose of subjection to involuntary servitude, peonage, debt bondage or slavery.

It also includes a situation where a commercial sex act is induced by force, fraud, or coercion, or in which the person induced to perform such an act has not attained 18 years of age.

“A victim need not be physically transported from one location to another for the crime to fall within this definition,” according to the US State Department annual TIP report, published in June 2019.

It ranks countries in four categories. Tier 1 rank means the countries fully compliant with the minimum standards in protecting trafficking victims; Tier 2 means the countries not fully compliant but making significant efforts.

Tier 2 Watch List means the countries not fully complying with the minimum standards in protecting trafficking victims; the absolute number of victims of severe forms of trafficking is very significant and there is a failure to provide evidence of increasing efforts to combat severe forms of trafficking.

Tier 3 means the countries not making significant efforts to combat trafficking.

POSITION OF BANGLADESH

Bangladesh has been ranked in Tier 2 Watch List for the last three years, with the TIP report of 2019 saying the country does not fully meet the minimum standards for the elimination of trafficking.

However, it says the country is making significant efforts to do so. The efforts included adopting a national action plan to combat trafficking, convicting traffickers, initiating an investigation into a police officer accused of child sex trafficking, and continuing to investigate some potential trafficking crimes against the Rohingya refugees.

However, it said, the government did not demonstrate overall increasing efforts compared to the previous reporting period. The government identified significantly fewer trafficking victims and did not consistently refer victims to care, and reports of it doing so were far fewer than the number of victims identified.

It also says victim care remained insufficient; Rohingya and foreign trafficking victims could not access protective services, and the government did not have shelter for adult male victims.

According to the TIP report, official complicity in trafficking crimes remained a serious problem, and the government did not report taking any action against some high-profile allegations.

Also, it says, the government continued to allow employers to charge high recruitment fees to migrant workers and did not consistently address illegally operating recruitment sub-agents, which left workers vulnerable to trafficking.

Quoting observers, the report said some police took bribes and sexual favours to ignore potential trafficking crimes at brothels, and some labour attaches, local politicians, judges, and police requested bribes from victims and their families to pursue cases.

Some officials from district employment and manpower offices allegedly facilitated human trafficking, and some traffickers in rural areas had political connections that enabled them to operate with impunity, it said.

Campaigners say though the government enacted the Prevention and Suppression of Human Trafficking Act in 2012, it has not yet established the special tribunals as suggested by the act.

As per the law, the investigation of alleged traffickers will complete in 90 days and the trial in 180 days, but that is hardly complied, they say.

According to an analysis by Brac Migration Programme, 4,529 cases were filed under the law between 2012 and February 2019, but only 103 were settled — demonstrating the extremely low rate of conviction.

Human rights lawyer Salma Ali said it is good news that the government is going to establish special tribunals. “However, so far, the main problem that we have observed is the poor investigation,” she said.

“The masterminds of the trafficking gangs remain untouched. Basically, some aides of the trafficking gangs came under investigation.”

Law Minister Anisul Huq said, “We hope we can come out of the situation as we are setting up special tribunals for this.”

The US Embassy in Dhaka said Bangladesh has to significantly increase prosecutions and convictions for trafficking offences, particularly of labour traffickers and complicit government officials, while strictly respecting due process if it wants to improve its ranking.

Bangladesh also has to take steps to eliminate recruitment fees charged to workers by licensed labour recruiters and ensure recruitment fees are paid by employers and improve identification of trafficking victims — male and female within Bangladesh or repatriated from abroad — and referral to care, it said.

The headline sounded ominous: “Former Justice Dept. Lawyers Press for Barr to Step Down,” blared an article in Sunday’s New York Times. More than 1,100 former federal prosecutors signed a letter to condemn Attorney General William Barr and encourage Justice Department employees to tattle on the nation’s top lawman if they see anything naughty.

The lawyers were outraged at Barr’s decision to override “line prosecutors,” including two holdovers from the Robert Mueller investigation, who had recommended an excessive sentence against Roger Stone. “Barr’s actions in doing the President’s personal bidding unfortunately speak louder than his words,” they wrote. “Those actions, and the damage they have done to the Department of Justice’s reputation for integrity and the rule of law, require Mr. Barr to resign.”

Times reporter Katie Benner, trying to make the stunt look like a legitimate grassroots effort, attributed the letter to Protect Democracy, which she described as a “nonprofit legal group.” But Protect Democracy is not an organic activist group spontaneously created by high-minded legal experts alarmed by Trump’s alleged flouting of the rule of law. Protect Democracy was launched in early 2017 as part of an extensive anti-Trump operation managed by a leftwing tech billionaire: Pierre Omidyar, the founder of eBay. This is who is behind Protect Democracy and a number of other nonprofits formed to destroy the president.

In 2018, according to the group’s most recent tax filing, Protect Democracy collected nearly $7 million in donations; Omidyar’s most politically-active nonprofit, Democracy Fund, has donated $2 million since 2017. Democracy Fund is spending tens of millions each year to underwrite dozens of anti-Trump projects. “Over the past two years, I have seen alarming and sometimes unprecedented violations of our country’s democratic norms,” Joe Goldman, the fund’s president, wrote in 2018.
