Obama-Appointed Judge U.S. District Court Judge John Tuchi, Awards $122,200 in Sanctions Against Kari Lake’s Attorneys for Lawsuit over Voting Machine Tabulators
U.S. District Court Judge John Tuchi, who was appointed to the bench by President Barack Obama, awarded sanctions in December against Kari Lake’s and Mark Finchem’s attorneys over their lawsuit against electronic voting machine tabulators in December. In his July 14 order, he emphasized that the sanctions are to be used “only in the most egregious situations” and as a “deterrent” to others who might be considering similar lawsuits.
Lake addressed the sanctions during an interview Wednesday on The Colonel of Truth.
“I sued to get rid of the machines in Arizona about a year before the election,” she said. “No, actually, I’m sorry. About six months. An Obama judge threw the case out, tried to sanction our attorneys,” she said, referencing the case with Tuchi (pictured above).
“They’re sanctioning our attorneys,” Lake said. “I tried to prevent the disaster of voting machines with this lawsuit BEFORE the election. We get to the election, the machines break down & they’re saying ‘you shouldn’t have bought it.’”
The Maricopa County Supervisors, represented by Maricopa County Attorney Rachel Mitchell, asked for $139,950 in attorneys fees. Tuchi found that the estimate wasn’t completely valid and lowered it to $122,200. In similar election-related cases, judges have declined to award sanctions against those bringing the lawsuits.
Bob Brickman, a local business and elections lawyer, expressed what he described as “grave concern” over this latest development by Mitchell and the federal judiciary. “If this decision stands, we now have the judiciary abandoning judicial restraint and aggressively taking over the legislature’s oversight and law-making role on the acceptable conduct of attorneys … we’re beyond the ‘TIPPING point;’ we’ve actually crossed over into the judiciary legislating standards, and eliminating an entire class of subject matter lawsuits!” he told The Arizona Sun Times.
Brickman warned that equal access to justice will be “a thing of the past” based on a judge’s subjectivity, instead of objective standards already in place; “for example, Rule 11 of the Federal Rules of Civil Procedure, and clear and objective standards that have a statutory basis.”
“What elections attorney would even consider taking a case knowing the judiciary has essentially legislated away that class of lawsuit from being filed — even if done in good faith, as they’ll automatically risk monetary sanctions if they don’t prevail!” he asked.
Brickman concluded by stating that in the event this decision stands, and the legislature does not quickly remedy it, “the Supreme Court and State Bar likely will impose mandatory CLE classes covering New Standards of Conduct for attorneys to avoid monetary and disciplinary sanctions —by not bringing election and other select conservative-based lawsuits.”

In his ruling, Tuchi admitted that “the Court declined to make a finding as to whether the case was brought for an improper purpose.”
He cited Federal Rule of Civil Procedure 11(c)(4), which states in part, “The sanction imposed . . . must be limited to what suffices to deter repetition of the conduct or comparable conduct by others similarly situated…”
The judge alluded to case law, “The purpose of imposing sanctions under Rule 11 is not ‘compensating the prevailing party,’ but ‘deterring, and if necessary punishing improper conduct.’”
At the same time, Tuchi acknowledged, “the imposition of sanctions is an extraordinary remedy to be exercised with caution and restraint,” citing the Ninth Circuit stating they should be used “only in the most egregious situations.”
Tuchi divided up the sanctions among Lake’s three attorneys.
Retired Harvard Law School professor Alan Dershowitz asserted that he only participated in the case as “of counsel,” meaning he was not one of the primary attorneys. He said he wrote only one paragraph of the complaint. However, Tuchi referenced sanctions issued against another election attorney, Lin Wood, who was also merely of counsel in an election challenge lawsuit.
He said, “The Sixth Circuit rejected Mr. Wood’s argument that the district court was ‘required to undertake an individual analysis of his conduct before it could sanction him.’”
Tuchi disagreed with Dershowitz’s contention that his role was minimal.
“In any event, Mr. Dershowitz’s subjective intent is not controlling at this stage,” he said. “The need for general deterrence [when it comes to his role is] significant,” the judge said. He reasoned, “Failing to impose meaningful sanctions here might very well encourage others to follow suit by lending their credibility to documents filed in court without facing any real consequence if their certifications prove hollow or incomplete.”
Since Dershowitz’s role was substantially smaller than the other attorneys, Tuchi reduced his share of the sanctions to 10 percent, $12,220. Attorneys Kurt Olsen and Andrew Parker were assigned the remainder of the $122,200.
In their lawsuit, Lake and Finchem denounced the “nullification of Plaintiffs’ fundamental rights as candidates and as voters to vote and have their votes properly counted without being diluted or debased by other fictitious or manipulated votes.” They cited a 2001 case, Bonas v. Town of N. Smithfield, which held, “[O]ne thing is clear: total and complete disenfranchisement of the electorate as a whole is patently and fundamentally unfair (and, hence, amenable to rectification in a federal court).”
Maricopa County Republican Committee censured Mitchell in June for representing county officials twice and asking for sanctions against Lake. Maricopa County Superior Court Judge Peter Thompson rejected the county’s motion for sanctions against Lake in her election contest lawsuit, stating it wasn’t “groundless.” The Arizona Supreme Court issued nominal $2,000 sanctions against Lake’s attorneys in May over her election challenge lawsuit.
Progressive-funded attorneys have filed multiple lawsuits in Arizona related to the 2020 and 2022 elections, but none have been sanctioned or disciplined by the State Bar of Arizona. The 65 Project files bar complaints against election attorneys representing Republicans in election-related lawsuits and has filed them against Dershowitz, Olsen, and Parker.
Last fall, Tuchi struck down a new Arizona law championed by Republicans that made it a crime to record law enforcement activity within eight feet after receiving a warning from an officer. Attorney General Kris Mayes agreed to pay Arizona news outlets, including The Arizona Republic, $46,000 and the ACLU $23,000 for attorney fees and costs.
Dershowitz said he intends to appeal. Tuchi ordered payment due in 30 days, but if appealed it will go on hold.

US creates permanent pandemic agency
The office will take over the duties of the White House Covid-19 response team
The US government has launched a new agency to prepare for pandemics and other “biological threats,” with President Joe Biden tapping a retired Air Force general to spearhead the project.
The White House announced the creation of the Office of Pandemic Preparedness and Response Policy (OPPR) on Friday. The agency will be tasked with devising a response to public health crises, coordinating scientific research and medical efforts against pandemics, and providing regular reports to Congress.
“This will be a permanent office in the Executive Office of the President charged with leading, coordinating, and implementing actions related to preparedness for, and response to, known and unknown biological threats or pathogens,” the White House said in a press release.
The new office will beheaded up by Retired Air Force Major General Paul Friedrichs, who currently serves as a special assistant to President Joe Biden and the Senior Director for Global Health Security and Biodefense at the White House National Security Council. Friedrichs previously worked as a joint staff surgeon at the Pentagon, where he also advised the military’s Covid-19 task force.
The OPPR will formally come into existence on August 7, after which Friedrichs will begin assembling a team. His responsibilities will include ensuring the Strategic National Stockpile is well-equipped with medical supplies, and working with Congress to procure funding for US preparedness efforts, according to the New York Times.
In addition to crafting a government response to future pandemics, the agency will confer with industry, the scientific community and the Department of Health and Human Services to develop the “next generation of medical countermeasures,” including vaccines. Its work will focus on Covid-19, monkeypox, polio, avian and human influenza, and RSV, among other pathogens.
Taking over the role of the White House’s Covid-19 response team, which was shuttered in May, the office was created under a sweeping government spending package enacted in late 2022. It will be required to submit a “preparedness review” to lawmakers every two years, and a separate “outlook report” every five years.

Governor Sergey Aksyonov has ordered a mass evacuation from the danger zone
A Ukrainian drone strike has resulted in an explosion at an ammunition depot in the central part of the Crimean peninsula, Governor Sergey Aksyonov said on Saturday. According to preliminary information, the incident has not resulted in any casualties, he added.
Writing on Telegram, Aksyonov said the detonation had taken place in the Krasnogvardeysky district. “A decision has been made to evacuate the population within a 5km radius from the site of the emergency and place them in temporary accommodation facilities,” he added.
The governor stated that the authorities had also suspended rail traffic in the area in order to “minimize risks,” while expressing hope that the emergency would be dealt with quickly.
The Ukrainian Armed Forces have confirmed the strikes,claiming that they “had destroyed an oil depot and Russian military warehouses”in the area.
Crimea has repeatedly been targeted by Ukrainian drone and missile attacks since Moscow launched its military operation against Kiev over a year ago. On Thursday, Aksyonov said a Ukrainian UAV raid on the peninsula had killed a teenage girl and damaged several administrative buildings.
Earlier this week, a sea drone strike on the Crimean Bridge – which Russia called a Ukrainian terrorist attack – damaged one section of the roadway and claimed the lives of a married couple from Belgorod Region, as well as injuring their 14-year-old daughter.
Kiev stopped short of claiming responsibility, but celebrated the incident, while Ukrainian President Vladimir Zelensky later called the bridge a legitimate military target.
Meanwhile, Russian President Vladimir Putin has condemned the raid as a “terrorist attack”that was pointless from a military standpoint, adding that the bridge has not been used for transporting military materials for a long time. In the aftermath of the incident, Moscow launched several “retaliatory strikes” on targets in Ukrainian port cities.

Ukraine has targeted a village in Russia’s Belgorod Region with cluster munitions, governor Vyacheslav Gladkov has said.
At least three cluster munitions were employed by the Kiev forces during a large-scale attack on the settlement of Zhuravlevka, Gladkov wrote on Telegram on Saturday.
According to the governor,21 artillery shells and ten mortar rounds were also fired at the village. It was also targeted with a single kamikaze drone.
There were no casualties or damage in Zhuravlevka as a result of the shelling, he said.
Smaller artillery,mortar and drone attacks targeted at least a dozen other settlementsin Belgorod Region on the same day, Gladkov wrote.
In the village of Ilek-Penkovka, 12 households were affected by an explosion, with the facades of buildings being damaged and windows shattered, he said, adding that injuries had been avoided.
The US announced the delivery of cluster munitions to Ukraine earlier this month, with President Joe Biden describing it as a stopgap measure that was necessary due to a shortage of regular artillery rounds among Kiev’s Western backers.
The controversial shells, which contain multiple bomblets that are dispersed over a large area, have been banned in more than 100 countries. However, neither Ukraine, the US, nor Russia are signatories of the 2008 Convention on Cluster Munitions (CCM).
Washington admitted that it was aware of the increased risk posed by cluster munitions for the civilian population, but claimed that Kiev had pledged to deploy them responsibly and steer clear of densely populated areas.
On Thursday, White House National Security Council spokesman John Kirby confirmed that the Ukrainian forces had begun using US-supplied cluster munitions on the battlefield. They were doing so “quite effectively,” he claimed.
Russian President Vladimir Putin noted last week that the US itself had earlier branded the use of cluster munitions “a crime,” saying this was exactly how he regarded the delivery of such weapons to Kiev by Washington.
The Russian military has a “sufficient” stock of cluster munitions, which itcan also put to use in a tit-for-tat responseto such weapons being deployed by Ukraine, the president warned.

An affluent liberal D.C. suburb has a simple explanation for why it won't honor parents' requests to exclude their children, some as young as 3 years old, from "storybooks" with sex workers, kink, drag, gender transitions and same-sex romance for elementary-age children: It's hard.
Maryland's Montgomery County Public Schools claims it was flooded with opt-out requests when the books were introduced in the curriculum in January, giving it legal justification, on logistical grounds, to issue a blanket policy of no exceptions and no notifications.
The district didn't provide a specific number or even vague range, however, in its memorandum opposing the motion for preliminary injunction by Catholic, Muslim and Ukrainian-Orthodox parents who filed the First and Fourteenth Amendment lawsuit in May.
The July 6 amended complaint adds plaintiff Kids First, a new unincorporated association of Montgomery County parents with children in MCPS or who would be "but for" the new policy. It includes "Muslims, Catholics, Protestants, Latter-day Saints, and Jews, and is open to individuals of all faiths."
The district imposed the no-exception and no-notification policy March 23, a day after it told the media it would honor requests and issue notifications, which united parents across the religious spectrum in opposition.
The Council on American-Islamic Relations, a reliably liberal advocacy group on most issues, has been especially vocal and visible in challenging the policy.
"Public schools have an obligation to be inclusive and neutral," Maryland Director Zainab Chaudry said at a multifaith rally Thursday. "They can't be favoring one group over another."
MCPS is the only known district nationwide to go this far, setting "a dangerous precedent for more bullying, more harassment, more intimidation for children within schools," according to Chaudry. "We can't teach children allyship and tolerance and inclusion by forcing them to assimilate" and give up "their own diverse identities."
MCPS "cannot plausibly claim that an opt-out policy that is both required by state law and was willingly followed until March 2023 could somehow harm the public interest if followed for the duration of this case," the parents' June 12 memorandum in support of a preliminary injunction states.
Maryland law requires districts to honor "family life and human sexuality" curriculum opt-outs "for any reason," and MCPS policy directs schools to "accommodate requests" from students and parents for classroom content "they believe would impose a substantial burden on their religious beliefs," the memo also states.
In addition, the storybooks go beyond "basic civility and kindness toward all," explicitly encouraging children to "question sexuality and gender identity, focus on romantic feelings, and embrace gender transitioning," the memo reads.
Pre-kindergarten students, for example, are required to read Pride Puppy, which "promotes pride parades as family-friendly events without cautioning about the frequent nudity and sexually explicit conduct that many parents find objectionable –especially for children."
MCPS policy never guaranteed parents exemptions from the storybooks, just "reasonable and feasible adjustments" specifically for religious beliefs, while expressly warning they may be refused if requests become "too frequent or too burdensome," the district's July 12 memo against the injunction states.
"Through conversations with principals, MCPS became aware that individual schools could not accommodate the growing number of opt-out requests without causing significant disruptions to the classroom environment and undermining MCPS’s educational mission," according to the memo.

Grassley Obtains & Releases FBI Record Alleging VP Biden Foreign Bribery Scheme
Grassley, Comer to continue joint inquiry into FBI handling of significant, politically charged investigations
WASHINGTON – Sen. Chuck Grassley (R-Iowa) today released an unclassified FBI-generated record describing an alleged criminal scheme involving then-Vice President Joe Biden and a Ukrainian business executive. Grassley acquired the record, an FD-1023, via legally protected disclosures by Justice Department whistleblowers.
“For the better part of a year, I’ve been pushing the Justice Department and FBI to provide details on its handling of very significant allegations from a trusted FBI informant implicating then-Vice President Biden in a criminal bribery scheme. While the FBI sought to obfuscate and redact, the American people can now read this document for themselves, without the filter of politicians or bureaucrats, thanks to brave and heroic whistleblowers. What did the Justice Department and FBI do with the detailed information in the document? And why have they tried to conceal it from Congress and the American people for so long? The Justice Department and FBI have failed to come clean, but Chairman Comer and I intend to find out,” Grassley said.
“The FBI’s Biden Bribery Record tracks closely with the evidence uncovered by the Oversight Committee’s Biden family influence peddling investigation. In the FBI’s record, the Burisma executive claims that he didn’t pay the ‘big guy’ directly but that he used several bank accounts to conceal the money. That sounds an awful lot like how the Bidens conduct business: using multiple bank accounts to hide the source and total amount of the money,” House Committee on Oversight and Accountability Chairman James Comer said. “At our hearing with IRS whistleblowers, they testified that they had never seen or heard of this record during the Biden criminal investigation, despite having potentially corroborating evidence. Given the misconduct and politicization at the Department of Justice, the American people must be able to read this record for themselves. I thank Senator Grassley for providing much needed transparency to the American people. We must hold the Department of Justice accountable for seeking to bury this record to protect the Bidens.”
Grassley first disclosed the FBI’s possession of significant and voluminous evidence of potential criminality involving the Biden family last year. He has since worked to unearth the FBI record, eventually partnering with Comer on a subpoena to compel its public disclosure. After delays, the FBI provided a highly redacted version of the document to select members of the House of Representatives, but it remained shielded from the public and omitted key details, including references to recordings. Following the FBI’s failure to fully comply with the congressional subpoena, Grassley received the legally protected disclosure with limited redactions to protect a trusted FBI source, handling agents, department whistleblowers and identifiers related to other ongoing investigations.
‘Poluchili’
According to the FBI’s confidential human source, executives for Burisma, a Ukrainian gas company, brought Hunter Biden on the board to “protect us through his dad, from all kinds of problems.” At the time, Burisma was seeking to do business in the United States, but was facing a corruption investigation in Ukraine, led by then-Ukraine Prosecutor General Viktor Shokin. Regarding that investigation’s impact on its ambitions in North America, Burisma CEO Mykola Zlochevsky reportedly said, “Don't worry Hunter will take care of all of those issues through his dad.” Zlochevsky reportedly stated that he had to pay $5 million to Hunter Biden and $5 million to Joe Biden, an arrangement he described as ‘poluchili,’ which is Russian crime slang for being “forced or coerced to pay,” according to the document.

Zlochevsky claimed to have many text messages and recordings that show that he was coerced into paying the Bidens to ensure Shokin was fired. Specifically, he claimed to have two recordings with Joe Biden and 15 recordings with Hunter Biden. Zlochevsky also retained two documents, presumably financial records, as evidence of the arrangement, but said he didn’t send any funds directly to the “Big Guy,” a term understood to be a reference to Joe Biden. References to the “Big Guy” surfaced in communications involving other Biden family business arrangements independent of the Burisma arrangement. Zlochevsky claimed it would take investigators 10 years to uncover the illicit payments to the Bidens, according to the document.

North Korea fires multiple cruise missiles – Seoul
The latest weapons test comes shortly after Pyongyang threatened Washington with nuclear retaliation
North Korea launched several cruise missiles early on Saturday, according to Seoul's Joint Chiefs of Staff, marking yet another show of force in response to the docking of a US ballistic missile submarine in South Korea for the first time in decades.
The launches were detected at around 4am local time, the Yonhap News Agency reported on Saturday morning.
On Thursday, North Korea threatened a nuclear response if the US deployed aircraft carriers, bombers, and missile submarines in South Korea, according to a statement shared by state media channel KCNA.
North Korean Defense Minister Kang Sun-nam accused Washington and Seoul of going “beyond the ‘red line’ in their military hysteria,”and argued that the deployment of nuclear submarines and other strategic assets would fall under the conditions for the use of nuclear weapons specified in North Korean military doctrine.
Pyongyang claims that despite repeated warnings, Washington and Seoul held a meeting of the new “nuclear consultative group” on July 18 to allegedly discuss the use of nuclear weapons against North Korea. On Wednesday, the DPRK fired two ballistic missiles into the Sea of Japan, in an apparent show of force against the perceived provocation by the United States and South Korea.
The latest spike in tensions comes after theUSS Kentucky docked in Busan, marking thefirst port callon the peninsula by a US nuclear ballistic missile submarinesince the 1980s. The Ohio-class submarine can carry up to 20 Trident II D5 intercontinental missiles.
US National Security Council spokesperson John Kirby insisted on Friday that Washington is ready for negotiations “without preconditions to denuclearize the peninsula,” while arguing that the deployment of a nuclear-capable submarine was necessary to protect not just allies, but also 38,000 US troops and their families in South Korea.
