Republican Senate chairman Ron Johnson and Chuck Grassley have requested a full declassification of briefing notes that were compiled for then-FBI director James Comey summarizing the FBI's Crossfire Hurricane investigation efforts.
The request was sent late last week by the chairman of the Senate Homeland Security committee and the Senate Finance Committee chairman to Attorney General William Barr.
The specific notes that Johnson of Wisconsin, and Grassley of Iowa are requesting identify Miles Taylor – a former Trump administration official, who anonymously wrote a 2018 New York Times op-ed criticizing the president and his administration – as a possible witness into the investigation into former Trump National Security Adviser Michael Flynn.

California truckers fed up with the federal government’s endless emergency powers mandating masks and vaccines are gearing up for what they hope will become a Canadian-style “freedom convoy” to Washington, D.C. and are set to roll on Interstate 40 heading east from Barstow on Feb. 23.
A national group, called The People’s Convoy, is organizing the truckers who will hit the road for the nation’s capital city to demand the Emergency Powers Act be lifted, ending the mandates, according to Chris Marston, chairman of the American Foundation for Civil Liberties, a non-profit that advocates for civil liberties issues and is helping coordinate the trucker’s protest.
Though previous news reports stated the convoy wouldn’t depart California until March 7, organizers now say the convoy will leave earlier than planned.
“Freedoms can’t wait,” Marston told The Epoch Times.

The collection, titled “Head of State,” includes a digital portrait of the former first lady wearing a designer hat during her first official state visit in 2018.
The winner of the auction is tied to a digital wallet that is listed as the creator of the NFT, according to Bloomberg.
The web site that hosted the auction says that the digital wallet that created the NFT transferred 372,657 USDC, a stablecoin that is pegged to the dollar, to another wallet on Jan. 23.
The second wallet then sent 1,800 SOL, the cryptocurrency that runs on the Solana blockchain, to a third address, which is listed as the winner.

Story
A former clinical trial overseer for a contractor holding trials of Pfizer’s COVID-19 vaccine is pressing forward with a lawsuit against Pfizer and her former company despite the U.S. government declining to side with her.
Brook Jackson was fired by the contractor, Ventavia Research Group, in 2020. She came forward as a whistleblower in 2021.
Jackson filed a False Claims Act suit against Pfizer, Ventavia, and another company involved in the trial, ICON. It has been under seal for over a year, but is now public after the U.S. Department of Justice declined to intervene on behalf of Jackson.
Government lawyers did not explain the choice not to intervene and the Food and Drug Administration (FDA), which investigates alleged clinical trial fraud, did not respond to a request for comment.
The choice, though, has not deterred the whistleblower.
“We’re going to pursue the case without the help of the government,” Jackson told The Epoch Times.
She said she wasn’t surprised but felt “total disappointment” when, after over a year of putting off a decision, the government declined to intervene.
The odds of success aren’t good but “it’s just a chance I have to take,” Jackson said. “I just feel like somebody has to be held accountable.”
Jackson set off a firestorm when the British Medical Journal in November 2021 published a piece, based on documents, recordings, and other materials from Jackson, that outlined repeated failures by Ventavia to properly run sites for Pfizer’s COVID-19 vaccine trial before it received emergency clearance from U.S. drug regulators.
While the article did not include any of the materials, many were filed with the court and obtained by The Epoch Times, including emails that detail problems observed not just by Jackson, but other Ventavia workers.
For instance, Lovica Downs wrote on Sept. 18, 2020, to Jackson and another employee that she observed boxes containing patient information left on the counter “full[y] exposed to anyone that entered the room could see.”
Other missives described other problems. Marnie Fisher, Ventavia’s director of operations at the time, said on Sept. 21, 2020, that an investigation found multiple sites had left documents exposed, including a schedule with patient names on it; adverse events either “not being reported correctly or at all”; the vaccine and placebo “not being kept locked” in “disorganized” rooms; and informed consent errors.
The documents show that Ventavia employees were aware of serious problems arising during the trial, including vaccine administrators who who were either described as having “no training” and “very little oversight” or lacking medical certifications or background. A Pfizer official was copied on, and answered some, of the emails.

Downs declined to comment while Fisher couldn’t be reached. ICON and Pfizer didn’t respond to requests for comment. Ventavia spokeswoman Lauren Foreman told The Epoch Times via email last year that Jackson worked for Ventavia but “no part of her job responsibilities concerned the clinical trials at issue.”
In an updated statement on Feb. 11, Foreman added, “Although Jackson was hired to oversee certain sites and aspects of clinical trials, she was only employed with Ventavia for 18 days, and, as a result, did not have the longevity with the company to complete the training for the role for which she was hired.”
Jackson, through her lawyer, recently threatened to file a defamation lawsuit against Ventavia over its description of her employment.
The FDA told The Epoch Times in an email last year, “Although the agency cannot comment further at this time in this ongoing matter, FDA has full confidence in the data that were used to support the Pfizer-BioNTech COVID-19 Vaccine authorization and the Comirnaty approval.” Spokespersons didn’t reply when asked on Monday for an update.
Jackson was fired hours after filing a complaint with the FDA. A Pfizer official reached out directly to Jackson several weeks after she filed the complaint asking for more information, according to text messages reviewed by The Epoch Times.
The suit was brought under the False Claims Act, which enables Americans to file suits on behalf of the government “against those who have defrauded the government,” according to the government. More than $5.6 billion has been obtained through suits under the act, as of the fall of 2021.
The suit says Pfizer, ICON, and Ventavia “deliberately withheld crucial information from the United States that calls the safety and efficacy of their vaccine into question.”
“Namely, Defendants concealed violations of both their clinical trial protocol and federal regulations, including falsification of clinical trial documents,” it also says. “Due to Defendants’ scheme, millions of Americans have received a misbranded vaccination which is potentially not as effective as represented.”
Jackson is asking the court to award her damages and back pay and reinstate her to her position with Ventavia.

The same day that videos emerged of Ottawa and Quebec police gearing up to go after peaceful Convoy supporters in the capital, the Ottawa government has warned protesters that their pets may be confiscated following their arrest.
Moreover, position statements issued by the Ottawa Humane Society reveal that they may unilaterally euthanize any animal that they deem to be “not suitable for adoption.” Arbitrary behavioral and health tests would be used to make the call.
These decisions about the life of a trucker’s pet would, thus, be made without their consent or knowledge while they are imprisoned for indefinite periods of time via the Emergency Powers of the Trudeau regime.
"Attention animal owners at [the] demonstration," Ottawa By-law writes in a Tweet. "If you are unable to care for your animal as a result of enforcement actions, your animal will [be] placed into protective care for 8 days, at your cost. After 8 days, if arrangements are not made, your animal will be considered relinquished."
As anyone with experience in pet care or animal shelters will know, "relinquishment" means that ownership of pets will be handed over to animal shelters, where the pets will be housed while awaiting a prospective owner to adopt them or to be euthanized.
As Adopt-a-Pet explains, "When shelters run out of kennel space, sometimes even healthy adoptable dogs are put to sleep. Some shelters simply don't have the manpower to spend time with each dog, so they spend most of their time alone in a small cage… What is true at every shelter is that when you surrender a dog, what happens to him is completely out of your hands."
It isn't clear what length of time Convoy supporters may face if arrested for peacefully protesting, but the government has been clear that it could be up to one year in prison, in addition to a possible $100,000 fine.
This move, while despicable, should come as no surprise, as authoritarian regimes often resort to such measures when under stress.
Last year, the Australian government euthanized 15 rescue dogs, including ten puppies, at an animal shelter to 'stop the spread' of COVID amongst the devastated staff.
As it stands, all Canadians continue to be held hostage following Trudeau's invoking of the Emergencies Act, with Canadians' who happened to support the Convoy financially being threatened with the possible freezing of their bank account. Dogs are just the latest target for a government in shambles.

1. The Savior wasn't attractive to the Hebrews when he came. They thought he was going to bring victory and prosperity to Israel through force. Instead he came as the suffering servant.
2. The cabal is learning that Jesus/God/Holy Spirit cannot be fucked with. God always comes out on top.
3. The Mystical Body of Christ on earth cannot be fucked with, they are protected by God.
4. Those dancing in the streets, the Body of Christ, couldn't be fucked by the cabal no matter how hard they tried.
5. The Mystical Body of Christ on earth can be healed.
The opposite of unfuckable is fuckable. This relates to the evil being wiped out.
1. evil always comes packaged in attractive ways, temptation
2. evil is getting fucked bad right now by God and the Body of Christ
3. evil is getting fucked up permanently, this is for keeps, it can't be healed unless God allows it
Also had visions of disorded people last night with all sorts of demonic facial implants. Then I had a vision of shit and piss all over the floor in jail facilities / institutions. Attorney General Merrick Garland claimed the action by Missouri “impedes criminal enforcement operations” in the state.
“A state cannot simply declare federal laws invalid,” Principal Deputy Assistant Attorney General Brian Boynton, head of the Justice Department’s Civil Division, also said.
According to the department, the law has caused confusion among officials and said many local authorities have not been as cooperative with federal authorities.
“Critical information that state and local offices previously shared with federal law enforcement officers to facilitate public safety and law enforcement is now frequently unavailable to federal law enforcement agencies,” the complaint states.
A spokesperson for the Missouri Attorney General’s Office responded to the suit by standing by the gun rights law and accusing President Joe Biden’s administration of putting “partisan politics ahead of public safety.”
Missouri’s law is also facing a challenge in the state’s Supreme Court, which heard arguments in the case earlier this month.

Durham probe: Russiagate isn't Watergate – here are key differences
Eight days before the 2016 presidential election, the New York Times ran what I would describe as a memorable headline, except it seems to have been forgotten in recent days: "Investigating Donald Trump: F.B.I. Sees No Clear Link to Russia."
The underlying report makes for fascinating reading. In hindsight, the Times undoubtedly regrets publishing it. Clearly, the paper believed that Donald Trump didn’t have a prayer of winning the then-imminent election. It would not otherwise have reported a determination by the nation’s premier law-enforcement and domestic-security agency that the Trump-Russia "collusion" narrative – which the Times had spent so much energy hyping – was unfounded.
But the Times, like the FBI itself, was confident that Hillary Clinton would win comfortably. It was thus time to clear the decks and tone down the "collusion" chatter. Had Clinton prevailed, as everyone was so very sure she would, we’d never have heard another word about "collusion." Having served its purpose, which was always political, the smear would be retired.
Nevertheless, the Times report is worth remembering in light of the Watergate comparisons that have filled the air waves since Russiagate special counsel John Durham’s revelation last week that Clinton campaign operatives pushed the CIA to investigate then-President Trump –allegedly based, in part, on Clinton-friendly tech executive Rodney Joffe’s privileged access to government records of White House internet-traffic.
As the Times explained on Oct. 31, 2016, the FBI had scrutinized but rejected the suspicion of "cyberexperts" that there was "a mysterious computer back channel between the Trump Organization and Alfa Bank, which is one of Russia’s biggest banks and whose owners have longstanding ties to [Russian President Vladimir Putin]."
We now know, of course, that the "cyberexperts" in question were led by Joffe. Durham’s indictment of Democratic Party lawyer Michael Sussmann elaborates that Joffe, who was hoping to land a job in the anticipated Hillary Clinton administration, collaborated with a group of fellow tech experts to mine and distort the internet data to which they had privileged access due to a government contract. The objective was to support the Clinton campaign’s project to portray Trump, then the Republican presidential nominee, as a Putin puppet.
What the Clinton operatives were pushing the FBI, and later the CIA, to do was political spying. That is indeed scandalous. Although the media-Democrat complex would prefer to ignore or discredit the scandal, it deserves a lot more attention.
But the incident brings into sharp relief the flaw in Watergate comparisons so cavalierly tripping off the tongues of former President Trump and his supporters.
In Watergate, it was the executive branch of government itself that put the law-enforcement and intelligence apparatus of the government in the service of partisan politics. That’s what made the conspiracy so perilous. When government officials, behind the veil of "national security," abuse these awesome powers to achieve partisan ends and maintain their grip on power, our democratic republic truly is threatened.
That, however, is not the case when a third party beseeches a government security agency to use its investigative authorities for the purpose of slandering a political enemy, and the government agency ends up clearing the political enemy of wrongdoing.
That is what happened to the Alfa Bank allegation that was sculpted by Joffe and peddled to the government by Sussmann.
To be sure, the FBI did conduct an investigation. We should be alarmed that an investigation of a presidential candidate could be triggered because politically connected insiders have trusted access to government data and chummy relations with government officials.
That said, though, this was not a Watergate situation. It was not a scenario in which the White House, based on no credible evidence, tasked the FBI to scrutinize the opposition party’s presidential nominee so a story could be spun that a communications back channel had been established between that nominee and a hostile foreign regime. It was not even a situation in which the FBI, because of the tight alliance between former Secretary Clinton and then-President Obama, collaborated with the Clinton campaign in framing Trump as if he had established a secret system for exchanging messages with the Kremlin.
No, what happened here is the Clinton campaign tried to recruit the FBI into portraying Trump as having a back channel to Putin, but the FBI not only rejected the allegation but managed to get its rejection leaked to the nation’s most prominent newspaper. As the Times put it, "Law enforcement officials say that none of the investigations so far have found any conclusive or direct link between Mr. Trump and the Russian government."
Now, let’s maintain an even keel on this. The FBI’s performance in Russiagate was erratic, at best. At times it veered from malevolent to incompetent. The Bureau opened an investigation in which Trump was obviously the focus based on scant evidence. Even as the Bureau dropped the Alfa Bank investigation, it was eavesdropping on a former Trump campaign adviser based on warrants it obtained by representing to the FISA Court that Trump might be in cahoots with Putin. These warrants were continued for eight months into Trump’s presidency, and were based in part on bogus information (the Steele dossier) that the Bureau failed to verify and about which it made misrepresentations under oath to the court.
Presumably, Durham is giving the FBI’s performance a long look. Still, based on the cases he has indicted so far, his position is that the FBI was duped by Clinton operatives.
I am skeptical of that theory; I suspect Durham will have a tough time convincing juries of it. But what I think is beside the point. Here’s what we know: (a) the FBI rejected the Alfa Bank suspicions against Trump that are the context of Durham’s prosecution of Sussmann, and (b) Durham, a well-regarded prosecutor who has unearthed the political spying evidence we should all find disturbing, is portraying the FBI as a victim of, rather than a participant in, the Clinton campaign’s deceptions.
That’s not Watergate.

In a letter filed with the federal court in Manhattan Thursday, Musk’s legal team claims the SEC “seems to be targeting Mr. Musk and Tesla” because he remains “an outspoken critic of the government.” The agency is trying to “chill” his speech with “endless, unfounded” investigations, his lawyers allege.
A federal judge has also raised questions about the status of a $40 million fund established from fines paid for Musk’s controversial tweets, seeking accounting statements in a December order.
The firm appointed in May to administer distributions from the fund, set up by the SEC for harmed investors, hasn’t filed required accounting statements, U.S. District Judge Alison Nathan said in a December order. The SEC reached a settlement with Musk and Tesla in September 2018 after suing the billionaire over his tweeted claims weeks earlier that he had the funding and investor support to buy out stockholders at $420 a share.
The SEC alleged the tweets were false, and while Musk and Tesla didn’t admit to wrongdoing as part of the accord, the agency set up a so-called Fair Fund to repay investors harmed by Musk’s statements.
In the letter Thursday, Alex Spiro, one of the lawyers representing Musk and Tesla in the case, asks Nathan for a hearing “to address why the SEC has failed to distribute these funds to shareholders but has chosen to spend its energy and resources investigating Mr. Musk’s and Tesla’s compliance with the consent decree by issuing subpoenas unilaterally, without court approval.”
Spiro claims the SEC is using the 2018 settlement to “muzzle and harass” Musk and the company while ignoring its responsibility to distribute the $40 million to shareholders.
The consulting company handling the fund has said it is awaiting transfer of the money from the SEC.

it's been 5 months. in these 5 months, he/his lawyers have not filed any motion to dismiss the case.
technically all that Durham did in the last filing was present a potential conflict of interest. why would that warrant a response by Sussmann seeking to dismiss the case? why, out of nowhere, would he suddenly claim that Durham's allegations are baseless?
making false claims is a very low level charge, usually the kind of charge they would level against someone who is singing/cooperating to catch bigger fish. i might be wrong here but it sounds like after Durham's last filing, particularly the "factual background" wherein he showed his cards and essentially laid out plans to go after tech-executive one and his connections to the Clinton campaign, Sussmann was threatened, in the same way that Pentangeli was threatened by his brother appearing at the Senate hear.. i.e. "don't snitch". he seemed to be a cooperating witness.. now all of a sudden he seeks to dismiss the case.
THE SAME DAY, Durham draws attention to that particular scene of the Godfather, where the government's witness, one who had already sang and provided a sworn affidavit against Michael Corleone, suddenly reneges and decides not to snitch.
is it just me or this is all just one big coincidence?? this is not just lawyer-esque shade..

The US Department of Justice stepping up its policing of cryptocurrencies with the formation of a new task force
The US Justice Department announced the launch of the National Cryptocurrency Enforcement Team.
The task force will tackle the rise in ransomware attacks and the surge in crypto-related crimes.
Chainalysis reported that there was an 80% increase in crypto crimes in 2021.
The US Justice Department this week announced the launch of the National Cryptocurrency Enforcement Team to combat the criminal use of digital assets.
Deputy Attorney General Lisa Monaco made the announcement at the Munich Cyber Security Conference, and appointed veteran prosecutor Eun Young Choi to serve as the inaugural director of the force.
The team will meet the challenge of crypto crimes and increasingly large ransomware attacks, according to a press release from the department.
"With the rapid innovation of digital assets and distributed ledger technologies, we have seen a rise in their illicit use by criminals who exploit them to fuel cyberattacks and ransomware and extortion schemes; traffic in narcotics, hacking tools and illicit contraband online; commit thefts and scams; and launder the proceeds of their crimes," said Assistant Attorney General Kenneth A. Polite Jr. of the Justice Department's Criminal Division in the release.
The team will have a "particular focus on virtual currency exchanges" and entities that facilitate the misuse of cryptocurrency.
The rapid growth of cryptocurrency markets in 2021 also came with an 80% rise in crypto crimes, according to a Chainalysis report.
A separate report then found that cyber crooks laundered $8.6 billion worth of dirty crypto last year, and laundering surged 30%. There's been about $33 billion in crypto laundered since 2017, primarily through centralized exchanges, according to the research firm.
"The NCET will serve as the focal point for the department's efforts to tackle the growth of crime involving these technologies," Polite Jr. said.

U.S. Adds WeChat and AliExpress to Notorious Piracy Markets List

The Biden administration on Thursday added WeChat’s e-commerce ecosystem and AliExpress, an e-commerce site owned by Alibaba, to an annual list of markets that the United States says engage in counterfeiting and copyright violations.
The administration said the activities caused significant financial losses for American businesses and workers and posed risks to consumer safety last year.
The Biden administration also removed from the list several of Amazon’s foreign stores, which the Trump administration had added for the first time to its report released in January last year.
The inclusion of Amazon’s stores in Britain, Canada, France, Germany and India prompted an outcry from the company, which claimed that its inclusion was driven by a “personal vendetta” on behalf of the Trump administration, despite consumer complaints about fake products on the platform.
The new report, released by the Office of the United States Trade Representative, identified 42 online markets and 35 physical markets that sold or eased trade in a wide array of counterfeit or pirated goods, including fake Nike products, pirated books and academic papers, music files and virtual items like video games.
The list included several major Chinese e-commerce businesses, like Taobao, an e-commerce site owned by Alibaba; DHGate, a business-to-business e-commerce platform; and Baidu Wangpan, a cloud storage service that allows users to share pirated movies, TV shows and books.
In a statement, Alibaba said that it looked forward to continuing to work with governments to understand and address concerns about intellectual property protection across its platforms.
“We know the challenges in I.P. protection and remain fully committed to advancing our leadership in this area,” the company said.
A press officer for Tencent, which owns WeChat, said in a statement that the company strongly disagreed with the decision and that it monitored and deterred intellectual property rights violations.
The protection of intellectual property rights “is central to our business,” the statement said. “We take a comprehensive approach, based on industry best practices, to combating counterfeiting and infringement on all of our platforms.”
The office said some countries had made progress in cracking down on the sale of counterfeit goods, including Brazil, the Philippines, Thailand and the United Arab Emirates. It also said it had documented a shift of pirated goods from physical marketplaces to online, in part because the pandemic depressed global tourism.
The report also identified a new ecosystem: “piracy-as-a-service,” in which operators offer website templates, databases of infringed video content or other features that make it easy for customers to set up pirate operations.
“The global trade in counterfeit and pirated goods undermines critical U.S. innovation and creativity and harms American workers,” Katherine Tai, the United States trade representative, said in a statement. “This illicit trade also increases the vulnerability of workers involved in the manufacturing of counterfeit goods to exploitative labor practices, and the counterfeit goods can pose significant risks to the health and safety of consumers and workers around the world.”
The report also examined the impact of counterfeit goods on the people who make them, part of the administration’s focus on how trade affects workers. Because these businesses operate outside the law, counterfeiting and piracy often go hand in hand with unsafe working conditions, child labor, forced labor and other issues, the trade representative’s office said.
“Counterfeit manufacturing often occurs in clandestine work places outside the reach of labor market regulations and inspection systems, which increases the vulnerability of workers to exploitative labor practices,” the report said.
The report will result in no immediate penalties for the named companies, though it said the goal of publishing such a list was to “motivate appropriate action by the private sector and governments.”
Congress is mulling some actions that could clamp down on Chinese e-commerce sales, including counterfeit goods, to the United States as part of a major legislative effort at promoting U.S. economic competitiveness with China.
One provision, proposed by Representative Earl Blumenauer, Democrat of Oregon, would raise the threshold for the dollar value of a good that could come into the United States duty free from certain countries, namely China.
That level, called de minimis, is set at $800 in the United States. That’s far above the level in many other countries, a policy that critics say has led to an explosion of imported e-commerce packages, including some unsafe and illicit goods.

Detectives were told the incident occurred about one week prior during baseball practice at Midland’s MH Christensen Stadium, where the victim said he was abused as part of “freshman initiation day.” He added that he was pushed to the ground in a locker room by fellow students, who “started hitting him” and later “assaulted [him] with a baseball bat,” according to the records.

The affidavit notes that secondary principal Ellis was informed of the assault on January 20 and alerted Lee, the school’s superintendent, the next day. However, instead of bringing the matter to police, Lee allegedly launched an internal investigation, apparently taking no further action. The school’s board of trustees responded to the allegations in a statement on Wednesday, confirming the five employees had been arrested and that “school officials have, and will continue to, cooperate with law enforcement and their investigation.”
“The five administrators were notified of an alleged hazing incident involving some of our student-athletes that resulted in school disciplinary action,” wrote the board’s president, Jason Stockstill, adding “The physical, spiritual, and emotional safety of our students is the most important responsibility we bear as educators and one we take seriously.”
On “advice from legal counsel,” however, the president noted that the school would offer no further comment on the incident.

Canadian MPs have been asked to stay away from central Ottawa amid a police operation
A Canadian parliamentary session was canceled on Friday due to a police operation aimed at removing Freedom Convoy protesters, the speaker announced.
“A police operation is expected to take place on Wellington Street and other locations in the downtown core of Ottawa. Given these exceptional circumstances, and following discussion with all recognized party leadership, the sitting today is canceled,” Speaker of the House of Commons Anthony Rota said in an email sent to MPs in the morning and quoted by media outlets.
The parliamentarians were set to continue debate on the decision by Justin Trudeau’s government to invoke the Emergencies Act amid mass protests across Canada.

The Freedom Convoy demonstrations originally started as a truckers’ protest against Canada’s vaccine mandate. However, the harsh measures adopted by the authorities to quell the protests have transformed them into a full-blown anti-government action.

Former President Donald Trump and two of his children must testify in an investigation being conducted by New York Attorney Letitia James into the Trump Organization, a judge ruled on Feb. 18.
Trump’s lawyers argued that the probe violates the U.S. and New York constitutions and thus the subpoenas issued against him and his children should be quashed but New York Supreme Court Judge Arthur Engoron disagreed.
Engoron said he’s considered the arguments “and finds them to be unavailing and/or non-dispositive.”
James, a Democrat, “has the clear right” to question under oath principals of an entity after uncovering “copious evidence of possible financial fraud,” he added in his 8-page ruling.
Trump, Ivanka Trump, and Donald Trump Jr. must sit for depositions within 21 days of the order. However, each can invoke their Fifth Amendment rights, the judge said.
Trump Jr. and his sister have served as executives at the Trump Organization, Trump’s company.
Trump must also produce documents and information within 14 days in response to the subpoena issued by James’s office.

James, who vowed to investigate Trump while campaigning for the post she ultimately won, said the ruling means “justice prevailed.”

James has said her office has obtained evidence that the Trump Organization used misleading or fraudulent asset valuations to acquire loans and other economic benefits, and that securing the testimony of Trump and his children is critical to the investigation.
Trump’s lawyers had drawn attention to James’s vows and her cooperating with the Manhattan District Attorney’s Office, which is conducting a criminal investigation into Trump. They said she was acting with an appearance of “impropriety.”
Trump said James is “selectively prosecut[ing] him and his family.
“After viewing millions of pages of documents over many years, they come up with a ‘fringe benefits’ case on a car, an apartment, and on grandchildren’s education,” the former president said in a statement. “She is doing everything within their corrupt discretion to interfere with my business relationships, and with the political process.”

McCarthy Endorses Cheney Challenger In Wyoming House Race
House GOP Leader Kevin McCarthy (R-Calif.) has endorsed Rep. Liz Cheney’s (R-Wyo.) GOP challenger in Wyoming, striking a tough blow against the already-endangered incumbent.
Cheney, the daughter of former Vice President Dick Cheney, has had a relatively unchallenged political career up to this point, but her participation on the Democrat-dominated Jan. 6 Committee and her comments regarding former President Donald Trump have alienated GOP voters and officials.
Though he has yet to give an endorsement for many upcoming races, Trump quickly endorsed attorney Harriet Hageman to replace Cheney in the one-district state of Wyoming.
On Thursday, McCarthy also endorsed Hageman over Cheney, indicating that the more established wing of the GOP has also grown frustrated with Cheney’s participation on the Jan. 6 Committee.
“The most successful Representatives in Congress focus on the needs of their constituents, and throughout her career, Harriet has championed America’s natural resources and helped the people of Wyoming reject burdensome and onerous government overreach,” McCarthy said in a statement.
“I look forward to welcoming Harriet to a Republican majority next Congress, where together, we will hold the Biden Administration accountable and deliver much-needed solutions for the American people,” he added.
Rep. Elise Stefanik (R-N.Y.), who has been an outspoken critic of the Jan. 6 commission, followed suit in giving her endorsement to Hageman.
“I’m proud to endorse Harriet Hageman in her race to unseat Liz Cheney,” Stefanik said in a press release. “House Republicans were ready for a change when I took over as Conference Chair, and it’s resoundingly clear that Wyoming families are too.
“Liz Cheney abandoned her constituents to become a Far-Left Pelosi puppet. Liz sadly belongs in an MSNBC or CNN news chair, not in Congress representing Wyoming—a state that voted for President Trump by over forty points.
“Harriet is a true America First patriot who will restore the people of Wyoming’s voice that has been long forgotten by Liz Cheney.”
Cheney has faced criticism for being more concerned with the goings-on of the Jan. 6 commission and Trump than she is with the needs of Wyoming voters, and both McCarthy and Stefanik indicated that they agree with the criticism.
Cheney, who is not a native to Wyoming, began her career in the House with a bid to take Cynthia Lummis’ seat after the former representative resigned to join the U.S. Senate.
In 2016, Cheney won the state GOP primary with around 40 percent support, easily edging out the closest rival who had around 22 percent support. She later won the general election in the red stronghold with 62 percent of the vote. In 2018, she widened her margins in the GOP primary substantially, winning 67.7 percent support, and later won the general election with 63.6 percent of the vote. Cheney further increased her margins in 2020, winning nearly three-quarters of the vote in the GOP primary, and winning the general election with 68.6 percent support.
But this year, after her comments about the Jan. 6 “Stop the Steal” rally led to her and compatriot Adam Kinzinger (R-Ill.) being censured by the Republican Party, the situation for Cheney is far less sanguine.
A recent straw poll of Wyoming GOP activists shows that, at least among party officials, Hageman’s campaign has far more momentum. According to the local Casper Star-Tribune, of the 71 activists polled, 59 cast their ballot for Hageman, while only six voted for Cheney. The remaining votes were cast for an assortment of local Wyoming lawmakers.
While the straw poll does not necessarily predict the outcome of the primary vote later this year, it does indicate that Republican officials have little love for Cheney.
In addition, Cheney will likely not have access to support from the GOP.
In its resolution censuring Cheney and Kinzinger, the Republican National Committee (RNC) said that it will “immediately cease any and all support of them as members of the Republican Party for their behavior which has been destructive to the institution of the U.S. House of Representatives, the Republican Party, and our republic, and is inconsistent with the position of the Conference.”
The RNC resolution came after the Wyoming GOP had already voted to expel Cheney from the state party.
Without this critical network of support, Cheney could have significant difficulty in raising funds to finance her reelection bid.
Still, Cheney has given no indication that she intends to follow Kinzinger in retiring, but McCarthy’s endorsement of her challenger is another tough blow for Cheney’s already-dire prospects.

Republican Rep. Jim Hagedorn dead at 59
Rep. Jim Hagedorn, R-Minn., passed away at the age of 59, his wife Jennifer Carnahan announced on Facebook.
Hagedorn announced a reoccurrence of kidney cancer last July and had tested positive for COVID-19 last month. A cause of death was not mentioned in Carnahan's Facebook post.
Hagedorn was elected to represent Minnesota's mostly rural 1st Congressional District south of Minneapolis in 2018. Shortly after being sworn in, he was first diagnosed with kidney cancer.
Hagedorn's office informed Republican leadership of his death Friday morning, Fox News is told.
"Jim loved our country and loved representing the people of southern Minnesota," Carnahan wrote. "Every moment of every day he lived his dream by serving others. There was no stronger conservative in our state than my husband; and it showed in how he voted, led and fought for our country."
Hagedorn is the third House member to die during the 117th Congress. Rep. Ron Wright, R-Texas, and Rep. Alcee Hastings, D-Fla., died last year. Also, Rep.-elect Luke Letlow, R-La., died in December 2020 from complications related to COVID-19 after being elected but was never sworn in.
The new breakdown in the House is 433 members: 222 Democrats, 211 Republicans and two vacancies – Hagedorn's seat and the seat of former Rep. Devin Nunes, R-Calif., who resigned.
Carnahan described him as a "loving husband, son, brother, uncle, cousin, nephew, friend, brother-in-law, son-in-law, Vikings, Penguins and Twins fan."
"While nothing can accurately prepare you for the unimaginable pain, intense sorrow, suffocating grief and seemingly never-ending emptiness that engulfs the entire body, soul and spirit when your forever love passes away; at least we can smile knowing Jim is smiling from heaven encouraging us to keep chasing our dreams, loving unconditionally and fighting for the country," she continued.
"Jim Hagedorn, I love you," Carnahan concluded. "I miss you. I feel empty without you. I will forever be holding your hand."

ew York (CNN Business)It has been about two decades since Microsoft and the US government went head-to-head in one of the country's biggest-ever antitrust battles. In the years since, Microsoft has managed to mostly stay off the radars of lawmakers and antitrust regulators, even as scrutiny of other tech giants has ramped up.
But with its plan to acquire popular video game developer Activision Blizzard (ATVI) for nearly $70 billion, Microsoft (MSFT) may be thrust firmly back into the antitrust spotlight. The blockbuster deal would secure Microsoft's spot among the most dominant global players in gaming alongside Sony and Tencent, and it would expand the tech company's first-party content library to include some of the most popular titles in gaming, including "World of Warcraft" and "Call of Duty."
Industry watchers say it's a risky time for Microsoft to try to push through what would be the largest acquisition in its history. The head of the nation's antitrust enforcement agency, Federal Trade Commission Chair Lina Khan, has pledged to crack down on companies consolidating power and reducing competition in a range of industries, especially technology. Activision Blizzard's stock is currently trading nearly 15% below the acquisition share price, a possible sign of investor skepticism about the deal going through.

Still, Microsoft isn't the only one who faces a risk if the FTC does decide to challenge the deal. It could also present some uncomfortable challenges for Khan and the agency by highlighting limitations in their ability to tackle a new era of potential antitrust issues raised by the tech industry.
In her first six months leading the FTC, Khan laid out an ambitious agenda that involves pushing sweeping reforms to the practice of antitrust law and being more proactive about blocking potentially anticompetitive mergers before they're completed. Her plans have been bolstered by support from the White House and bipartisan agreement among lawmakers about the need to rein in massive tech firms.
Challenging the Microsoft-Activision deal could be a chance for Khan to prove she's serious about taking action. However, there remain serious legal hurdles to the FTC actually winning such a lawsuit (should it decide to bring one) — namely that the law itself is slow to change, and the existing rules and practice may not be enough to block even such a large acquisition.
Both antitrust experts and the FTC itself have also noted that the agency is short on resources, especially compared to large tech companies. And it's unclear whether Khan will want to spend those limited resources on Microsoft and the gaming industry — or, for that matter, to make it one of her first new antitrust fights against Big Tech — rather than focus on some of the other ways tech companies have potentially consolidated markets. For example, Khan's FTC is moving forward with a Trump-era suit to unwind Facebook's years-old acquisitions of Instagram and WhatsApp, and it is also reportedly engaged in an extended review of Amazon's acquisition of movie studio MGM.
It's still early in the process. Microsoft filed formal paperwork with the FTC to kickstart the merger review process and delivered an initial briefing to FTC staff earlier this month. The agency's review process could take months. But antitrust experts say Microsoft's nearly $70 billion bid for Activision will be hard for the FTC to ignore.
A deal of this size "is almost a challenge to Lina Khan to kind of bring it on," Hal Singer, managing director at economics research firm Econ One and a professor at Georgetown Business School, told CNN Business. "She's trying to push back and slow down the train, and this is basically the tech sector just saying, 'You can't stop us.'"
The FTC typically does not discuss deals under review and did not respond to a request for comment on this story. Microsoft pointed CNN Business to comments from President Brad Smith — who was the company's general counsel during its last antitrust battle — in a recent briefing with reporters, where he said it "is so early in the process that we're not yet at a point where we're getting any real feedback [from the FTC]. We wouldn't expect to yet."
Microsoft CEO Satya Nadella also commented on the deal during the briefing, saying: "We want to compete … I want us to approach this in a principled way where we are building our platforms, our technology, such that we are on the right side of history."

Evaluating the Microsoft deal
At the heart of regulators' evaluation of any merger is the question of how much the deal could reduce competition, and therefore threaten to raise prices for consumers or cause other harms.
There are a few ways to approach this: Because Microsoft, like Activision Blizzard, designs some of its own games, it's possible that the deal could be considered a "horizontal merger," the term for when one company is acquired by a direct competitor, effectively consolidating the market. But because there's significant competition in the game development space, regulators are less likely to be concerned about this aspect of the deal, antitrust experts say.
If the FTC does decide to challenge the deal, it will likely instead be on the grounds that it is an anticompetitive "vertical merger." A vertical merger is one in which one company (think, Microsoft, which creates gaming platforms and consoles) acquires another company in the same industry but a different part of the supply chain (like Activision Blizzard, which makes the games to play on those platforms).
That's where things could start to get tricky for the FTC. It can be harder to prove potential harms from a vertical merger than from a horizontal merger because the economics are more complex, according to Daniel Crane, a law professor and antitrust expert at the University of Michigan. In a horizontal merger, two competitors become one competitor, making it more apparent how overall competition in the market is reduced. But in a vertical merger, the end result is less straightforward. (There have also been fewer challenges to vertical mergers over the past few decades, which would mean less legal precedent to rely on in court.)
In a vertical merger case against Microsoft, regulators would look at whether the deal could result in the denial of a crucial product to competitors that would impede their ability to compete effectively. In this case, that would likely mean looking at whether Microsoft could make existing or future games developed by Activision Blizzard exclusive to its platform, to the detriment of rivals like Sony.
In theory, that proposition is part of what makes the deal attractive. Microsoft has been trying to drive a growing slate of content into its Game Pass subscription offering to attract new users and keep existing ones paying for the membership, said Forrester analyst Will McKeon-Wright. (Microsoft has suggested it won't make Activision content exclusive to its own platforms, although the company could still profit from licensing deals with competitors' platforms.)
Much of the antitrust argument could come down to how you define the market. Regulators would likely want to focus on a smaller market — game consoles, for example — where it could contend that Microsoft is a dominating force. The company, meanwhile, would likely argue that it competes for consumers' attention with a broader collection of companies, such as Netflix and TikTok.
"There might be something in the Activision portfolio, that by denying it to a rival gaming platform, Microsoft could cripple that rival platform," Singer said. If there is, regulators may reasonably be able to make the case that consumers could expect higher prices from the deal.
Still, "the chances for the government, under the current state of the law, are very low for stopping a vertical merger," Singer said. The failed challenge to the AT&T-Time Warner merger in 2018 is one of the only recent examples of litigation over a vertical merger. (Time Warner, which later rebranded as WarnerMedia, is CNN's parent company.)
"If I'm Microsoft and I'm looking at this kind of a deal, I think I'm expecting pushback from the FTC and possibly litigation," Crane said. "But I'm also feeling pretty good about my chances."
The challenge for the FTC
That's where Khan's plans to overhaul the country's approach to antitrust come into play. For the past several decades, antitrust regulators have focused chiefly on the potential for mergers to raise prices for consumers. Now, Khan, who has been concerned about vertical mergers since before starting at the FTC, is proposing a broader framework for how to think about the possible harms from mergers and corporate consolidation, such as the impact on workers in the affected industry.
To that end, the FTC in September withdrew guidelines for evaluating vertical mergers that the agency released during the Trump administration, and is now working with the Justice Department's Antitrust Division to review whether to release updated guidelines that reflect technological and economic changes in recent years. That update could include giving regulators more leeway to consider whether a merger might "tend to create a monopoly," even in its early stages, the agencies said.
The review is being made, at least in part, with an eye toward better regulating the tech companies, who have defended mergers and their growing power by pointing to the many free products and services they provide to consumers.
While the guidelines are not legally binding, the fact that there currently are none for a court to refer to may mean that the FTC is not yet ready to come out swinging with a challenge to the Microsoft-Activision deal. "You want that thing in your hand when you go in to challenge this deal, you really don't want to go in without it," Singer said of the FTC.
But it's unlikely that those revised guidelines, the public comment period for which began last month, will be ready in time for a potential case against the Microsoft deal. Even if the new guidelines were released during litigation, "you know what Microsoft's going to say, they're going to say, 'they wrote these guidelines with us in mind,'" Crane said. (The FTC could wait to take action, as it has shown that it's willing to revisit mergers even years after the fact with its lawsuit seeking to break up Facebook, but Khan has indicated a desire to challenge potentially anticompetitive deals before they go through.)
In the end, the acquisition could end up closing with a consent decree, a settlement where the acquiring company agrees to make some concessions to complete the deal, as many other vertical mergers have in recent decades. Microsoft has already hinted at its willingness to negotiate and play nice with competitors to help ensure the deal goes through. Shortly after the deal was announced, Microsoft's head of Xbox, Phil Spencer, tweeted that he had spoken with leaders at Sony.
"I confirmed our intent to honor all existing agreements upon acquisition of Activision Blizzard and our desire to keep Call of Duty on PlayStation," Spencer said. "Sony is an important part of our industry, and we value our relationship."
And last week, the company made a more detailed appeal to regulators to bless the deal. It promised to ensure that the popular franchises it acquires from Activision Blizzard will remain available on PlayStation under Activision's existing deal with Sony. The company also said it has offered to extend the deal on a "multiyear basis." Activision's existing deal with Sony runs until 2024.
"I would be very surprised if Microsoft wasn't willing to make a number of concessions to get this deal done. The question is whether that would be acceptable," Crane said. "[The FTC] want to be seen as active and doing things and really changing the status quo in antitrust."

Utah’s Republican Governor Vows To Veto School Voucher Bill After Taking $75,000 From Nation’s Largest Teachers Union
Utah’s Republican Gov. Spencer Cox vowed to veto a school choice bill on Thursday as school choice advocates point out that the Governor accepted $75,000 in campaign funds from the nation’s largest teachers union.
Cox said during his monthly news conference that he would veto House Bill 331, which would create an educational voucher program that establishes “scholarship accounts on behalf of eligible students to pay for private education goods and services” for the 2023-2024 school year, according to a local news outlet.
“Yeah. Yeah, I would,” Cox said on vetoing the bill. “At some point, I will be absolutely willing to support vouchers, but that point is not now because we are underfunding our schools.”
Cox’s office directed the Daily Caller to his radio show for further comments on his decision to veto the bill. The Governor said that he will support funding a voucher program when the starting salaries for teachers hits $60,000.
School choice advocates pointed out that the nation’s largest teachers union, the National Education Association (NEA), donated $75,000 to Cox’s 2020 campaign. The Utah Education Association (UEA), an affiliate of the NEA, also endorsed the Republican Governor.
The UEA is vehemently opposed to House Bill 331, according to its website. The union’s Government Relations Director said that the bill requires “exactly zero reporting about student learning outcomes” and condemned the program for allegedly paying “twice as much state funding to students attending a private school.”
Funding for government-run public schools goes up under House Bill 331.
“Educators have been crystal clear that what they need most are time, resources, and respect and HB 331 delivers absolutely none of these things. None,” said UEA President Heidi Matthews.

Four Senate Republicans failed to show up to vote on an amendment that would have defunded President Joe Biden’s remaining vaccine mandates, thus ensuring its failure.
The Senate voted on Sen. Mike Lee’s (R-UT) amendment to the continuing resolution (CR), which would defund Biden’s remaining vaccine mandates. The measure failed 46-47, with Sens. Mitt Romney (R-UT), Jim Inhofe (R-OK), Lindsey Graham (R-SC), and Richard Burr (R-NC) failing to show up, depriving Senate Republicans a potential majority to pass the amendment to the CR.
Senate Majority Leader Chuck Schumer (D-NY) set the vote threshold to a majority, and it remains possible that he could have set the threshold to 60 if Republicans had enough votes to pass with a majority; however, Democrats broke and voted to defund Biden’s private employer mandate the last time they voted on vaccine mandates. This could have put more pressure on Democrats to support the defunding of Biden’s vaccine mandates.

Former Trump admin official exposes how traitor Mike Pompeo allowed the deep state to attack the security clearance of patriots
Former Trump administration official Catharine O’Neill is blowing the whistle on how former Secretary of State Mike Pompeo allowed the deep state to target patriots and Trump loyalists and looked the other way.
O’Neill, who worked at the Department of State and U.S. Agency for International Development in the Trump administration, was targeted by the deep state because of her patriotic political beliefs for a revocation of her security clearance. Pompeo did nothing to stop this from happening. O’Neill blew the whistle in response to a question from journalist Mike Cernovich.
“How many of you know that [former Secretary of State Mike Pompeo] pulled the security clearances of Trump’s most loyal supporters?” Cernovich asked in a Twitter post.
“Unfortunately I was one of those people. I almost lost my clearance because I was politically targeted. Secretary [Mike Pompeo] and his team did NOTHING to help me,” O’Neill wrote in response.
Ultimately, it was the patriots over at Judicial Watch who intervened on O’Neill’s behalf as Pompeo shirked his duties as an American and exposed himself as a Pence-tier traitor and enemy of the Republic.
“It was [Judicial Watch] that came in and stood up for me and helped me get my clearance back,” she wrote, promising to share the “full story” in the near future.

Judicial Watch Sues CIA for Records of Contacts with Indicted Clinton Campaign Lawyer Michael Sussmann
Judicial Watch announced today that it filed a Freedom of Information Act (FOIA) lawsuit against the Central Intelligence Agency (CIA) seeking records of meetings and phone conversations between any CIA personnel and former Clinton campaign lawyer Michael Sussmann, who has been charged in Special Counsel John Durham’s investigation with making a false statement to a federal agent (Judicial Watch v. Central Intelligence Agency (No. 1:22-cv-00412))
Judicial Watch filed the lawsuit after the CIA failed to reply to an October 26, 2021, FOIA request for:
All records regarding any meetings or telephonic conversations between any official or employee of the Central Intelligence Agency and Mr. Michael Sussmann (formerly an attorney with Perkins Coie) between January 1, 2015 and the present. This request includes, but is not limited to, all notes, transcripts, summaries, or other records created in preparation for, during, or pursuant to the meetings or conversations.
On February 11, Durham, who is investigating the origins of the Trump-Russia investigation, filed a motion, which focused on potential conflicts of interest related to the representation of Sussmann, who has been charged with making a false statement to a federal agent. Sussmann has pleaded not guilty.
According to a February 15, 2022, Fox News report, a spokesperson for the individual labeled in Durham’s latest filing as “Tech Executive-1” has seemingly identified the CIA as the “second” federal government agency to which Sussmann provided an “updated set of allegations” to “establish ‘an inference’ and ‘narrative’ ” tying Donald Trump to Russia.
Durham writes in the latest filing:
[O]n February 9, 2017, [Sussman] provided an updated set of allegations – including the [Alfa Bank] data and additional allegations relating to Trump – to a second agency of the U.S. government (“Agency-2”). The Government’s evidence at trial will establish that these additional allegations relied, in part, on the purported DNS traffic that Tech Executive-1 and others had assembled pertaining to Trump Tower, Donald Trump’s New York City apartment building, the EOP, and the aforementioned healthcare provider. In his meeting with Agency-2, the defendant provided data which he claimed reflected purportedly suspicious DNS lookups by these entities of internet protocol (“IP”) addresses affiliated with a Russian mobile phone provider (“Russian Phone Provider-1”). The defendant further claimed that these lookups demonstrated that Trump and/or his associates were using supposedly rare, Russian-made wireless phones in the vicinity of the White House and other locations. The Special Counsel’s Office has identified no support for these allegations.

The Canadian government’s Emergency Measures Regulations: SOR/2022-21 order bans people from taking part “in a public assembly that may reasonably be expected to lead to a breach of the peace.”

This includes Indians, refugees, immigrants, asylum seekers and ‘protected temporary residents’.
The exemptions have left some people asking if the prohibition order only applies to white people.

The never-before-told backstory of Pence's Jan. 6 argument
For most of his life, J. Michael Luttig has operated behind the scenes at the top of the conservative legal world. He started his career as a young aide at the U.S. Supreme Court, worked as an attorney in the Reagan White House, clerked for Judge Antonin Scalia before he was a legal icon, helped guide the appointment of two other Supreme Court justices and was appointed to a federal judgeship by former President George H.W. Bush.
During Luttig’s time on the bench, one of his clerks was a young attorney named John Eastman. In recent months, Eastman’s name has become inextricably tied to the legal advice he offered to then-President Donald Trump in December 2020 and January 2021: In a now-infamous legal memo, Eastman argued that then-Vice President Mike Pence had the ability to discard certified electoral votes from contested states — a notion that has been roundly debunked, but which Trump’s closest allies clung to (and which helped to inspire some of his supporters to storm the Capitol in rage).
That story is, by now, well known. But there’s another part of the story — one that hasn’t been told until now.
Today, in his first in-depth interview on the topic, Luttig shares the story of those days before the insurrection, when he was unknowingly enlisted to help Pence reject Trump’s efforts on Jan. 6.
For “Playbook Deep Dive,” Ryan Lizza talks with Luttig about his advice to Pence then, what needs to be done to rewrite the Electoral Count Act now and why he’s choosing this moment to make his legal commentary loud, clear and very public — in panel discussions and op-eds in publications like The New York Times. A transcribed excerpt from that conversation is below, edited for length and readability.
J. Michael Luttig: I was first called by the vice president’s outside counsel, Richard Cullen, on the evening of Jan. 4. We now know that that was after the fateful Oval Office meeting that day between the president and vice president, where John Eastman made the argument that the vice president could overturn the election unilaterally as presiding officer.
Ryan Lizza: And you know John Eastman?
Luttig: John Eastman was one of my clerks — over 25 years ago — and Richard Cullen is one of my closest friends in all of life. And we had been, at that point, talking seemingly every day — if not multiple times a day — throughout the entire Trump administration because, of course, our close friend, Bill Barr, was attorney general.
So he called me. I was having dinner. No big deal: this is like your best friend calling. He called the night of the 4th and says, “Hey, Judge, what do you know about John Eastman?” And I said, “He was a clerk of mine 30 years ago.” He says, “Well, what else do you know?” I said, “I don’t know. John’s an academic, he’s a professor, he’s a constitutional scholar — and he’s a brilliant constitutional scholar.”
Lizza: This is sort of shocking to hear you say this, considering the way that most people have been introduced to John Eastman.
Luttig: Well, read everything that was written about him before, you know, Jan. 6.
Lizza: So that’s interesting: the person who was the architect of the attempted coup, essentially — I think it’s fair to use that language — was actually a well-respected legal mind with sound views of the Constitution and not some legal quack.
Luttig: That’s correct: The farthest thing from it. So Richard said, “Well, you don’t know, do you?” And I said, “Know what?” He said, “John’s advising the president and the vice president that the vice president has this authority [to reject electoral votes] on January 6” — two days hence. And I said, “Wow, no, I did not know that. Well, look, you can tell the vice president that I said that he has no such authority at all. And Richard said he knows that, I said OK, and we hung up.
So I told my wife about the call, and I said, “Wow. This is big.” I got up the next morning — I get up about 4:45 — and I’m having my coffee, and Richard calls — which is not unusual. But the call was unusual. He said, “Judge, can you help the vice president?” And I said, “Sure, what does he need?”
He said, “Well, we don’t know what he needs.” And I said, “What do you mean you don’t know what he needs? Then why are you calling me?” He said, “Look, this is serious.” I said, “OK, I understand. What do you want?” He’s talking with Marc Short and the vice president. And he says, “We need to do something publicly, get your voice out to the country.”
At that point, I said, “Oh my gosh, Richard, I don’t even have a job, much less an official one. I have no platform from which to speak.” I’m out here in Colorado at 6 in the morning. I don’t even have a fax machine. I said, “I really don’t even have a thought.” And he said, “This is urgent.” I said, “I understand.” He said, “I’ll call you back in five minutes.” So we hung up, and I sat there, finished my coffee — just racking my brain.
Just try to put yourself in my position. I had not a clue [what to say].
So he calls me back in five minutes: “You got anything yet?” And I said, “No, I don’t, Richard.” He says, “I’ll call you back in 10 minutes.” So he calls back in 10 minutes, and I said, “Richard, honest to goodness, I have no earthly idea what I can do.” And he says, “I’ll call you back in 10 more minutes, but we’ve got to move.” He called back in 10 minutes, and I said, “Alright, I opened a Twitter account a couple of weeks ago, but I don’t know how to use it.” He said, “Perfect.” And I said, “I told you: I don’t know how to use it.” He said, “Figure it out and get this done.” So I called my tech son who works for Peter Thiel, and I said, “How do I tweet something more than 180 characters long?
Lizza: Wait a second. You’re in the position here where the vice president is being pressured by the president of the United States to overturn the results of the election. And you’re the go-to legal mind who’s respected among Republicans that the vice president is looking to to essentially stop a coup. Do I have that right?
Luttig: To answer the question you’re asking: I understood the gravity of the moment and the momentous task that I was being asked to help the vice president with. I had been following all of this very closely in the days leading up to it. It was then — and may forever be — one of the most significant moments in American history. I’m a cut up, but I’m deadly serious when the time comes, and that day, I was as serious as I can possibly be.
Lizza: But first, you’ve got to learn how to tweet.
Luttig: So my son … well, first off, he says, “Dad, I don’t have time for this. You’ve got to learn this stuff on your own. … I’m busy.” To which I said something like, “Just tell me right now how to get this done, or I’ll cut you out of the will.”
The only thing I knew how to do was type out in prose all I wanted to say. Well, that was like 10 tweets [long]. So I go down to my office, and I open up the [Twitter] instructions on my laptop and I copy and paste what I’ve written on my iPhone into my laptop into a Word document, and then I set about to divide it up into 180-character tweets. I read it and reread it multiple times and then, I take a deep breath and I hit “tweet.”
Almost immediately, reporters started calling me: “Judge, what are you doing?” And I say, “What do you mean?” And they said, “You didn’t just tweet what you just tweeted for no reason.” And … I said, “If I tweeted this for a reason, I would not be at liberty to tell you.” Minutes later, The New York Times ran the tweet…
Lizza: And more importantly, the vice president cited your legal analysis on Jan. 6 in his famous letter explaining what his responsibilities and authorities were that day.
Luttig: Yes, that might be the greatest honor of my life. But it came to my attention in the least auspicious way. I got two back-to-back emails on [January] 6th from two of my clerks — both of them to the effect of: “Judge, we know what you’re doing.” And I said, “Guys, I don’t know what you’re talking about.” They said, “The vice president is on his way to the Capitol, and he cited you in his letter to the nation.” And they sent me a copy of it.
That’s the first time that I ever knew what was to happen with the tweet from the day before. No one had ever told me that. I had no idea. And they obviously didn’t want and didn’t intend to tell me — and that’s fine; it’s none of my business. I was floored to read that and honored.
Lizza: That was a total surprise? In the most important moment of Vice President Pence’s life, that letter justifying that no, he cannot overturn the results; his role as simply ministerial — that was a total surprise to you that he cited your legal analysis as the justification for his view?
Luttig: Complete, utter surprise. And the vice president called me the next morning to thank me.
Lizza: Can you tell us a little bit about that conversation?
Luttig: He was the most gracious person in the world. I was at a UPS Store in Vail, Colorado, standing outside freezing, and my wife was sending a package. A call came [on my phone] as spam. I never answer spam calls, but I had nothing else to do. So I answered it. I said nothing for seemingly 15 seconds. And then a voice said, “Is this Judge Luttig?” And I was startled and said “Yes, it is.” And the voice said, “Please hold for the vice president.”
I scurried out to the car so I’d have some privacy. The vice president got on: “Judge, this is Mike Pence.” And I said to the vice president that it was the highest honor of my life that he had asked me and I will be grateful to him for the remainder of my life.
