In a major reversal from its previous push to get kids under 5 vaccinated against COVID, Pfizer has withdrawn its application from the FDA for its COVID vaccinations for kids under 5 yrs old.

The company said it “did not have enough data” to recommend it for young kids.

CNET reports – Last week, Pfizer and BioNTech submitted data to the FDA for authorization of their COVID-19 vaccine for children 6 months through 4 years old. While the vaccine for children under 5 is expected to be a three-dose vaccine series (it’s one-tenth the volume of Pfizer’s vaccine for people 12 and up), the FDA asked the companies to submit data on the first two doses as part of a “rolling submission” process.

In December, Pfizer announced that while two doses of the vaccine were effective in children ages 6 months to 2 years, two shots failed to promote a strong enough immune response in children ages 2 through 4 years. This prompted the company to start testing a three-dose version of the vaccine for children under 5.

1/ KYIV, Ukraine—While the U.S. is warning of a potential new Russian invasion of Ukraine, officials in Moscow are claiming another military scenario is in the offing: an attempt by Kyiv to retake by force territories in its east.

Western officials can’t say for certain how an attack on Ukraine might unfold by the more than 100,000 Russian troops that now bracket the country on three sides.

But Russia’s ever-louder warnings of an escalation by Kyiv in Donbas in eastern Ukraine, they say, point to one way in which Moscow may try to recast an offensive as a reluctant act of self-defense.

In Donbas, Russia fomented a separatist conflict in 2014 and then covertly sent military units to slice two largely unrecognized territories from Kyiv’s control. Heavy fighting there was halted by a peace deal in 2015, but Ukrainian and Russian-led forces still trade mortar and sniper fire across largely fixed front lines.

Now, Moscow has pointed to what it says is Ukraine’s military activity near Donbas as an escalating threat.

“Preparations are in full swing,” Russian Foreign Intelligence Service Director Sergei Naryshkin said of Ukrainian war plans. Kyiv, he told a Russian newspaper Thursday, had deployed its best military units near the front line of the eight-year conflict with Moscow-led separatists, and it was being pumped up by weapons deliveries from the U.S. and its allies.

Russian Foreign Minister Sergei Lavrov accused the U.S. of leading a “propaganda campaign about ‘Russian aggression’ against Ukraine” in a phone call Saturday with his U.S. counterpart, Secretary of State Antony Blinken. Mr. Lavrov said the campaign pursues “provocative goals” by encouraging Kyiv to sabotage the Minsk agreements and try to resolve the “Donbas problem” by force, according to a Russian Foreign Ministry readout of the call, which it said was requested by the U.S.

Ukrainian officials have repeatedly said they have no such plans, and that Russian claims could be part of an effort to create a pretext for an invasion.

Moscow’s accusations that Ukrainian forces are preparing to attack Donbas could be used to support an array of military options, Western analysts say. If a Russian attack were launched to take Kyiv, the Kremlin could tout the allegations to try to justify ousting the Ukrainian government and installing a Moscow-friendly regime.

On Friday, national security adviser Jake Sullivan said that a Russian invasion might begin soon with a “false flag” operation, which he defined as “something they generate and try to blame on the Ukrainians as a trigger for military action.”

If the scale of a possible Kremlin attack were more limited, it could be a way for Russian President Vladimir Putin to build leverage over Ukraine to accept Moscow’s demands in the stalemated peace talks that began in Minsk with a faltering cease-fire in 2014 and were followed up with broader talks the following year. Such an operation, they say, could also set the stage for further military steps, such as taking the canal west of Donbas that provides water to Crimea.

“A push into the Donbas would deliver something to his nationalists, put increased pressure on the Ukrainian government to capitulate to Russia’s interpretation of the Minsk agreements and test trans-Atlantic unity in the face of what would now seem to be a more measured operation than a full occupation of Ukraine,” said Evelyn Farkas, a former U.S. Defense Department official.

Russia has built a case in recent weeks that goes beyond Donbas. Moscow has accused the U.S. and its allies of arming Kyiv and dragging it into Western political and military blocs to threaten Russia. Senior Russian officials have appealed to historical ties with Ukraine, claiming it gives them a special right to intervene there.

But the narrative that Russian-speaking residents of eastern Ukraine’s Donbas region are under threat and need protection from Ukrainian nationalists enabled by the West has resonated with much of the Russian public and reflects longstanding Kremlin policies.

Mr. Putin has also long put the defense of Russian citizens and Russian speakers at the heart of his assertive policies toward former Soviet neighbors. When Russia invaded the Caucasus country of Georgia in 2008, it said it was defending its citizens from an attack by Georgia’s army.

According to Russian Federation Council senators, Russia has handed out more than a million passports to residents of the areas that its proxies have controlled in Donbas.

2/ Mr. Putin told a recent news conference, following talks with French President Emmanuel Macron, that he was concerned about the fate of the Russian-speaking population in eastern Ukraine given Kyiv’s actions.

“What worries me most of all is that they are adopting legislation that discriminates against Russian speakers,” whom Mr. Putin said had been denied proper political recognition in what he called their homeland.

Allegations by Mr. Putin’s top aides have been more sensational. Russian Defense Minister Sergei Shoigu said in December that U.S. mercenaries had provided Ukrainian forces with an “unidentified chemical component” they could use to attack eastern Ukraine.

Mr. Naryshkin, the foreign-intelligence chief, said he had information about the “the appearance of multinational units of jihadist militants.” He also warned that Ukraine’s security services were planning to stage incidents along the front lines near Donbas and then document them in the style of the White Helmets in Syria, a humanitarian group that Russia has falsely accused of conspiring to tarnish the reputation of its protégé, Syrian President Bashar al-Assad.

“The contingent of ‘rapid-deployment propaganda forces’ of Western media has been significantly increased,” Mr. Naryshkin said.

Belarusian President Alexander Lukashenko, Moscow’s closest ally, sketched out a scenario of Russia and Belarus reacting to Ukrainian aggression in an interview with a Russian reporter earlier this month, ahead of joint military exercises between the two countries that began Thursday.

“In case Ukraine starts a war in Donbas, the Belarusian army will act in exactly the same way as the Russian army, it will be a joint response,” Mr. Lukashenko said. “Do you think we’re joking around on the southern border today?”

One Russian proxy leader said Friday, without presenting evidence, that the separatists had discovered more than 130 mass graves of civilians. Ukraine has dismissed that claim as false and has sought to counter the narrative that it is planning an attack in Donbas.

“We do not intend to attack anyone,” Ukrainian President Volodymyr Zelensky’s chief security adviser, Oleksiy Danilov, said in an interview last month. “We have no plans to use the military to liberate our territories.”

Western officials have also been carefully monitoring Russia’s parliament, the State Duma, which they fear might cite the Donbas situation to support a political case for military action. Russia’s Communist Party faction prepared a proposal last month to recognize the independence of the two breakaway statelets there.

The move from the Biden administration was announced by the Department of Defense over the weekend, but an official confirmed the deployment to Fox News on Friday.

"At the direction of the President, Secretary Austin today ordered to Poland the remaining 3,000 soldiers of the 82nd Airborne Infantry Brigade Combat Team based at Fort Bragg, N.C.," the official said. "These troops will depart Fort Bragg over the next couple days. They are expected to be in place by early next week."

This group of paratroopers, the second batch of soldiers being sent to Poland, will join the 1,700 soldiers and key enablers that Austin ordered there on February 2nd.

"Nearly two-thirds of this first tranche has already arrived," the official said, noting that they are commanded by Maj. Gen. Christopher Donahue.

"All told, these 5,000 additional personnel comprise a highly mobile and flexible force, capable of multiple missions," the official added. "They are being deployed to reassure our NATO allies, deter any potential aggression against NATO’s eastern flank, train with host-nation forces, and contribute to a wide range of contingencies. Canadian police have moved in to clear out Freedom Convoy protestors blocking the Ambassador Bridge.

Demonstrators protesting COVID-19 vaccine mandates shut down traffic on the Canada-US bridge for a fifth day Saturday.

A judge ordered them to leave Friday after hearing arguments that the blockade was causing economic harm.

Police have started moving in to clear out protestors that have been blocking a crucial bridge on the US-Canadian border for the past five days.

Authorities in Windsor, Ontario, began removing demonstrators from the Ambassador Bridge on Saturday.

"The Windsor Police & its policing partners have commenced enforcement at and near the Ambassador Bridge," Windsor Police wrote in a tweet Saturday morning. "We urge all demonstrators to act lawfully & peacefully. Commuters are still being asked to avoid the areas affected by the demonstrations at this time."

Windsor Police told people to vacate the area, stating they would arrest anyone who failed to leave and ticket or tow vehicles left parked in the area.

The attempt to clear the bridge came after an Ontario Superior Court judge on Friday ordered protestors to leave after hearing arguments that they were blocking traffic, impeding trade, and hampering the production of vehicles.

Roughly $360 million of goods are transported via the bridge every day, roughly 25% of the value of all trade between the US and Canada, according to Reuters.

The blockade has caused a shortage of fruits and vegetables for some grocery stores in Canada, particularly those in rural areas, that rely on imports from the US.

Ford is reportedly considering sending car parts to its Windsor factory by plane rather than truck after the blockade cut off the supply of auto parts to the plant. General Motors and Stellantis previously told Insider production at their Canadian factories was also impacted by supply shortages from the blockade.

Demonstrations began when Canadian truckers drove to the country's capital, Ottawa, late last month, to protest COVID-19 lockdown measures and vaccine mandates in the country. The so-called "Freedom Convoy" has since spread to other cities in Canada and attracted more supporters beyond truckers, including right-wing protestors also opposed to the vaccine mandates.

Their demonstrations have sparked discussions for staging similar protests in other countries. In the US, federal officials have warned that a similar convoy could target the Super Bowl, though law enforcement says there is no "legitimacy" to the threat.

US aims to counter China by opening Solomon Islands embassy

WELLINGTON, New Zealand – The U.S. says it will open an embassy in the Solomon Islands, laying out in unusually blunt terms a plan to increase its influence in the South Pacific nation before China becomes “strongly embedded.”

The reasoning was explained in a State Department notification to Congress that was obtained by The Associated Press.

The plan was confirmed by U.S. Secretary of State Antony Blinken during a Saturday visit to Fiji, part on a Pacific tour that began in Australia.

Blinken later landed in Hawaii, where he will host the foreign ministers from Japan and South Korea to discuss the threat posed by North Korea, amid rising concerns over its recent missile tests.

The State Department said Solomon Islanders cherished their history with Americans on the battlefields of World War II, but that the U.S. was in danger of losing its preferential ties as China “aggressively seeks to engage” elite politicians and business people in the Solomon Islands.

The move comes after rioting rocked the nation of 700,000 in November. The riots grew from a peaceful protest and highlighted long-simmering regional rivalries, economic problems and concerns about the country’s increasing links with China, after it switched allegiance from the self-ruled island of Taiwan to Beijing three years ago. Rioters set fire to buildings and looted stores.

Solomon Islands Prime Minister Manasseh Sogavare survived a no-confidence vote the following month, telling lawmakers in a fiery 90-minute speech that he’d done nothing wrong and would not bow down to “the forces of evil” or to “Taiwan’s agents.”

The U.S. previously operated an embassy in the Solomons for five years before closing it in 1993. Since then, U.S. diplomats from neighboring Papua New Guinea have been accredited to the Solomons, which has a U.S. consular agency.

The embassy announcement fits with a new Biden administration strategy for the Indo-Pacific that was announced Friday and emphasizes building partnerships with allies in the region as a way to counter China's growing influence and ambitions.

In its notification to Congress, the State Department said China had been “utilizing a familiar pattern of extravagant promises, prospective costly infrastructure loans, and potentially dangerous debt levels,” when engaging with political and business leaders from the Solomon Islands.

“The United States has a strategic interest in enhancing our political, economic, and commercial relationship with Solomon Islands, the largest Pacific Island nation without a U.S. Embassy,” the State Department wrote.

The State Department said it didn't expect to build a new embassy immediately but would at first lease space at an initial set-up cost of $12.4 million. The embassy would be located in the capital, Honiara, and would start small, with two U.S. employees and about five local staff.

The State Department said the Peace Corps was planning to reopen an office in the Solomon Islands and have its volunteers serve there, and that several U.S. agencies were establishing government positions with portfolios in the Solomons.

“The Department needs to be part of this increased U.S. presence, rather than remaining a remote player,” it wrote.

During his visit to Fiji, Blinken met with Acting Prime Minister Aiyaz Sayed-Khaiyum and other Pacific leaders to talk about regional issues, especially the existential risk posed by climate change. It was the first visit by a U.S. secretary of state to Fiji since 1985.

Sayed-Khaiyum said he welcomed the renewed U.S. engagement in the region and President Joe Biden’s move last year to rejoin the Paris Agreement. He said that in the past, Pacific island nations had sometimes felt overlooked by larger nations as “flyover” countries.

Blinken and the Pacific leaders also spoke about the coronavirus pandemic and disaster assistance. But looming over the visit were the increasing tensions in Ukraine.

Blinken visited Fiji after leaving the Australian city of Melbourne, where he had a meeting with his counterparts from Australia, India and Japan. The four nations form the “Quad,” a bloc of Indo-Pacific democracies that was created to counter China’s regional influence.

Former White House adviser and the son-in-law to former President Donald Trump, Jared Kushner, has been nominated for the Nobel Prize due to efforts in leading negotiations on the Abraham Accords.

The nomination, submitted by Long Island GOP Rep. Lee Zeldin, was spurred by Kushner's efforts in organizing a series of groundbreaking normalization agreements between Israel, the United Arab Emirates, Sudan, Morocco, and Bahrain. Over 200 lawmakers sign letter to DECERTIFY the 2020 election and audit all 50 states

Arizona State Sen. Wendy Rogers, who has been a proponent of auditing the 2020 election results across the country, tweeted on Thursday that her nationwide movement is growing.

Following Arizona’s fall 2021 audit that found thousands of voting irregularities, these 204 legislators have argued that if a national audit finds evidence of fraud that could change the results of the 2020 election, then the House of Representatives must be convened to decide how to press forward.

In the letter signed by the hundreds of lawmakers to the American people, they wrote the following:

“We have come to the conclusion that all 50 states need to be forensically audited. Voter rolls should be scrubbed with a canvass of the voters to ensure the future integrity of our elections…We call on each state to decertify its electors where it has been shown the elections were certified prematurely and inaccurately.”

The lawmakers called for definitive action to be taken, such as convening the House of Representatives, if the results of the audit indeed show widespread fraud. The letter continues:

“If it is shown that either Joe Biden would receive fewer than 270 tallied electoral votes, or Donald Trumps would receive more than 270 electoral votes,” the letter reads, “then we call for the US House of Representatives to convene and vote per the US Constitution by means of one vote per state to decide the rightful winner of the election in accordance with the constitutional process of choosing electors.”

Citing the Maricopa County audit results as an example of fraud that could potentially be found nationally, they write, “It has come to our attention from an audit of 2.1 million ballots in Arizona complemented by an in-depth canvas of votes in Arizona, as well as through multiple different data reviews of voting by independent experts; that our representative republic suffered a corrupted 2020 election.”

The Arizona election audit that they are referring to uncovered thousands of irregularities, including duplicate ballots, chain of custody issues, corrupted data files, cybersecurity weaknesses, and unsigned ballot envelopes.

And thus the call for a national audit of the 2020 election results continues to grow.

Special counsel John Durham says he is building a case to show the technology executive with whom an indicted Democratic lawyer on the payroll of Hillary Clinton's campaign was working to build a Trump-Russia collusion narrative gained access to internet traffic at the White House to try and obtain dirt on former President Donald Trump.

Left-wing lawyer Michael Sussmann was indicted last year for allegedly concealing his clients, among them Clinton's 2016 presidential campaign, from the FBI when he volunteered since-debunked claims of a secret back channel between the Trump Organization and Russia’s Alfa Bank. Durham revealed in a Friday court filing that he has evidence that Sussmann’s other client (dubbed “Technology Executive-1” but known to be former Neustar Senior Vice President Rodney Joffe) “exploited” domain name system internet traffic at “a particular health care provider” (which was likely Spectrum Health), Trump Tower, Trump’s Central Park West apartment building, and “the Executive Office of the President of the United States.”

The revelations, made as part of a motion for the Washington, D.C., federal court to look into possible conflicts of interest related to Sussmann’s defense team, gave allies of Trump more reason to believe the former president was spied upon, as evidenced by an upsurge in tweets about the latest salve in the so-called Russiagate scandal.

"They didn’t just spy on Donald Trump’s campaign. They spied on Donald Trump as sitting President of the United States. It was all even worse than we thought," tweeted Mark Meadows, a former congressman who later became Trump's White House chief of staff.

Kash Patel, an intelligence and defense official in the Trump administration and chief "Russigate" investigator under then-House Intelligence Committee Chairman Devin Nunes, said the filing "shows that the Hillary Clinton campaign directly funded and ordered its lawyers at Perkins Coie to orchestrate a criminal enterprise to fabricate a connection between President Trump and Russia."

Durham said that "Internet Company-1" accessed “dedicated servers for the EOP as part of a sensitive arrangement whereby it provided DNS resolution services to the EOP” and that Joffe and his associates “exploited this arrangement by mining the EOP’s DNS traffic and other data for the purpose of gathering derogatory information about Donald Trump.”

Joffe alerted Sussmann about the Alfa Bank claims by July 2016, Durham said last year, and “over the ensuing weeks, and as part of their lawyer-client relationship,” Sussmann and Joffe “engaged in efforts with Campaign Lawyer-1” — identifiable as former Perkins Coie lawyer and Clinton campaign general counsel Marc Elias.

Durham said Friday that Sussmann “provided an updated set of allegations — including the Russian Bank-1 data and additional allegations relating to Trump” to another U.S. government agency dubbed “Agency-2,” which is reportedly the CIA. Durham said the allegations Sussmann passed along during the Feb. 9, 2017, meeting relied partly on “the purported DNS traffic that Tech Executive-1 and others had assembled pertaining to Trump Tower, Donald Trump’s New York City apartment building, the EOP, and the aforementioned healthcare provider.”

Durham's team has charged Sussmann with lying to the FBI when pushing the Alfa Bank claims. Sussmann allegedly told FBI General Counsel James Baker in September 2016 that he was not working for any particular client despite doing the bidding of Clinton’s campaign, billing his services to her, as well as working on behalf of Joffe. Sussmann denies any wrongdoing and has pleaded not guilty. Durham insists Sussmann repeated the lie in 2017.

The special counsel said Friday that Sussmann “provided data which he claimed reflected purportedly suspicious DNS lookups by these entities of internet protocol addresses affiliated with a Russian mobile phone provider” during the February 2017 meeting, and Sussmann “claimed that these lookups demonstrated that Trump and/or his associates were using supposedly rare, Russian-made wireless phones in the vicinity of the White House and other locations.” Durham said this assertion was likely highly misleading or outright false.

“The Special Counsel’s Office has identified no support for these allegations,” he wrote. “Indeed, more complete DNS data that the Special Counsel’s Office obtained from a company that assisted Tech Executive-1 in assembling these allegations reflects that such DNS lookups were far from rare in the United States.”

Durham added: “For example, the more complete data that Tech Executive-1 and his associates gathered — but did not provide to Agency-2 — reflected that between approximately 2014 and 2017, there were a total of more than 3 million lookups of Russian Phone-Provider-1 IP addresses that originated with U.S.-based IP addresses. Fewer than 1,000 of these lookups originated with IP addresses affiliated with Trump Tower. In addition, the more complete data assembled by Tech Executive-1 and his associates reflected that DNS lookups involving the EOP and Russian Phone Provider-1 began at least as early 2014 (i.e., during the Obama administration and years before Trump took office) — another fact which the allegations omitted.”

Durham pointed to the indictment of Sussmann, which alleged beginning in July 2016 Joffe worked with Sussmann, Fusion GPS (which had been hired by Perkins Coie), numerous cyber researchers, and employees at multiple internet companies to put together the Alfa Bank claims. While doing this, Durham said Joffe “exploited his access to non-public and/or proprietary Internet data.” The special counsel said Joffe “also enlisted the assistance of researchers at a U.S.-based university,” Georgia Tech, “who were receiving and analyzing large amounts of Internet data in connection with a pending federal government cybersecurity research contract" — likely from the Defense Advanced Research Projects Agency. Durham said Joffe tasked those researchers to mine internet data to establish “an inference” and “narrative” tying then-candidate Trump to Russia. Durham said Joffe indicated he was doing this to please certain “VIPs” at Perkins Coie and on the Clinton campaign.

The Washington Examiner reached out to an attorney for Joffe for comment.

"Durham states that Sussman and Mark Elias (Perkins Coie) hired the internet executive, Rodney Joffe and his team to establish an ‘inference and narrative’ tying President Trump to Russia," Patel said in his statement on Durham's new filing.

"Durham writes he has evidence showing Joffe and his tech company obtained a 'sensitive arrangement' where they were able to infiltrate White House servers. Per Durham, this arrangement was put in motion in July of 2016, meaning the Hillary Clinton Campaign and her lawyers masterminded the most intricate and coordinated conspiracy against Trump when he was both a candidate and later President of the United States while simultaneously perpetuating the bogus Steele Dossier hoax," Patel added. "Per the pleading, the government will also show that Joffe, at the direction of Sussman/Elias and the Clinton Campaign, exploited proprietary data, to hack Trump Tower and the Eisenhower Executive Office Building (EEOB) to establish a false narrative, which Sussman later relayed to U.S. agencies in the hopes of having them launch investigations of President Trump."

Last month, Durham’s team said it had met with DOJ Inspector General Michael Horowitz in October and followed up with a discovery request for information relevant to its inquiry into the Russia investigation origins. Horowitz provided records, including a report about a "cyber-related matter" that Sussmann brought to the inspector general's attention in early 2017.

The cyber report said Sussmann told an agent in Horowitz’s office that one of Sussmann’s clients claimed a DOJ inspector general employee’s computer was “seen publicly” in “internet traffic” and had connected to a virtual private network in a foreign country.

What Horowitz failed to reveal, according to Durham, was that he personally met with Sussmann in March 2017 to discuss the mysterious report. Durham only learned of that meeting during a Jan. 20 call with Sussmann’s lawyers, according to the filing, and the DOJ watchdog discussed it with Durham's team for the first time the next day after being asked about it. Durham says Sussmann was working on behalf of Joffe related to this "cyber issue."

The Friday filing by Durham asked the presiding judge “to inquire into potential conflicts of interest arising from the representation of the defendant by his current counsel” at the Latham & Watkins law firm, saying the special counsel team discussed this with Sussmann’s lawyers “and believes that any potential conflicts likely could be addressed with a knowing and voluntary waiver by the defendant.” Durham said Sussmann “presently intends to waive any potential conflict of interest.”

The special counsel said “possible that conflicts of interest could arise” from Latham previously representing others in the Durham investigation whose interests may conflict with those of Sussmann. The firm previously represented Sussmann and his prior employer, Perkins Coie, in connection with events Durham said likely will be relevant at trial and that Latham “maintained professional and/or personal relationships with individuals who could be witnesses in these proceedings.”

The Alfa Bank allegations began to emerge publicly in the closing weeks of the 2016 election. On Oct. 31 of that year, former Secretary of State Hillary Clinton tweeted: “Computer scientists have apparently uncovered a covert server linking the Trump Organization to a Russian-based bank.” Clinton also shared a lengthy statement from Clinton campaign adviser Jake Sullivan, now President Joe Biden’s national security adviser, who claimed that "this secret hotline may be the key to unlocking the mystery of Trump’s ties to Russia.”

Horowitz, the DOJ inspector general, said in his December 2019 report on the Russia investigation that the FBI "concluded by early February 2017 that there were no such links” between Alfa Bank and the Trump Organization.

"The latest pleading from Special Counsel Robert Durham provides indisputable evidence that my campaign and presidency were spied on by operatives paid by the Hillary Clinton Campaign in an effort to develop a completely fabricated connection to Russia," Trump said in a statement issued by his Save America PAC on Saturday. "This is a scandal far greater in scope and magnitude than Watergate, and those who were involved in and knew about this spying operation should be subject to criminal prosecution. In a stronger period of time in our country, this crime would have been punishable by death. In addition, reparations should be paid to those in our country who have been damaged by this."

Durham began the investigation in the spring of 2019 at the behest of then-Attorney General William Barr. Under the Biden administration, Durham left his role as the U.S. attorney in Connecticut but was allowed to continue the investigation as special counsel. Roughly $3.8 million was spent across a nearly one-year period ending on Sept. 30 for the special counsel's work.

The so-called "investigation into the investigators" has lasted longer than Robert Mueller's special counsel investigation into alleged ties between the Trump 2016 campaign and Russia, which cost nearly $32 million.

Durham told a federal court in December that he was scrutinizing members of Clinton’s 2016 presidential campaign as part of his criminal inquiry. The special counsel's team asked a judge to “inquire into a potential conflict of interest” related to the lawyers for British ex-spy Christopher Steele’s main anti-Trump dossier source, Igor Danchenko, noting that a separate lawyer at their firm “is currently representing the 2016 ‘Hillary for America’ presidential campaign, as well as multiple former employees of that campaign, in matters before the Special Counsel."

Danchenko, a U.S.-based and Russian-born researcher, was charged with five counts of making false statements to the FBI. Durham’s indictment said Danchenko made these statements about the information he provided to Steele for his now-discredited dossier, which the FBI relied upon when pursuing authority for the secret surveillance of former Trump campaign aide Carter Page. Danchenko has pleaded not guilty.

Horowitz, the DOJ watchdog, concluded in December 2019 that Steele's dossier played a "central and essential" role in the FBI's effort to obtain wiretap orders against Page. The DOJ watchdog determined the FBI’s investigation was filled with serious missteps and errors and concealed potentially exculpatory information from the Foreign Intelligence Surveillance Court. The inspector general also said Danchenko undermined Steele’s claims of a “well-developed conspiracy” between Trump and Russia.

Ex-FBI lawyer Kevin Clinesmith pleaded guilty to editing an email fraudulently to say Page was “not a source” for the CIA and was sentenced to a year of probation.

Durham's endeavor has long been criticized by Democrats and legal observers who claim the inquiry is meant to undercut Mueller's special counsel investigation. Trump and his allies have championed the investigation as a means to root out corrupt officials and settle political scores.

Attorney General Merrick Garland told lawmakers in October that Durham has free rein under his watch.

"We’re now in a new fiscal year, and as everyone knows, Mr. Durham is continuing. So I think you can readily assume that his budget has been approved," Garland said, adding, "We don’t normally make a statement about those things, but since he’s still in action, the provisions of the regulation which require approval of his budget for the next fiscal year are public, so I think … you would know if he weren’t continuing to do his work."

Rodney Joffe is an internet entrepreneur and an internet data expert. He is a recipient of the FBI's Director's Award for Outstanding Cyber Investigation for his role in uncovering the Mariposa botnet. He is also one of a group of four experts, including Michael Sussmann and David Dagon, who were involved in researching possible internet links between The Trump Organization and Alfa-Bank in Russia.[2]

Joffe was born in South Africa to a Jewish family.[3]

Career[edit]

Joffe is credited with creating Genuity (Internet company), the world's first commercial Internet hosting company, as well as UltraDNS, the world's first outsourced, cloud-based DNS company. He is now a fellow at Neustar.[4]

Lawsuit[edit]

In 1988, Joffe's Clinton, Iowa-based firm, Merchandisers Warehouse Inc., was sued by the Attorney General of Iowa for its alleged involvement in a scheme to sell cheap mail-order grandfather clocks at inflated prices to consumers in Iowa. The firm, as well as its Beverly Hills-based parent corporation, Prize Redemption Warehouse, in a settlement agreed to refund $800,000 to more than 10,000 Iowan consumers.[5][6][7][8]

Durham inquiry[edit]

On September 16, 2021, Joffe was pseudonymously referenced as "Tech Executive-1" in the indictment of Perkins Coie attorney, Michael A. Sussmann, and was alleged to have exploited his access to non-public data to conduct opposition research into potential communications between Alfa-Bank and the Trump Organization.[9]

Identity revealed[edit]

On September 15, 2021, Internet researchers successfully extrapolated information from civil litigation brought by Alfa Bank and other open source data to identify Joffe as "Max" from Dexter Filkins' New Yorker articles about Alfa-Bank and The Trump Organization, in addition to being a client of Sussmann.[10][11][12]

Hours later, The New York Times reported Special Counsel John Durham was seeking to indict Sussmann for allegedly falsely telling the FBI general counsel he was not representing a client for the purposes of a meeting they had in September 2016.[13][14]

On September 30, 2021, Joffe was confirmed to be Tech Executive-1.[15][16][17][18]

Lawyers for the Clinton campaign paid a technology company to "infiltrate" servers belonging to Trump Tower, and later the White House, in order to establish an "inference" and "narrative" to bring to government agencies linking Donald Trump to Russia, a filing from Special Counsel John Durham says.

Durham filed a motion on Feb. 11 focused on potential conflicts of interest related to the representation of former Clinton campaign lawyer Michael Sussmann, who has been charged with making a false statement to a federal agent. Sussmann has pleaded not guilty.

The indictment against Sussmann, says he told then-FBI General Counsel James Baker in September 2016, less than two months before the 2016 presidential election, that he was not doing work "for any client" when he requested and held a meeting in which he presented "purported data and 'white papers' that allegedly demonstrated a covert communications channel" between the Trump Organization and Alfa Bank, which has ties to the Kremlin.

But Durham's filing on Feb. 11, in a section titled "Factual Background," reveals that Sussmann "had assembled and conveyed the allegations to the FBI on behalf of at least two specific clients, including a technology executive (Tech Executive 1) at a U.S.-based internet company (Internet Company 1) and the Clinton campaign."

Durham’s filing said Sussmann’s "billing records reflect" that he "repeatedly billed the Clinton Campaign for his work on the Russian Bank-1 allegations."

The filing revealed that Sussmann and the Tech Executive had met and communicated with another law partner, who was serving as General Counsel to the Clinton campaign. Sources told Fox News that lawyer is Marc Elias, who worked at the law firm Perkins Coie.

Durham's filing states that in July 2016, the tech executive worked with Sussmann, a U.S. investigative firm retained by Law Firm 1 on behalf of the Clinton campaign, numerous cyber researchers and employees at multiple internet companies to "assemble the purported data and white papers."

"In connection with these efforts, Tech Executive-1 exploited his access to non-public and/or proprietary Internet data," the filing states. "Tech Executive-1 also enlisted the assistance of researchers at a U.S.-based university who were receiving and analyzing large amounts of Internet data in connection with a pending federal government cybersecurity research contract."

Durham also writes that during Sussmann's trial, the government will establish that among the Internet data Tech Executive-1 and his associates exploited was domain name system (DNS) internet traffic pertaining to "(i) a particular healthcare provider, (ii) Trump Tower, (iii) Donald Trump's Central Park West apartment building, and (iv) the Executive Office of the President of the United States (EOP)."

Durham states that the internet company that Tech Executive-1 worked for "had come to access and maintain dedicated servers" for the Executive Office of the President as "part of a sensitive arrangement whereby it provided DNS resolution services to the EOP."

"Tech Executive-1 and his associates exploited this arrangement by mining the EOP's DNS traffic and other data for the purpose of gathering derogatory information about Donald Trump," Durham states.

The filing also reveals that Sussmann provided "an updated set of allegations" including the Russian bank data, and additional allegations relating to Trump "to a second agency of the U.S. government" in 2017.

Durham says the allegations "relied, in part, on the purported DNS traffic" that Tech Executive-1 and others "had assembled pertaining to Trump Tower, Donald Trump's New York City apartment building, the EOP, and the aforementioned healthcare provider."

In Sussmann's meeting with the second U.S. government agency, Durham says he "provided data which he claimed reflected purportedly suspicious DNS lookups by these entities of internet protocol (IP) addresses affiliated with a Russian mobile phone provider," and claimed that the lookups "demonstrated Trump and/or his associates were using supposedly rare, Russian-made wireless phones in the vicinity of the White House and other locations."

DURHAM TARGETS CLINTON CAMPAIGN LAW FIRM IN FRESH ROUND OF SUBPOENAS

"In his meeting with Agency-2 employees, the defendant also made a substantially similar false statement as he made to the FBI General Counsel," Durham wrote. "In particular, the defendant asserted that he was not representing a particular client in conveying the above allegations."

"In truth and in fact, the defendant was representing Tech Executive-1–a fact the defendant subsequently acknowledged under oath in December 2017 testimony before Congress, without identifying the client by name," Durham wrote.

Former President Trump reacted to the filing on Saturday evening, saying Durham’s filing "provides indisputable evidence that my campaign and presidency were spied on by operatives paid by the Hillary Clinton Campaign in an effort to develop a completely fabricated connection to Russia."

"This is a scandal far greater in scope and magnitude than Watergate and those who were involved in and knew about this spying operation should be subject to criminal prosecution," Trump said. "In a stronger period of time in our country, this crime would have been punishable by death."

Former chief investigator of the Trump-Russia probe for the House Intelligence Committee under then-Rep. Devin Nunes, R-Calif., Kash Patel, said the filing "definitively shows that the Hillary Clinton campaign directly funded and ordered its lawyers at Perkins Coie to orchestrate a criminal enterprise to fabricate a connection between President Trump and Russia."

"Per Durham, this arrangement was put in motion in July of 2016, meaning the Hillary Clinton campaign and her lawyers masterminded the most intricate and coordinated conspiracy against Trump when he was both a candidate and later President of the United States while simultaneously perpetuating the bogus Steele Dossier hoax," Patel told Fox News, adding that the lawyers worked to "infiltrate" Trump Tower and White House servers.

The anti-Trump dossier, authored by ex-British intelligence officer Christopher Steele, commissioned by opposition research firm Fusion GPS, was funded by the Democratic National Committee and Hillary Clinton's campaign through Elia's law firm, Perkins Coie.

Patel added that Sussmann relayed the "false narrative" to U.S. government agencies "in the hopes of having them launch investigations of President Trump."

Sussmann's indictment is the second prosecution to come out of Durham's probe.

In 2020, Durham charged former FBI lawyer Kevin Clinesmith with making a false statement – the first criminal case arising from his probe. Clinesmith was referred for potential prosecution by the Justice Department's inspector general's office, which conducted its own review of the Russia investigation.

Specifically, the inspector general accused Clinesmith, though not by name, of altering an email about Page to say that he was "not a source" for another government agency. Page has said he was a source for the CIA. The DOJ relied on that assertion as it submitted a third and final renewal application in 2017 to eavesdrop on Trump campaign aide Carter Page under the Foreign Intelligence Surveillance Act (FISA).

Former Attorney General Bill Barr appointed Durham, then the U.S. attorney from Connecticut, in 2019 to investigate the origins of the FBI’s original Russia probe, or Crossfire Hurricane, which began in July 2016, through the appointment of Special Counsel Robert Mueller in May 2017 shortly after Mueller completed his years long investigation into whether Trump's campaign colluded or coordinated with the Russians to influence the 2016 presidential election.

Mueller's investigation found no evidence of illegal or criminal coordination between Trump or the Trump campaign and Russia in 2016.

Barr, in December 2020, before leaving the Trump administration, tapped Durham as special counsel to continue his investigation through the Biden administration.
