They may have asked for a continuance. Not sure how MASS court recording works and whether that goes on the record up there or not. If they did get a continuance it could be a bit.

If not, ZQ didn't have to be there for her lawyers to respond. Most of the time they can call their client and ask them stuff, and the only time the client really needs to come in is either for court dates, dispositions, or if there is something the lawyer needs in person or needs to tell them face to face.

Heck, I've assisted attorneys on cases we've settled where we never saw the client after the initial meeting because they provided us with all the info and stuff there and we handled the rest.

Basically Zoe could be at XOXOfest and her attorneys can still do their job and file briefs, motions, etc. Her presence is not required for every moment related to this case.

WL only added the amicus brief from last month, and it is basically just two alleged published professors claiming the gag order violated Gjoni's first amendment right and allowing it to stand sets a dangerous precedent since it was too broad and vague.

Yes, court opinions are usually public record, I don't think every single document in the interrim that I have access to right now is. I want to make sure these can be shared, and all the motions, briefs, etc are covered. When I say this, it is because I got access via WestLaw to this stuff. Now, if you want to do it yourself, keep in mind case databases can charge either per click or by the minute (at least they used to, it might have changed). Costs rack up if you don't know what you are looking for and to find it.

Also, keep in mind once again last I checked Quinn's attorneys' response was not up yet.

I did read Gjoni's attorney's brief for the appellete level. He may have a point in challenging the fact that he was denied the right to cross Quinn on the witness stand. However, in talking with an attorney who has tried and seen a number of cases over the years and teaches classes on trial procedure, I learned you can forfeit the right to cross examine if the witness has been intimidated, threatened, or harassed by the client (there is more to it, but look up forfeiture by wrongdoing). I think her attorneys may make that claim in appeal, but if Gjoni's lawyer can prove that Gjoni did not do any of that to Quinn, this may go in his favor.

But anyways, I'm sorry I want to keep my ass covered and I don't wish to play it fast and loose with my career like Cernovich does.

The basic case, from a district court, is the one he lost.

Normally on appeal it goes up to the appeals court. This is what's happening now.

What he wanted to do was to skip the above level and go straight to the MA's Supreme Court. They denied the special exemption he wanted. Had he have gotten it, the decision would've been binding on the whole state, as opposed to whatever jurisdictions are covered from a lower ranking court.

That's all it means. State Supreme Courts don't accept too many cases to begin with (and the federal Supreme Court even less) so it's not a big shocker, though still disappointing.

But here's the thing… if his appeal would have been found to have no merit it would have died on its own without Zoe having to do a goddamned thing. If I was Zoe and believed the gag order I issued against Gjoni had strong legs to stand on I wouldn't be worried about what I'd see as futile appeals and wouldn't ever bother with them. Considering the fact that Volokh decided to come to Eron's side though it would seem more likely that the gag order against Gjoni is totally unconstituional and against the first amendment.

If you're trying to be taken seriously, try not to indulge in obvious hagiography. Most people in the world don't know who Zoe Quinn is. More importantly, most people in the United Sates and Canada (the countries to which Quinn has the strongest ties to by being a citizen of the former and an expatriate in the latter) don't know who Zoe Quinn is. Those of them who do know Quinn and are sympathetic to her cause see her as a victim, but I seriously doubt the majority of them view her as a "a champion of human rights".

The appeals court basically bitchslapped Zoe and bitchslapped her HARD and not only got the original gag order dropped but basically said that she abused and manipulated the court system through lies to get said court order. Furthermore, Zoe's attempts to further lie in court (literally, as soon as the court told her they were voiding the gag order, Zoe tried to refile it in another state and got BTFO and forced to drop it)

Eron already won the victory but he and his lawyers are now pushing it up so that legal precedence is established that makes it impossible for Zoe or ANYONE ELSE to do what Zoe did to Eron.

Zoe and her lawyers are now in full fucking stall mode, to delay the inevitable day of judgement, when Zoe's name is forever linked in the world of law as a villain engaging in spousal abuse gaslighting. She tried to make Eron drop taking it to the higher court (which would have saved her this permanent infamy) by offering to drop the restraining order, when she realized she was going to get BTFO. But Eron refused and is intending to go full tilt in making Zoe pay for her crimes.

Zoe recently had her new fancy team of lawyers block Eron from getting the case expedited to the MA supreme court for final judgement, meaning that she's added a couple of extra steps in the process to basically stall for further time and hope to bankrupt Eron
