据现代快报,江苏南通一公司员工在上班时因长时间停留在卫生间里,被公司发现后解雇。该员工不服,起诉并要求公司支付违法解除赔偿金20万元。近日,当地法院审理查明,根据公司内部视频统计,该员工于2023年2月2日至2月23日期间长时间停留公司卫生间11次,日停留时间最短1小时22分钟,最长6小时21分钟。

法院经审理认为,正常去卫生间应是即去即回,短暂停留卫生间行为不构成擅离岗位。但该员工停留卫生间时间过长,已明显超出合理正常的生理需求范围,亦明显超出其岗位职责范畴所需;根据公司的规章制度,该员工累计视为旷工天数达到6天,公司有权依据其规章制度解除与该员工的劳动关系。最终未支持该员工的诉讼请求。
