America's internet copyright laws are fucked because DMCA is shoot first, ask questions later. It was only tolerable because our Fair Use laws were so lax and forgiving. All IP law is illegitimate and bad for an economy. IP law requires violating private property rights by the threat of violence and comes at the cost of the consumer.
People try to justify this with "needing to protect the creative." However, the way I see it, there are only 2 types of creativity that are actually legitimate and beneficial to an economy. IP law is counter to both of those.
The first type of creativity is business innovation. Business innovation is a cost-cutting innovation, like a new technology or a more efficient method of work (e.g. fast food restaurants requiring multiple low-skill employees rather than one high-skill chef). On paper, it sounds good to doubly reward innovators which cut cost in business, but in reality people do not need IP law to reward them for making their business more efficient. The business owner is already rewarded by having their costs cut. In the same way you do not need government reimbursement (or some other form of economic intervention) to motivate home improvement, the business owner doesn't need a special law to motivate him to innovate. And what would IP law even do? Make an innovation exclusive to its creator, because all this does is require extra tax money to enforce and publicly store IP innovations, lock all competitors out of using said innovation (usually for a cost) which means products are less cheap than they could be and can lead to the creation of monopolies.
The other form of innovation is artistic. However, not only is art's contribution to the economy arguable at best, true art does not come from an urge to make profit, which is the goal of IP law. If you have an artist simply with the goal of profit through IP, you do not have an artist, you have a patent troll.
