Yeah, but even if you implement DRM, it'll get cracked eventually. And the devs that would upload on piratebay and co. are going to be smaller teams, not megacorporations. So they may not even have access to potentially costly DRM deals and there's no way they'll be able to develop their own DRM scheme and justify the additional dev cost of doing so. So, since people are going to pirate anyways, why not have a little banter with the pirates and generate some free word-of-mouth advertisements from all the, "ha, did you know the game/devs fucks with you if you pirate it?"

The purpose of DRM (from a company's standpoint) is to get people who are on the fence about pirating to buy their game. Using my ass as a source, let's say that 90% of a game's sales during the first year are within a month of release. If you're the company, you'd want to delay or trip up pirates as much as possible to convert as many potential pirates into sales during that time. Then, you get another surge of sales a year or two later when you permanently drop the price.
If you don't use DRM, then you're missing out on potential sales. Of course, in an ideal world, devs would be honest, and also not treat games as a cheap commodity, rather than passion projects, but here we are surrounded by Jews

Didn't Spyro feature a fairly elaborate anti-piracy mechanic meant to fool crackers and flood the "market" with defective copies? From what I recall, the devs built in a system to detect if the copy being played was legitimate or not, and for the first few hours the game plays fine, but the further in you go the more broken the game gets, until it becomes completely unplayable/unbeatable.
This is more social engineering than clever mechanic since they preyed upon the competitiveness of cracking groups to be the first to deliver a cracked copy of the game, not bothering to look too deeply into the game code.

Can you stop arguing the merits of piracy vs. buyacy and just talk about what is in the OP? There's that one "game dev sim" I forget the name, but pirated copies eventually make the game extremely difficult to reflect the fact everyone in-game isn't paying for what you're making. People liked this enough that it got added as an optional difficulty. There's a DS Michael Jackson game that adds vuvuzela sounds to the music if detected to be illegitimate.
Also while this is anti-emulation and more of technical interest, some of these techniques do apply against game copiers.
