Those circumstances screwed him badly. Not only did a special needs child take his lunch, but the child had a stand. You learn at the end of the series that in cases where he legitimately gets screwed over by circumstance his go to solution is to just rewind time.
To do this he needs to blab his identity and secrets to a person to activate bites the dust, but it won't activate with stand users. In a single moment to avoid the issue he created a circumstance where he absolutely needed to kill the person.
This screwed him, but truthfully he could have just left town for a few months and gotten away with it. Never forget writing screws over villains more so than fate.
