The chinks that own PUBG have lost EVERY SINGLE lawsuit they pushed against PUBG clones. Paul and Fred just dropped their lawsuit against Stardock because they finally accepted it was impossible to win. Everyone acts like an angry gung-ho cunt when it comes to trying to keep people from copying them, but the overwhelming majority of cases are just tossed or ignored. He would have had to straight up continue using Mario assets in order to actually get caught up in real trouble. Companies like Nintendo or Disney actually love (and perpetuate) the idea that you could be sued for petty things that aren't actually true when it comes to copyright law.
What it boils down to is that Nintendo made some threats against a guy. The guy complied. They followed up with more threats. The guy legitimately believed he would be stuck in an expensive legal battle over the game. He crumpled.
