He points out that these events did not happen only once, but were regular affairs. Thus showing that the majority was wrong in thinking that public acts of sex are always regarded as shameful. This has not been true in the justices' own country throughout history and, certainly, cannot be assumed to be the truth throughout all cultures and time. He then cites Judge Hand from the United States Supreme Court as support when he said, "it is unthinkable that, in actual practice, the sense of shame should forever bar expression of the most beautiful and important aspect of human nature."

However, what changed in this case was the Court's opinion regarding the weight of artistic value in the determination of whether a material is obscene. The Court, in this case, stated that artistic value could potentially absolve a material from the label of obscenity though it did not in the present case. Instead of a few pieces of obscene materials rendering an entire work obscene as in Lady Chatterley, the overall artistic value of the work, outside of the obscene parts, could absolve an entire work from the charge of obscenity. This is clearly in conflict with what the Supreme Court intended in the Lady Chatterley case.

His denials of authorship may have been because he sought to escape being accused of violating Article 175 and forced to stand trial. It is important to note that the work was found to be obscene and publisher of the 1948 publication was found guilty of violating Article 175 in 1950 at the district court level. This was just two years after Kafu's most explicit denial of authorship, though the trial did little to address the provisions of Article 175. Clearly, Kafu was smart to deny writing the sexually explicit version of the story if he was denying authorship simply to avoid being arrested. The accused in this trial were, "author Nosaka Aikuyuki and publisher Sato Yoshino who had republished the story in a humorous literary journal Omoshiro hanbun (Half serious) in 1972." Both were owners of the magazine publication. The prosecution did its best to separate Kafu from the piece and condemn the accused of republishing old pornography, so as to avoid attacking the credibility of a celebrated national author. The defense did its best to link Kafu to the story and to make it seem that the accused were only reprinting a work of both nationalistic and literary value to Japanese culture. The trial was during the time of a resurgence of nationalism in Japan. Thus, the Supreme Court was cornered because, if it found the accused guilty, they were potentially finding Kafu guilty of obscenity. Doing this would be seen as unpatriotic and highly criticized by the public.

Instead of the simple objective standard based solely on the words of the text, as previously used by the courts, this Court defined obscenity in terms of its effects on the minds of the readers by considering the entire effect of the main piece in combination with outside accompanying materials. Pink-eiga films are pornography films that are typically low-budget, are at least an hour long, and attempt to observe the obscenity laws of Japan by using props, mosaics, and other means to hide the forbidden images during sexual intercourse scenes. Though it was the first film to be accused of obscenity, its charge never reached the courts because the director consented to editing of the film and it was released without the "obscene" parts. It is important, however, in that it shows the beginning of films being accused of violating Article 175 and that by censoring, a film may exonerate itself from an obscenity accusation.

This case proceeded De Sade and provides some basis for the later decision where the Court stated that the artistic value of a book might absolve a book from being declared completely obscene.

Lastly, he argued that the ban was obsolete simply because there is a copy of the book in the collection of the National Diet Library. Under pressure from the Tokyo Metropolitan Police, Asai suspended sales of the book in 2000. In 2003, he won his case in the District Court and was awarded his confiscated book and a damage award of 700,000 yen, which equates to approximately $7,000 United States Dollars (USD). The District Court found that the only reason to ban an obscene material is if it harms public morals. The Court did not see how the Mapplethorpe collection harmed the public and deemed it safe to publish. The Court also ruled that the customs authorities had to return the book. The Court reasoned that Asai was not breaking any laws by bringing the book back into Japan. Bringing the book into the country did not alter the fact that 900 copies had already been sold in the country. As such, it was not a threat to public morals. Asai correctly noted that this judgment, "broke the direct link between obscene material and material hat harms public morals." The two can exist independently of each other. Essentially, as Asai phrased it, "The ruling means that art can be obscene."

>In a way, manga authors have the most rules to abide by when writing and illustrating their comics. Manga has existed in its current form since shortly after World War II, though it has existed in other forms since ancient times. However, it was not until 2002 that a manga came before the courts for the charge of obscenity. In April 2002, the manga Misshitsu (Honey Room) was accused of being obscene. Both the editor, Motonori Kishi, and the author, Beauty Hair, were arrested and charged. The manga depicted rape, sadomasochism, and genitalia. Initially, Kishi was sentenced to one-year imprisonment and a fine of 1.5 million yen, approximately $15,000 USD. The sentence was later deemed, "too severe" by the Supreme Court and the court abandoned the prison sentence but left the fine intact. Kishi was still found guilty of the crime of obscenity. The artist was sentenced with a 500,000 yen fine. The trial caused a great deal of controversy publicly because it was only one of many graphic mangas in publication. Mangas such as Resident Female Cat and Young Jump depict content as extreme as a young college student being raped nightly by cats to the night-life of a dominatrix secretary. Kishi expressed the confusion of the public during an interview when he said, "I did not understand why only our publication was questioned when other publishers have issued unexpurgated sexual comics." There, initially, seemed to be no basis for having Misshitsu singled out and charged. The difference seems to lie in the fact that Misshitsu was published with genitalia drawn in but not sufficiently censored out and the manga was not sold wrapped in plastic with the Restricted-18 label affixed to it, as is the custom for adult-oriented manga in Japan. The High Court said, that the manga was, "unnecessarily sexually stimulating, damages the normal sexual sense of shame of ordinary people, or is against good sexual moral principles."

This is important for two reasons. The first is that the ruling makes it illegal to link to pornographic websites from a Japanese website since it aides and abets the distribution of obscene materials. The Court did not explicitly say that it was the combination of the program plus the links. It merely ruled that the presence of the links were a part of the aiding and abetting piece of the crime. Second, this ruling extends the reach of the obscenity law and increases the likelihood of creators in the digital realm to be found guilty of under Article 175. What is most important to about the Osaka District Court's ruling is that the Supreme Court did not overrule it, but also did not find Kiuchi guilty for the same reasons. The Court did not address the links on Kiuchi's websites or, even, the mere existence of his website. This means that linking could potentially be a cause for arrest and trial in the future. In the Supreme Court ruling the Court addressed the existence of pornographic materials on hard disks and defined what is meant by the words "public display" in relation to computers. The Court viewed the facts as they related to the ease by which users could access the materials on Kiuchi's hard disks without addressing the fact that a user accessed Kiuchi's hard disks via his website. The Court, "deemed that having digital copies of pornographic materials (photos) on a hard disk drive is in violation of the obscenity article." In fact, the Court stated that the hard disk of the host computer should be considered the obscene material because that is where the defendant recorded and stored the obscene visual data. The Court then defined "public display" as, "placement of the material in a manner whereby the obscene contents can be seen by many and unspecified persons." The Court continued by stating that "public display" does not specifically mean that it is in an area where another person can view it immediately and without any special intervening action. Rather, it refers specifically to the simplicity of the actions needing to be performed by another to view the material. In this case, the actions making it so that others could access the defendant's hard drive were typical and simple actions for computer users and, thus, the material was on "public display."

With the increasing usage of electronic storage devices and the internet, guidelines for these questions could save many a Japanese citizens from inadvertently violating, and being arrested for violating, Article 175.

In February 1998, the Fukuoka Prefecture Police went to the Bekkoame building in Tokyo and seized a large quantity of pornographic related data from the company. Included in the data confiscated were lists of Bekkoame's customers. The Supreme Court ruled that the confiscated list of customers was not a valid seizure. TL;DR
Japan's rule on what is and isn't allowed in terms of porn is up to whatever mood the government is in.
