You should have wrote that this about "large capacity magazines". How long until califags can buy those baby-killin' assault clips?

i am not a lawyer and this is not legal advice, but my understanding of this ruling is that the law is immediately unenforceable since it was never constitutional to begin with. expect this decision to be appealed extremely quickly as CA seeks to prevent people from acquiring more mags as long as possible

fd0be1  No.662692

Unfortunately this isn't blocking a magazine ban. This is blocking a confiscation of grandfathered mags. The NRA won a takings clause case and is avoiding mentioning that to give the appearance of having done something vaguely hard.

File: 21d635d9cd5150e⋯.jpg (43.89 KB, 660x381, 220:127, Belt fed AR.jpg)

>Magazine capacity limits

Would these still apply to a weapon that didn't use a magazine of any type?

a3183d  No.662784

>>662773

Imagine a rifle that accepted boxes of loose ammunition in a feed hopper.

Would the box of ammunition then be a high capacity magazine?

There is a reason why natural rights were so broadly defined in the bill of rights.

a2a3e2  No.662790

>>662773

My understanding is that you cannot link 11 or more rounds on one belt. So basically New York's "only 7 rounds, okay?" unenforceable bullshit and yes it was touched by the ban.

>>662692

I don't know about that but 32310 seems like THE bullshit. The penal code prohibits the sale, manufacture, importation, giving, lending, receiving, and possessing high caps.

This site seems to cut down the legalese bullshit

https://www.shouselaw.com/large-capacity-magazines

>>662784

Any ammo feeding device with "high" capacity is illegal regardless of it being an actual mag or not technically you could own a gatling gun the big brass shit but the hopper would either be cut down or left up to you being a good boy. Only issue would be about the trigger and if it fired more than once per turn.

a2a3e2  No.662791

>>662790

Fucked up and forgot to mention that tube fed rifle mags are sort of exempt. Marlin model 60 for example is okay in California.

106549  No.662793

From what I'm hearing some gun sites are now shipping 30+ round mags into california right this second, at least until some new legal motion occurs. Better get it while you can.

20b8a2  No.662796

>>662670

Big heads up for Californians, many online retailers are legally able to sell 30 round magazines to California today because of this ruling, so go ahead and pick up as many as you can from the website that will do so. A few examples of websites that are selling to California are preppergunshop, justicearms, armsunlimited, and skidtactical

3bfacf  No.662802

>>662796

Honestly, people should just start ignoring the law and buying mags accross state lines. Same with salt weapon accessories and tracer/AP ammo.

11379d  No.662806

>>662802

Jestice arms is a favorite for many since they make compliant mags in ways that makes it easy to unfuck with just a drill for rivets or a pot of hot water for epoxy. Only issue is the hole in your mag that may let dirt in, but still you can get real(ish) mags delivered to your door without having to make a trip which will only increase since the ammo BG checks are coming in july.

106549  No.662807

>>662802

It certainly makes it easier to say "but officer, I bought these mags during the exemption period and they were grandfathered in", when the exemption period was six months ago instead of however many years.

6c9fb5  No.662808

>>662802

Anyone with 2 brain cells to rub together can tell you this was already happening; this means that, as far as magazines go, no one can stop it.

The first thing I thought of reading that was vid related. It could, potentially, even be UK legal - as to the best of my knowledge all UK legal definitions of what does and does not constitute a 'firearm' involves the pressure bearing components, and as this doesn't use any kind of propellant there's no pressure involved. obviously it would have some specific amendment passed to ban it by name, but a man can dream

>>662790

>Any ammo feeding device with "high" capacity is illegal regardless of it being an actual mag or not

What if you were using something like this vid, where ammo was just dumped into a hole in the weapon by the user - would you be limited to storage containers (which are completely that could only hold X rounds?

974751  No.662872

>>662670

if the Judge's ruling was "OK, I guess 10rds ain't enough for lawful use/ownership due to legit need for self defense, etc" then why and how could where and when the mags were bought matter?

So people that happened to have bought some item in 1990 have a right to defend themselves but not people who bought or wish to buy in 2019?

Well some more news from yesterday and today, the CA DOJ filed an appeal for a stay on Judge Benitez' ruling so that way they can cry to their faggot butt buddies on the 9th Circuit but the appeal has yet to be granted, and today, both plaintiffs and defendants filed notices regarding their take on yesterday's appeal. Here's to hoping Becerra gets told to go pound sand and fuck a cactus.

As an Irishman, I have to ask why there's such controversy about what is and isn't "constitutional" when it comes to firearms.

The second amendment is literally 27 words long, how is there any wiggle room?

FDR's pet Klansman and some other judges he appointed ran a show trial called US v. Miller. There the Judge was Heartsill Ragon, a former congressman who wrote the law being challenged, and he didn't allow the defendant to choose his lawyer or plea (even the slightest hint of either is supposed to get a case thrown out). The lawyer forced on the defendant appealed to the supreme court before dropping him as a client (illegal now and likely then) and the defendant was murdered before the Supreme Court heard the case.

Now this uncontested case is used as "precedent" that lower courts are supposedly forced to follow. FDR has a horrible bastard.

7f30ac  No.664249

In the future we will also pass legislation regulating the number of weapons each individual can own. Ideally in the future we would like to have a society where each individual can only owe a few firearms, and only certain types of firearms (like handguns, shotguns, and some rifles).

We will pass these laws democratically and you will have to either accept our democratic process or become a lawbreaker, in which case we have the right to use the security forces of the state to bring you in line with the law.

Cry or whine as much as you like, this is what will happen.

(Ironic shitposting is still shitposting)

HEADS UP FAGGOTS

You have until 5:00 pm today to order/buy mags. gunmagwarehouse has stopped all sales to CA but whatever was on order is still going through and will likely make it in time. Other sellers will likely follow gunmag. Palmetto is still taking orders for mags until 3:00 pm. Get them while you can.

because, like rest of Bill Of Rights that was tacked on to fool the unwashed masses, it was deliberately FUBAR.

Its a sentence with TWO SUBJECTS and would not pass 4th grade class of 9yr olds.

Legit, unbias scholars will say "we can't say WTF it says".

Funny, you think if they were honest they'd write it so ANYONE would easily know for sure exactly what it meant. Real contracts between honest people are like that. As are "club rules" etc.

"The Constitution is a LIVING DOCUMENT" FUCK YOU!

It like when divorce lawyers size up their clients and keep cumming up with reasons why the Divorce never seems to quite become "done", even if both clients want it done.
