Some places you can drop the charges and that'll be it but if its the cops prosecuting him the best you can do is turn up for court and say you exaggerated or only spoke to the cops in the heat of the moment.

It's a shitty scenario if he didn't hit you, and for whatever reason you said he did, because now the situation is out of your hands. The assumption in DV cases is that the victim is going to go back on their testimony. I'd say it's unlikely that the prosecutor will drop the charges.

If he actually didn't hit you, now what you need is a good DV lawyer and not a public defender. If he's good, he'll get a dismissal. But now you're spending money you probably don't have because you had a stupid argument. More strain on your relationship. Go to a counselor if you've fought before the police got involved.

If he actually did hit you, please don't be abused. Don't put up with that shit, please, for your own sake. Let him rot, and end it. Get a restraining order if need be, in the US there's many case workers for this sort of thing to help take the burden of the process off of you.

Since you've already given a statement, are there pictures? Do they have any other evidence of physical abuse? A history?

He won't be convicted at the arraignment. You still have a bit of time. You'll probably want a good DV attorney for him to do the negotiations if you gave really shitty statements and said some blemish or something was evidence of abuse. Not having your attorney at the arraignment isn't that big of a deal, it's where he can get his public defender.

they're sorta blowing smoke up your ass. you can press charges if you want to - resulting in a civil lawsuit(?), or you can choose not to press charges. if the local PD or state attorney decide there's enough of a case there, the state can press charges against him regardless of your wishes - a criminal lawsuit(?).

if he didn't do it, then he can plead not guilty and the evidence would hopefully be insufficient to convict him of anything. but the fact that he's at an arraignment, assuming you didn't press charges, means the state/local district is prosecuting him. if you don't want to see him prosecuted, just tell the court you made it up. you could be charged for falsifying a police report, but you'd probably also get a pussy pass and receive no punishment from it.

And if the prosecutor is gunning for his ass it doesn't matter, it's an abuse case. It all depends on the evidence and what sort of statements she gave, and whether they have physical evidence, so it's a shot in the dark.

Hence: a good DV lawyer for advice if she's not going to be totally forthcoming about the entire scenario. You could try to tell the prosecutor to drop it, but I doubt they will. Worth a shot.
