I read through the deposition and it appears that they were already having trouble with Meyer's conduct before Waid's call, which is made clear in the internal company emails submitted for evidence. Meyer's infodump on the five retailers planning to boycott his book is what caused the trouble that led to Antarctic dropping him.

What's really interesting is reading how Meyer kinda fucked Antarctic with the info dump. Meyer convinced a retailer to fill him in on what some retailers were going to do, promising not to rat them out. Then he proceeds to rat them out, leaving the retailers thinking it was Antarctic who dropped a dime on them.

Also, emails prove that Antarctic lied when they claimed they didn't know about Meyer's actions. They knew what he did the night of and tried to play dumb. It was only after AP Editor-in-Chief Jochen Weltjens got a first-hand look at how bad things were going on the retail end did AP's attitude change. Apparently, his request to have his name be taken off the book and his strong advise to Publisher Joeming Dunn to drop Meyer over his behavior is what finally got Jawbreakers canned.

First, Meyer's lawyers haven't proven "willful or intentional act of interference". AP's own internal emails state that Waid called to warn them about Meyer and AP claimed ignorance, despite the emails showing they knew full well what was going on, what kind of person Meyer was, and were trying to ignore it in hopes it would go away. Those emails also clearly state that Waid told them that he didn't want to tell them what to do. There's a strong case here that Waid was operating in "Good Faith".

Second, they haven't proven that "The defendant’s act was the proximate cause of some injury to the plaintiff", as other emails show they were feeling pressure before Waid's call, and it can be argued that AP dropped the book following their Editor-in-Chief's advice.

So the evidence of "willful act of interference" and that Waid was "the proximate cause" is kinda tenuous. That's 1/2 of the elements necessary to claim Tortious Interference in the state of Texas. I can say, from just a low-level, google-search understanding of Texas tort law, that they're probably no where close to pursing a settlement.

Look up "Good Faith" as it concerns TI in Texas. Everything presented so far, including the emails and Waid's concern that he "bullied them", shows that even if it's proven that Waid was the proximite cause, Waid did not intentionally interfere with Meyer's contract and was operating in "Good Faith".

The case isn't as solid as you've been led to believe.

Does he ever explain how Meyer's going to prove Waid's actions were intentional? Or how Waid's call carried more weight at AP than their own Editor-in-Chief or the retailers? That's the stuff that stuck out to me and those seem like important hurdles to jump.

Read the texts and deposition again. Waid thought he was talking to Ben Dunn when in reality he was talking to Ben Dunn's brother Joeming. Joeming thought he was talking to someone else, hence Waid's confusion and "Ben's" lack of replies.

As for the death threats, remember we've only received plantiff's questioning of the witnesses and the evidence relevant to that. I noticed it when going through the court documents that the release stopped right before it was defendent's turn.

However, if you argue that's a threat through it's implication, then Meyer was even more blatant when he posted the names of those employees. It would potentially open Meyer up to harassment lawsuits.

Of course, that's relies on the arguer relying on logic and not having some double standard like "Waid's implications were worse because he's got comic professional privilege" or some shit like that.

That doesn’t answer why Waid didn’t simply call AP again and why he texted them instead and asked them to say whether or not he was bullying them. If he genuinely cared about Dunn’s feelings then he would’ve just called again, a faster and more reliable way to get a response generally. The other Dunn also notably keeps a neutral response to his texts, stating he doesn’t want to make any statements that might lead to something else

And before you say so, it is not collusion to collectively decide not to publish something however it IS collusion to decide not only to not publish something but also to slander or threaten to slander those who choose to publish said something.
