They're not making exceptions for modifications that do not impact the games themselves, like repairs (replacing capacitors, optical drives), cosmetic stuff like changing the color of the power LED, or even external shit like replacing or even simply painting the casing. If they want to waste their time making laws that aren't even remotely enforceable, it's their problem. Making ineffective laws can even serve to dissuade stricter, more solidly enforceable laws.
As an example, you have France's hadopi. Basically it was meant to filter any and all downloads and automatically force an ISP to ban the user after three strikes. The problem was that it didn't track torrents, only shit like eMule. It cost a huge amount of cash, came out to a patently ridiculous PR campaign that was a laughingstock for months, and was clearly a huge waste of time and money for no results whatsoever. It was a fusion of what Japan had to begin with and what was brought over by Chinese Buddhists about 1400 years ago, and that was mostly it since due to the crazy stormy waters between Japan and Asia there wasn't a ton of interaction for a long time, so after that it kind of went in it's own Japanese direction.
