Ive been playing Okami HD for the past 3 hours and I have been having a great time with it, although my left thumbstick has been getting kinda fucky recently by making me move the the left occasionally, its not that much of a big deal.
Also to save you the trouble of freaking out just in case if you dont know where your .nsp files ended up, whenever you download the .NSP files they always end up inside the _NSPOUT file in your CDNSP folder.

You can always install AutoRCM so external devices aren't necessary but you'll then need to rely on an SD Cars to even get into SysNAND

The battery goes out of calibration because only the firmware itself was keeping track of battery charge levels and the longer your Switch sat in RCM mode the more out of sync it got, but IIRC that's since been fixed and there are numerous solutions to fix that online already

When Nintendo detects a console reporting data in a nonstandard way it tends to get banned a week or two later taking the Valve approach of not letting people know what banned them so easily
The problem with the Switch is when you get banned for piracy/fake certs they will ban you from the CDN as well which, in all likelihood, will be how Capcom distributes quest data this time around.
When you get banned from the CDN you can't download anything through Nintendo. Games, game updates, DLC, System updates, etc.
Most of that isn't really a big deal because nobody gives a shit about their inability to fix exploits on banned consoles and DLC is gay.
The issue arises when they have day one patches that include a good portion of the game, for example the Spyro rerelease for consoles only comes with the first game on disc, the classic versions and remakes of games two and three are downloaded.
If you were banned you'd be paying $40-$60 and be missing a majority of what you paid for.
If that sort of practice becomes more widespread and it probably will as game devs don't compress shit anymore you won't even be able to play physical carts with a CDN banned console.

I don't think bans are ever going to be "solved", there haven't even been surefire ways to stop 3DS bans, other than replacing LocalFriendCodeSeed_B, and that has been broken for years.
Considering how much of the eShop/CDN authentication is handled on Nintendo servers this time around I don't think it'll be six months, if ever.
You'd need to sacrifice a lot of hackable Switches to get close to figuring out how to spoof what they're looking for and Nintendo could probably break any potential solution rather quickly by authenticating in some other way.
I think people are going to need to get used to transferring .NSPs/.XCI from PC. I'd be happy to be wrong though.

I suspect it has to do with software sales.

As for your question, why wouldn't it be legal? A ban stops you from accessing their servers, full stop. Lots of other (((services))) follow the same policy. I think you need the latest firmware (11.8) to play online. However, that firmware breaks old version of Tranny3DS inb4 "but I'm using RxTools". You're thinking of 6.0.0, hacking works fine on all current, actually released OFW assuming you have a hackable unit.
That said, updating while not burning fuses use Hekate, autoRCM, etc to make sure you don't boot the actual Horizon OS may be to your benefit in the event that a coldboot exploit is discovered, those will generally come to lower OFW before moving up, if ever.
Currently, if you have a bootrom exploitable unit, there isn't much reason to not update assuming you do so without burning fuses.

You could look into autoRCM. You'll still need to inject a payload each boot but you can do that with an android phone rather than your desktop.

Hey i'm not sure if anyone else has tried this but I found a mod for the joycon so you can enter rcm mode without needing to take out the joycon and put in a jig.
Basically it only bridges the points when you press the release button. I used this method because I didn't want to fucking around taking out the joycon and putting in the jig every time to boot cfw, and I didn't want to risk damaging the pins.

The tinfoil method and has the pins constantly bridged which could cause all sorts of potential issuse down the line through prolonged use, and on 6.0 there's reports of joycons with the tinfoil mod being bricked, and also, it's easily detectable that people have modded joycons.
And the RCM jig method is an annoying hastle to deal with.
