There's at least a few why it wouldn't be feasible, the rights to certain games being tangled up elsewhere, source code has been destroyed, publishers gone defunct, etc, but i think the biggest reason why they won't do it's simply easier and more profitable to just port the games over to new consoles and then just do a print run on that., if they even do so to begin with, if it's not just them selling you an emulator and roms.

Depends what you mean. You can clone a game as long as you don't clone copyrighted assets (such as art, music, models, etc), but that "clone" means not using any of the original code or binary at all. If you want to replicate the gameplay, it has to be a clean room design. There's a Wikipedia page ( https://en.wikipedia.org/wiki/Clean_room_design ) but the gist is that you can not use any of the source code (even a clone-and-rewrite), you can not use a disassembly, and you can not use any direct knowledge of what was done to develop the software. That shit is very illegal.
The only way you could do it that way is have somebody examine the code and write a neutral specification, and have somebody else implement that specification. This means that somebody would essentially, from the specification, have to rewrite the entire codebase from scratch. It would literally be easier to just write a completely different game from nothing.
This gets even more messy when you factor in the recent Google vs Oracle court case, which determined that APIs are copyrightable, so your specification couldn't even describe any function calls in any direct way. And nobody wants to spend hundreds of hours anonymously developing illegally on a hot codebase and distributing a port of a 20-year-old game on the darkweb for nobody to play. Anybody with the time and ability to do that knows they're better off just working on real FOSS games or developing something of their own from scratch.
The only way the leaked source code could be useful is as a novelty, and to read and learn how they did what they did. You couldn't actually use it as a base for new development until all the original authors have been dead for at least 70 years. Still would be better off public, so it could be archived and preserved for posterity.
That's about the best I can explain it. I'm a programmer professionally, but I'm not really good at explaining the finer points of code copyright or licensing to non-programmers.

There's a lot of "older" games where almost the entirety of the mods produced for them have gone down with the developer's forums. Two Worlds is an example, as is Soldiers: Heroes of WW2, and a lot of Max Payne 1 and 2 mods are also gone from the tubes forever, or at least scattered so far and wide that it's very difficult to find most of them. Same for Operation Flashpoint. There are databases with the mods, but they're such a clusterfuck any newcomer will be lost in the indecipherable nomenclature, and God help you if any of those mods have dependencies.
The main issue is that there is no really secure solution to store your data on. Hard disks and flash drives fail all the time, and if you didn't make backups you're fucked (and good luck making backups of terabytes upon terabytes of content), CDs and cartridges rot and wear out. I hope there is some breakthorugh in the near future that will make storing data safe and secure, because otherwise we're fucked.

I know he's talking about games preservation in a general sense, but the leak that spurred this on was only possible because the games were in a digital format, a format that can be copied and sent across the world near instantaneously. If these lost works aren't protected by any sort of copyright, what would stop someone from sharing and ultimately saving a work by spreading it across the internet? I'd agree that if you leak or save lost work that you should be compensated for it, but the need to make shekels off of it shouldn't precede the act of saving the work in question.

It's pretty easy to analyze binary code to see what sources are used. Even with obfuscation, the level of changes you'd need to make in order to mung the structure past the point where somebody could analyze it and recognize it as having been built from the same source would effectively be the work of an entire rewrite from scratch. Note that the main points that you'd need to determine the sources used are just analyzing function call points, which are really easy to identify, and determine the parameters and parameter order passed in. And then you'd have to change the mechanics and visuals enough that nobody could recognize them as having come from the original source. It's more work than just making a game from scratch to make it unrecognizable. If it was that easy, everybody would just use GPL libraries in proprietary projects without anybody finding out, but people find out all the time, and sue them.
It's like using an existing book, and making your own book from it, but trying to make sure nobody finds out what it was copied from. It's more work than just writing a book from scratch.
