I'll defend the decision. Using a Batman set in the time period would defeat the purpose of "Batman Ninja". The draw of "Batman Ninja" is, literally, Batman becoming a ninja. So they take Batman and his villains, throw them into the past, so that Batman can become a ninja.
Boom, right there you have mystery, conflict, tension, and a character arc for Batman. You've got the mystery of how they ended up in the past and how to get back. Conflict as Batman has to adapt to limitations of medieval Japan. We've got tension since the history of the world is on the line. Finally, character arc, as Batman has to discard his reliance on technology to save Japan and the entire world.
A Batman from the setting wouldn't provide any of that, and by it's nature would have to be an origin story to allow for things like character arcs, tension, ect. It's a premise that would work for a Batman Ninja series, not a movie.
Personally, I hope we get a cameo from Professor Carter Nichols.

I think the Batman characters translate well to the feudal Japan setting, Batman as a ninja, Joker as a aristocrat with face paint, Catwoman as a kunoichi/thief etc etc. I really like how over the top the designs are (though I'd strip some modern elements and have it more contemporary). Not saying it's shit, just that it's not my cup of o-cha.
Side note, I think the gorilla will be a stand-in for Toyotomi Hideyoshi. Same kabuto and it would be a play on Hideyoshi's "Monkey King" nickname.

I want DC and Marvel to crash and burn as soon as possible, so I try to avoid supporting their shit. Marvel is shit in both comics and movies, and DC is slightly less shit in comics, even shitter in movies.
