So I came up with a business model which I believe has never been tried before. I've explained it to a handful of people that I trust and it blew their minds. If I am right it would blow the fuck out of some of the very large corporations and make small businesses much more profitable. If such an idea were novel would it be patentable? Is there any way to go about patents without risking intellectual rape? The reason I am thinking about patenting it is so that I could start said business as a proof of concept and then license the business model out on an open source basis.

Those are mutually exclusive.

According to a quick web search, and a large legal filing and processing website, a person who

I bolded what I think applies to your question.

If you think it's worthy of a patent, talk to a patent lawyer.

They might charge you or provide the information free regarding whether your process is patentable.

It doesn't have to be mutually exclusive. I was thinking along the lines of patenting it so that shit heads can not get ahold of it while giving out licenses as part of a grant program in order to circumvent any applicable laws.

Open source and license are not exclusive, that's why you have terms like Free Libre Open Source Software, and just Open Source.

If you license open source, the license holder can usually see the code, and or make changes based on restrictions of the license, and probably not share it, based on restrictions of the license.

OP may be able to "license" out an idea like software you can read the code for, but the license would prohibit sharing. Could sue for breach of contract. It's not uncommon for business deals to include things like "you won't take xyz action as a business for abc years."
