In terms of copyright, don't use what the company has copyrighted. Specific ideas, like the names of characters/names/etc. are covered by copyright, but the concept of a plumber hitting boxes and jumping on turtles isn't specifically protected. That said, the judge has the last word, which means expensive lawyers can win that case.
Also keep in mind, that the laws are fucked up, so even if you win the case, you'll still lose in court fees and your life will be ruined.
Spiritual successors are more than allowed, even reusing mechanics (if they had a patent, it'll be over by now). Don't use character designs, names, locations, and especially don't advertise it with the name of the original game. Make it clear it's a separate copyright, and you'll be fine.

Game mechanics cannot be the subject of a copyright. Game companies will tell you otherwise, and even try (and sometimes succeed) in copyrighting their mechanics (which will never hold up in court). If you want more evidence about that, take a gander at the history of tabletop RPGs, and how every game's rules can be found online or freely distributed. Basically, as long as you're not using actual names, assets, or representations, you're fine.

Unfortunately, companies like Zenimax or Nintendo are infamous for those letters. You're bound to get a letter by some company, even if you're not infringing upon copyrights. If you're 100% certain you're not infringing upon their material, politely tell them to blow it out their ass.
For example, you could entirely clone the Super Metroid engine. If the graphics, sound, and levels are all of your original design, you are not infringing upon anything. If your character was just an HD Samus, you're treading upon suspicious grounds.

You could remake 80% of the stage layout of Mario 1 with similar mechanics as long as you don't feature Mario, mushrooms, Goombas, Koopas or the Koji Kondo music and you'd be unfuckingtouchable. Correct, they can be the subject of patents. Sega patented the arrow in Crazy Taxi. Namco patented loading screen minigames, and Katamari's gameplay. Look up any big games corp on the patent database, and you'll find them doing a lot of them. Patents last 20 years, thankfully, so Katamari might be free to clone in a couple years.

Game mechanics aren't copyrightable. Just don't use copyrighted characters, assets, or music and you're fine. There were tons of Mario Bros ripoffs that didn't get C&D'd because they didn't call their shit "Super Mario Assblaster 23" or whatever. You can effectively copy the mechanics of any NES game verbatim and nothing will happen as long as you don't copy characters, art, music, code, or arguably level design (It's never been taken to court, but level design itself would be easy to argue as a unique piece of art, so I wouldn't push your luck here).

Game mechanics are not copyrightable, and Mario's mechanics have not as far as I am aware been patented, so implementing a 1:1 copy of its physics engine through clean room reverse engineering would not constitute either copyright or patent infringement.
To avoid copyright issues, the assets would have to be original and the levels would have to be redesigned. Abstract ideas such as eating a mushroom to grow bigger or jumping on evil turtles to make their shells slide are not copyrightable in themselves, but some caution would have to be exercised when using such elements.
To avoid trademark issues, naturally none of the names of the game's characters or objects names could be used. Call it something generic, like John the Plumber.
Combining these, I doubt Nintendo would have any legal standing in court. Consider The Great Gianna Sisters: despite intimidating Rainbow Arts and retailers to drop the game, they never actually took legal action against the developers.
