I didn't like most of Daggerfall's soundtrack but that's mostly because it was recorded on a budget. Soule has a proper orchestra at his disposal. I don't mind Soule's music, the non-combat tracks are comfy and sometimes uplifting. When TES 6 was first announced, Soule tweeted that he didn't make the music in the teaser and so far he wasn't even contacted by Beth about composing anything for TES 6. If this is going to be a High Rock game, Heberling could make some good stuff for it. Inon Zur is also capable of making good fantasy music, he made the Rift soundtrack.

Back in Doom/Doom 2 days it was a cover more than rip off, Id Software later on had Nine Inch Nails and Megadeth do their soundtrack, it was definitely intentional (there is some Pantera in there too E3M1 is a cover Mouth for War, etc…), I don't think they ever hid it or anything.

It's okay because it's an original composition from scratch in MIDI and not literally just a sampling of their music. Sure, most of the note and chord progressions are the same, but there are still enough key differences. Meanwhile you have entire bands of dudes that make a living or a hobby of covering older bands. In my last job, I knew a guy that was the lead singer for a Ramones tribute band. Copyright tends to be very forgiving when you perform or compose something yourself, at least where music is concerned.
