Mercer is dead and is a point that's expressly stated.

It's technically half-and-half. "Alex Mercer" is technically the virus but it takes on personality traits of Alex as the game progresses and develops a "good guy" personality, weirdly enough, culminating in saving Jew York from a nuclear explosion. It's one of the few plot points in the original Prototype which was actually interesting, a sentient virus that actually becomes heroic instead of being all "consume humans, dominate the world", which makes the absolute bastardization of Mercer's character in the second game all the more infuriating.
