It is the responsibility of the prosecution to prove that each piece of pirated media is, in fact, illegal. Not only must they prove where and how you got it, they must also prove that you do not have license to a legal copy on various distribution services, regardless of whether the service clients are on your computer at the time.
Which means they must prove that under no circumstances have you ever had license to download it, and they cannot burden you to provide proof that you have.
The EULA itself is not legally binding (not possible to agree to it prior to point of purchase, not possible to verify who agreed to it, not possible to agree to if it's a pre-set up gift, etc.) so there's nothing in there that can fuck you.
At worst they can get you on unlawful redistribution if they can prove you seeded, but even then you have a loophole if the title was unavailable for sale in the form of release you have a copy of for at least 4 years (to wit: NES and SNES games are free to download despite the eShop because they were not available for a good 25+ years)
