Only if they really really really want you to go to jail. Contrary to popular belief, cops would rather not waste filing the paper work needed to get the whole ball rolling on such a case. That's why a lot of arrests made for IP infringement are instigated by either lobby groups or the companies themselves. So unless you're already being targeted for one, you're pretty much safe.

It is the responsibility of the prosecution to prove that each piece of pirated media is, in fact, illegal. Not only must they prove where and how you got it, they must also prove that you do not have license to a legal copy on various distribution services, regardless of whether the service clients are on your computer at the time.

Which means they must prove that under no circumstances have you ever had license to download it, and they cannot burden you to provide proof that you have.

The EULA itself is not legally binding (not possible to agree to it prior to point of purchase, not possible to verify who agreed to it, not possible to agree to if it's a pre-set up gift, etc.) so there's nothing in there that can fuck you.

At worst they can get you on unlawful redistribution if they can prove you seeded, but even then you have a loophole if the title was unavailable for sale in the form of release you have a copy of for at least 4 years (to wit: NES and SNES games are free to download despite the eShop because they were not available for a good 25+ years)

And CP. You don't have CP saved anywhere they can find it, right?

The only way a search warrant would allow the police to investigate or confiscate your PC is if the warrant is for a potentially computer-related matter.

If it's something like drug possession they should have no grounds to investigate the PC beyond the physical contents of the case which they can do on the spot. If it's over drug dealing, on the other hand, they might confiscate the PC to check for financial records.

As for the subject of encrypting your PC, the courts currently view a refusal to provide the password as an admission of guilt and will hit you with obstruction. If they do so, hit them with the ACLU and the 5th amendment.

You are not responsible for providing them with anything to use against you, and it's not destroying or hiding evidence until such a time as it is filed as evidence.

Ok so I have legit anxiety issues and this is just one of many things i tend to freak out about. Heres the thing: The only stuff I have on here are thousands of songs, sony vegas, the adobe suite, some other minor software, movies, and games. Nothing on here is bad or anything like that. No, but encrypt your hard drive and if you get FUCKO'd then turn your computer off and don't talk to the cops unless your lawyer tells you to. There are some shithole countries where you are required to give the police decryption keys though, but it's only an issue in the US if they already know there is something illegal on the drive. This is why you don't want to talk to them too, since they could interpret you explaining why you encrypted it as you admitting that there is something illegal on there.

Also, they won't care about this stuff in a vacuum but the real problem is if they suspect you of something bigger that they can't prove then they'll find any other crime you've committed in order to at least get you in jail, like how they take out crime bosses by arresting them for tax fraud.

There was one example of a man who had to give up an encryption key because there was an eyewitness who visited his house and saw CP on his computer, and another when someone was stopped by airport security with the phone unlocked and they found something illegal but it automatically locked after a bit so they had to give the passcode to unlock it.

If by "intimidated" you mean "given a court order to unlock it" then yes, as that is a pretty strong form of intimidation.

If they're willing to extralegally intimidate you into giving up the key then they may as well simply plant CP on you and the only way to avoid that is to not be suspected in the first place. Any clever cryptographic measures you take to prepare for something like this like digitally signing all your files is going to have to be explained to a jury of tech illiterate idiots and is therefore useless.
