The only thing they can sue upon are the weapon stats, which probably aren't a reflection of how the real weapon works, unlike the model which is clearly based on the real one. If you model a weapon after an Ak-47 and it looks just like an AK-47, then you can't sue or get sued by others who modeled their guns after an AK-47, because they didn't steal your model of the AK-47, they just made their own model after the original, just like you did. If you made some Sci-Fi or fantasy weapon that nobody has ever drawn before or appeared in any book/magazine/movie and you find some chink game that has an exact copy of your weapon, then you know he stole it from you, because yours was the base.
If you add stats to your AK-47 model, for instance it takes 10% of the player's health for every bullet received, or it does 20pts of damage, stats than in no way reflect the real weapon, and some other game has the same stats for the same weapon, then you could say that they stole it from you, but they could just say that it was a coincidence, or that you don't own the weapon's stats.
It reminds me how a form of anti-piracy in the medieval age, was that if you made a warfaare or sword fighting manual, you would add some bullshit strategies that would guarantee you defeat if you used them, and if some other guy had the same bullshit strategy as yours, then you know he copied them from your manual. Even today Micro Processor manufacturers add some redundant circuits on their uP so that if some other company has the same redundant piece of circuit, then you know they copied it from you.

Matchmaking usually matches players to push for 50-50% winrate. Instead it should inflate winrates of the whales. Say players with skins (only cosmetics!) constantly get matched with less skilled players and gets 40-60, 20-80% winrate in his favor. It makes whale feel good, play more and spend even more money.
Beauty of such system that with standard P2W when cash buys overpowered gear players can pin point P2W happening, this discourages both non paying customers who don't like be killed with OP guns, and whales who understands that their win is cheating. In proposed case whale will genuinely feel that win was because of his skill (and actually he IS the most skilled player in the match that was matched specifically for him), and players losing to him would indeed be losing because of their skill not gear.
