I was gonna start this thread yesterday, but out of morbid curiosity I decided to post it on halfchan to see what would happen, and let's just say it was the biggest shitshow the world has ever seen and lots of keks were had. Regardless, this is a serious issue so let's try to get some actual discussion going. Anyway, on to the point:
Nintendo is a horrible fucking company and if you give them money in any way, shape, form or facet you are a piece of shit. Not only are they borderline incapable of making good games anymore, they abuse DMCAs like a drunk father. They have illegally tossed C&D's at a plethora of people who had been working on ROM hacks for 10 years, despite the fact that they lost a fucking court case about this in the early 90's (see: Game Genie vs Nintendo 1993.) This also applies to fangames which 110% comply with the "fair use" clause of the Copyright Act of 1973.
The problem is that Nintendo has money and the people who get hit with these have no money to fight back. Nintendo can't STAND it when random hackers in their bedrooms equipped with nothing but a hex editor and a Z80 assembly manual manage to make games 10x better than they can (see: Pokemon Prism vs Sun and Moon.) The difference is night and day, but instead of doing what they SHOULD be doing and hiring these very talented people, they ruin their life's work with an army of mean lawyers, and when facing losing their house and being homeless for the rest of their lives, the hackers have no choice but to take it. Nintendo ruins lives, and anyone with an respect for software freedom or artistry should want to squash them like the bugs that they are.
Even if you can find some stupid ass reason to circle-jerk your way around this inconvenient truth, we're talking about a company that sells half finished games, and gives you the rest of the content in the form of on disc DLC activated by plastic toys.

I think you're missing the point. ROM hacks are legal because they are not "derivative works" as proven by the Game Genie trial. Effectively, ROM hacks and Game Genie are the same thing but large scale. A lot of people who have never played a ROM hack before or have never been aprt of the community don't realize that nobody distributes actual ROMs. They distribute patches that include 100% original data: instructions to change certain hexcodes with their own. Game genie does this on a small scale while an IPS patch is a large scale effort. If GameGenie was rules as non-derivative, this means that ROM hacks are non-derivative as well.

-Those who love casual fast paced action packed games with excellent graphics can play arcade games.
-Those who wish to play arcade quality casual games at home albeit with downgraded graphics can buy the Atari.
-Those who love deep, engulfing, and expansive games can play PC games.
Then Nintendo came with the NES and tried to put all the three audiences into a melting pot. As a result, every game coming out ever since has been a dumbed down or watered down version of their original platforms. The consolization and hyper-commercialization of video games that still hurt the game industry to this day can entirely be blamed on Nintendo for starting the money grubbing melting pot trend.

The only genre the consoles improved were side scrollers, the rest of them were watered down version of arcade or PC games.
