You're right, but as America's legal system has taught us anything, it's that one party tie up another party for years with court proceedings and expenses even if they're on the eventual losing side. As a compromise, CBS drops its case and the Orville network jumps into Star Trek canon.

Cutting the restrictions with Roddenberry directives is probably what partially contributes to this show being as fresh as it is.

They aren't going to sue Seth McFarlane because if the Orville is successful they'd likely hire him to show run a Trek series. Since he's stated numerous times that he really wants to.
It's very unlikely they'd engage in a lawsuit they wouldn't win, would likely get dismissed and would end in bad publicity for Discovery.

The only reason these companies engage in lawsuits is to get something out of it. Like I said if the show is successful it's very likely they'd hire Seth themselves. So a lawsuit would be a very bad idea on their end especially since there's no grounds to do it and they're trying to push their own show at the same time.
This could possibly lead to a Married with Children situation where the show is failing in ratings but due to some controversy suddenly gets really popular because people see it as really edgy.

Thursdays, it moved to Thursday, and the ratings blew the fuck out.
http://variety.com/2017/tv/news/orville-ratings-fox-1202566264/
>Fox’s “The Orville” saw a significant drop in both key ratings measures in its first airing in its regular Thursday timeslot, according to Nielsen data.
>Airing at 9 p.m., the new sci-fi series drew a 1.1 rating in adults 18-49 and 4 million total viewers. That is a drop of 50% in the key demo and 39% in total viewers compared to the episode that aired this past Sunday after NFL football (2.2, 6.6 million).

That may have been the plan, Fox does these weird weekend debuts with other shows then moves them to a normal slot.
Gotham was Monday for 3 seasons and they moved it to Thursday, so I think it's officially fucked. Which is a damn shame cause it's the only decent comic show, imo.

>TNG's bad first season
This is a bit of a misconception. Few people who actually watched TNG back then (and would care enough to comment on it today) were sophisticated enough to know it was shit at the time. There were a contingent of fans who were miffed that it wasn't Kirk, Spock, and McCoy, but for the most part, it was popular with fans from the beginning and people were just happy to have new Star Trek on tv and a cool sci-fi show in general.
Keep in mind, this was the 80's. People didn't look at that cheesy aesthetic and bad production as being retro and ironic. They legitimately thought that shit was cool… and compared to everything else on tv, it pretty much was. It wasn't until the 90's that people realized it sucked.
Voyager and Enterprise, on the other hand, were noticably inferior to TNG from the beginning and it was a clear disappointment. TNG was cool from the beginning and (for the most part) only got better as the series progressed. DS9 was always niche. People who first encounter TNG on Netflix or Blu-Ray are lucky to have the ability to be more choosy with the quality of their entertainment, but miss-out on a certain perspective.. and getting to live with TNG and have it be a "new thing" full of surprise for 7. fucking. years. That's rare for genre fans now.

I liked TNG's first and second seasons better than what came afterwards. The themes of the episodes tend to be darker and more pessimistic, obviously from a time before the studio said "tone it back a notch."
▶ fbe74e (2) No.7780>>7783

TNG's first season was fairly watchable for the normie crowd. Honestly I remember a lot more people angry at Season 2 than Season 1. And that is quite understandable since the quality of the writing was botched frequently and included a clip show of all things. Season 1's worst excesses are that it's cheesy and derivative half the time, but it also has some strong points as well. S2 has a lot less of those to go with the crap.
▶ 834b7b (2) No.7783>>7884

nice quads. S01-S02 of TNG had less character-focused episodes and it was more of a true ensemble show. You're right about it being surprisingly harsh when you go back and watch it. Shit like Conspiracy was edgy in ways the show never really revisited, to be sure. Nagilum from Where Silence Has Lease literally gave me nightmares when i was like 11.
People tend to not remember that shit, though. They just think tight uniforms, inferior cinematography, and lame Wesley scenes with that gay rainbow shirt he wore.
>>7780
Yup, I actually hate S02 far more than S01. Dr. Polaski sucked and episodes like Outrageous Okona and Manhunt and a season finale that's a clip show were Riker gets bitten by a vine. There's a lot to like about S02 but it's my lease favorite season, easily. TNG would make more sense overall if they'ld have waited till season 3 to give Riker the beard.

I don't know if S2 was that dark although I would agree that S1 was pretty seedy in comparison to the 90s seasons. I mean the the first episode is basically the Feds dealing with a civilization of slavers after running into Trelane on crack, and pretty much every other episode they go to some kind of North Korean-tier shithole. And then you have your Conspiracy or your Skin Of Evil where (despite being on different ends of the quality spectrum) don't fuck around too much and are pretty intense for ST, let alone TNG. I'm still pissed that Conspiracy didn't get any development on the show, even though I will say the Borg was initially a decent replacement.
>>7783
Those S2s are bad, and then you have "The Child", "Loud as a Whisper", "Samaritan Snare", "Up The Long (Fucking) Ladder"…it's easier to mention the 2-3 worthwhile stories and wrap it up there. The last two are so fucking stupid they are unwatchable.

Yep. The insects from Conspiracy morphed into the Borg. It makes the Borg that much more special, in my opinion, because they really had the writer's stumbling into "space zombies" years before zombies went mainstream. It's a shame the studio suits forced them to nerf the Borg and just invent new "big baddies" that weren't so perfect an archetypal force of nature.
