So they're trying to give themselves the authority, but I really don't see that holding up in court. ATF is under DOJ, but the DOJ can't just take over the duties of the ATF of which interpretation and enforcement are included. Do we have any ATF officials who have commented on the situation?
If ATF doesn't play ball, can the President replace those in charge? I know he can appoint new directors, but I'm not sure if he can get rid of them as well.
The weak link is the silly way DOJ wants to define pulling the trigger. There are so many previous technical rulings that stand on the old interpretation that changing it is in this way is going to bring many old technical rulings into question. Either volley guns become illegal, or a good lawyer argues that the old technical rulings render this new definition complete bullshit.
Or, ATF realizes this and finds some even more fucked up way to render bumpstocks illegal which will open up a whole new shitstorm. If they come up with a proposal that uses fire rate as criteria in any way semi-autos could be fucked, but they've got enough lawyers they should know it probably won't stand up in the courts.
This is a bad situation all around, but I expect years of lawsuits and legal back and forth before the issue is settled. The NRA siding with the anti-gunners on this is a bad sign however. Lawyers cost money, and I don't know if the GOA is going to be able to pick up the bill for this.
