He's released Ren'py for free, and continues to do so. Those who use free software within their respective ToS/ToU/etc are free to use said software to whatever ends. That said, Tom "deserves" what he makes, and chooses to make, but also has the ability to make a lot more. If Tom decided to charge royalties, he would "deserve" them.
As far as opinions go (implying all previous text is fact, come at me), I'm pretty sure most would agree in that Tom would be reasonably justified in charging some sort of cut from profits made with his software.

I would think that the rates should scale with profit but only start after a threshold, wouldn't want to scare off people from using the software to begin with.
…something along the lines of 5% once profits reach 100$/month would work. maybe not those numbers specifically though.

I disagree, especially if this contradicts Tom's interests.
Also, "in a just world", the software developer can determine if and how much money a user must pay for the use or specific uses of their software.
