 No.74769>>74772 >>74891 >>74893 [Watch Thread][Show All Posts]

Well, well, well, seems like our little sub-cutlure is about to get it hard from now on, I hope your oc really is a damn original caracther and your favorite porn ain't from an already existing show or anime.

Well, from the bright side, sonic OCs and 70% of Rule34.paheal will be empited out from much of its horrible shit.

And for those who hate e621, you are in luck, article 13 will destroy it. :)

And lastly, they will reach us, not sure how, but I'm pretty sure it will.

It's been an honour my fur-friends.

Let's just hope some miracle happens soon.

Say good fucking bye to all those pokemon ocs that are just x pokemon wearing y accessory or a fucking recolor, thank god.

 No.74773>>74774

>>74772

Indeed, but it does effect our furry porn too, and even the SFW we furries seems to love so much.

OCs are only a small, small, small percentage which will be affected in the end.

I mean, our culture is built up on parodies, copyrighted communities, sharing and drawing artworks, etc, etc.

I mean fan-communities

You don't seem understand what will happen, we won't get in trouble and the court wont do jack shit towards us.

Article 13 is in short (very summarized) an act were websites has to in one or another way censor 'copyrighted content, and if the is passed at a later date it will be MANDATORY for websites to deal with what can be seen as 'copyrighted material. whether you have a pokemon fucking a horrible OC or a meme of some shity Ben Stiller movie.

In short, see it like the youtube algorithm and filter, were youtubers has their content blocked, taken down or demonetized.

You or me doesn't have to worry about court, not at all, but the websites like furrafinity, inkbunny, deviant art, music remix websites, and pretty much ALL platforms, etc will have to implement something to deal with what can be seen copyrighted material, and if they don't, they can be removed, blocked, closed down or like you say, taken to court.

But anon, but anon! It's still fair use! And it will still exist if this bill passes! This is in theory true, but if you are stupid enough to believe it will avoid fair use content on internet in practicality, you are gravely mistaken.

We are not talking about some cranky artist who is pissed their content has leaked, we are talking about government here, of course this can be avoided by like taking furries to the dark web or something.

___

In short, Article 13 would force sites and online platforms to use automatic tracking technology to detect when users uploaded content to make sure they weren't sharing copyrighted material.

 No.74841

>>74815

The only blessing is that is effectively impossible to do, any algorithm system similar to youtube, that also fail most of the time as well, would end up costing billion to make with all effective companies involved between now and 10 years, maybe even in less

There is just not enough calculating power or implementation technicality that allow for something so retarded as a all including net on the web, plus it won't touch oversea server, what then? Shut off all connection to eu like someone did with gdpr?

It's simply not doable with actual level technology, and even a faulty partial implementation have astronomical cost for any platform that get hundreds submissions per day, completely out of the possibility for smaller platform as well, plus it violates at least to main eu principle of the eu chart

This is gonna be a gigantic mess no matter, it show how ignorant of technology and internet the eu representative are

 No.74844>>74851

Can't websites just block all traffic from the EU? That seems like a good way to avoid any issues.

 No.74851

>>74844

Yes they could, it would avoid forcing the to respect the retarded regulation, of course this would mean also denying all service in full to anyone living there, just like someone did with the gdpr, difference is, this is gonna be so unthinkable, impossible, costly and ridiculous, that most company are gonna do just that instead of complying, effectively shutting down most internet for eu citizens

Fucking imbecile at work = eu representatives

 No.74854>>74860

What if it is a decentralized system with no central server, like FreeNet or Gnutella?

 No.74860

>>74854

Technically anything an eu user could see make the law applicable, but in practice services that have no central host, like torrent, cannot be regulated as no specified physical location where the cocwriting holder could send a notice exist, same for vpn, in practice the server do not know the original location, thus is legally not bind able by the regulation

To sum up, this regulation is useless to stop piracy, but sure as hell give cocksuckerholder and government officials lot of leeway in censoring and more importantly monitoring, anything they want, as this crap cannot be even conceptually applied without constantly monitoring users traffic on all major site, like reddit, youtube and pretty much any forum or image board that fall under the shadow of this thing

Fortunately such mass surveillance would fall under isp for the most part, and by law eu regulation Should not be able to force these company to pay for the significant change required to support it, meaning if someone sue because it dosen't want to pay, either the government of residence or even the eu commission would be forced to pay the bill, something we know they'll never do, thus making the regulation impossible to apply, as a similar case happened in germany some years ago with data retention, but we still don't know for sure

 No.74871>>74875

I wonder if the EU even has authority to enforce this against a US-based website to begin with. Just like I wonder if they can even legally fine US companies that don't comply with their new privacy laws. I bet in practice it's going to be really hard to enforce.

They can threaten to arrest you if you ever go to their country, fine, just don't go there. I highly doubt the US will agree to extradite over this crap, either. Lawsuits will probably amount to jack shit.

 No.74875

>>74871

Non eu based site are not directly affected, but if the same site want to make business, allowing upload of user from eu, theoretically it can attempt to enforce it, this crap on it's own would do nothing, that's why they tied it up with copysucking law as to affect based on those asseatingwrite violation, something that existed for years

As an example if an eu citizen upload something that is considered, look at the word carefully, considered not necessarily is, copyright violation on a us server and it's isp could not block it for some reason, becouse the regulation impose they should, the holder or even a third party not/working for them including the government could demand it's take down, penalty cocksuckingwright violation, that's how they could fine you even if your site is not based in eu

In theory only the holder have the legal basis required for such demand, but with deals and third party involvement, aka trolls, that can become unnecessary, and a government could just make the request either trough them or justify it as, it's not fully clear yet, security reasons or more probably dragging the isp of the user in court as liability, not having respected an eu regulation

This mean 100% attempt to monitor all eu citizen traffic no matter where it go, and this can-could mean trouble for site not based in eu that don't want the attention, in uk for example they are considering immediate arrest for such violation, you can easily guess what it could mean there for a board like this one

It's just easier to block all access coming from eu and spare themselves the bother, ignoring when users use vpn or known proxy, or just open up the site to tor network

<We're sorry, anon, he's a mouse and Disney has copyrights on all mice characters.

>W-well, here's another one, a dragon character

<A SMALL dragon? Sorry, buddy, all small dragons are classified as Kobolds, which are under copyright.

>O-okay, well here's a species I just made up, with blue fur, and-

<Nope, sorry, Amazon has copyrighted the color blue. Pay up, kid.

Why do you think this is going to go your way?

I want you to try registering something so vague as a mouse, or even a color.

Just try it.

The fact she's a troublemaking, lying cunt aside, her entire business model is based on stolen IP, not just drawing it but selling it. She's been hit by 2 Hasbro C&Ds so far(one for the Slave MLP art CD she sold, another in the furry pillow case company she worked for) and both times tried to pretend she was an innocent victim. I think she even tried to play the damn race card on it.

http://www.businessinsider.com/colors-that-are-trademarked-2012-9

You also have to consider that copyrights only cover the industry that the copyright pertains to, so a cola company can't get away with a red soda can, but Delta machinery can have a triforce as their logo and not get ass-blasted by Nintendo.

 No.74914>>74927

>>74912

Exactly. And I don't see many furries breaking into the big business industries and competing with these companies.

 No.74927>>74946

>>74914

I think you are underestimating copyright, and confusing things with trademarks

If i "sell" something on internet and you attempt to give potential customer what could be considered the same product, ie some spyro character, in theory you are already violating the damn thing

Hasbro for example could ask all stories hold in various specialized site, same for pokemon really, to take down everything related to them and their cartoons or sell able dolls-plastic shit whatever

Remember many youtubers where hit by a strike from nintendo just for showing the content of their games, theoretically anything distributed publicly could fall under this regulation if it have an holder, in practice most site are left alone because it would be publicity by going after free content that help a fan remain so and can gain new ones, but they could intervene, and with this regulation no matter where you upload your things they would know get notified immediately

For practical reason such immense mass of data cannot be processed in real time, even echelon would have problems with that, that's why data retention would have to be mandatory, but supreme court already declared twice that's illegal:

https://www.theguardian.com/world/2015/jul/17/data-retention-and-surveillance-legislation-ruled-unlawful

https://www.pcworld.com/article/2141040/eu-data-retention-rules-violate-privacy-rights-and-are-invalid-eu-court-rules.html

We will see how it this mess goes

 No.74940

And I'd love to see you try to sell a mobile game with the word "candy" or "crush" in them. >>74912 is right that it's contextual, but that's still very wide. [insert company here] could just claim that your drawings fall under the "entertainment" category. Or if they also sell comic books, and your character is in a comic book you've made, they've got you. Never forget that it's possible to sue ANYONE, for ANYTHING, and win, as long as their lawyers are more expensive than yours.

 No.74946

>>74927

Hasbro is trying to sue DC over the name "Bumblebee" even though DC's character existed 10 years before the Transformers version.

Hasbro stealing names, acting all dindu nuffin and even trying to fuck over who they stole from? Not the first time.
