I think, even if the US Government blocks the merger, because 21st Century Fox is being sold no matter what, there's a clause in the Fantastic Four and X-Men contracts that basically means either Marvel reserve the right to buy back the film and TV rights, or else they revert automatically.

So, in other words, Marvel are getting back X-Men and Fantastic Four no matter what happens.

I guarantee you there are. That's standard business procedure. They also made it so that if Fox ever tried to do that F4/X-Men crossover they were talking about, they'd have the right to reclaim all the rights there as well.
