Supreme Court allows Trump to fire independent agency members

The case raises broad constitutional questions aboutwhether Congress can set up agencies that prevent the president from removing officials without cause.

WASHINGTON —The Supreme Court on Wednesday ordered that, for now, President Donald Trump is not required to reinstate two members of independent federal agencies he wants to fire.

The provisional decision affects Gwynne Wilcox, a member of the National Labor Relations Board, and Cathy Harris, a member of the Merit Systems Protection Board.

Chief Justice John Roberts issued an order that temporarily blocked lower court rulings that said the two officials should be reinstated.

The court will decide what next steps to take in the case after hearing from lawyers for the two ousted officials.

Although the Supreme Court previously upheld protections against members of independent agencies being removed without cause, the current conservative majority has reversed course in recent cases affecting other agencies.

Wilcox was appointed to the body that adjudicates labor disputes by then-President Joe Bidenin 2021. Her five-year term would have expired in 2026. Under federal law, thepresident can only fire members "for neglect of duty or malfeasance in office."

Biden appointed Harris in 2022 to a seven-year term that has similar protections against removal. The Merit Systems Protection Board handles disputes involving federal employees.

Trump sought to fire both soon after taking office.

Wilcox and Harris both sued and won at the district court level. An appeals court panel initially ruled for Trump but, in a later ruling in which the entire bench of judges participated, reversed course in a 7-4 vote, prompting the administration to go to the Supreme Court.

In recent rulings, the Supreme Court, which has a 6-3 conservative majority, has ruled that provisions protecting single heads of independent agencies were unconstitutional. But a 1935 precedent that upheld the structure of multimember agencies remains on the books.

Conservative lawyers who favor broad presidential powerhave long argued that independent agencies are not sufficiently accountable to the democratically elected president under the Constitution's separation of powers provision. The president should be able to fire agency heads at will, they argue.

Solicitor General D. John Sauer said in court papers that,because of the lower court rulings, Wilcox and Harris are effectively "exercising the president's executive power over the president's express objection."

Lurking in the background of any effort to overturn the 1935 ruling, Humphrey's Executor v. United States, is whether thepresident would have the power to fire members of the Federal Reserve, which traditionally operates independently of the White House.

Gwynne Wilcox was confirmed by the Senate on September 6, 2023 to serve a second term as Board Member ending August 27, 2028. Ms. Wilcox previously served as a Member of the Board from August 4, 2021 until August 27, 2023, and she served as Chair of the Board from December 17, 2024 to January 20, 2025. On January 27, 2025, President Donald J. Trump removed Ms. Wilcox from the Board prior to her term’s expiration in 2028.

Ms. Wilcox is the first Black woman to serve on the Board since its inception in 1935, and is also the first Black woman to serve as Chair of the NLRB. In November 2021, Wilcox was presented with the Honorable Bernice B. Donald Diversity, Equity, and Inclusion in the Legal Profession Award by the American Bar Association’s Labor and Employment Law Section. The award is given to a member, law firm, corporation, organization or academic institution “that has demonstrated leadership in and commitment to advancing diversity, equity, and inclusion in the legal profession.”

Previous to her appointment, Wilcox was a senior partner at Levy Ratner, P.C., a New York City labor and employment law firm. While there, she served as Associate General Counsel of 1199SEIU United Healthcare Workers East and as a labor representative to the NYC Office of Collective Bargaining. Prior to joining Levy Ratner, she worked as a Field Attorney at Region 2 of the NLRB in Manhattan. Wilcox holds a bachelor’s from Syracuse University, a J.D. from Rutgers University School of Law-Newark, and is a Fellow in the College of Labor and Employment Lawyers.

China has made an offer to Australia in a bid to boost trade and growth between the two nations as the tit-for-tat tariff war continues with Donald Trump hitting Beijing with 125 per cent levies.

China has offered to "join hands" with Australia in the face of the escalating tariff war that has seen the United States hit Beijing with 125 per cent tariffs overnight.

President Donald Trump stunningly put a 90-day pause on "reciprocal" tariffs against dozens of nations, dropping the high levy for most countries to just 10 per cent.

But China was not spared as the tit-for-tat tariff war between Beijing and Washington heats up day by day, with 125 per cent tariffs on Chinese goods effective immediately.

Earlier this week trillions of dollars had been wiped off stock markets across the world following the "liberation day" announcement, but surged back up on Thursday.

With the relationship between President Trump and Chinese President Xi Jinping becoming unstable, Beijing is looking to other global partners to bolster relations.

Chinese Ambassador to Australia Xiao Qian said Beijing and Canberra must maintain their "open and cooperative" trade relationship amid the unpredictability of the US.

“Under the circumstances, China stands ready to join hands with Australia and the international community to jointly respond to the changes of the world," Mr Xiao said.

“In the meantime, China is also committed to working with Australia to implement the strategic consensus reached by the leaders of our two countries.”

In an opinion piece to the Sydney Morning Herald Mr Xiao also hit out at the US, saying "there is no winner in a trade or tariff war and protectionism leads nowhere".

"Against the backdrop of globalisation, countries around the world are closely intertwined by interests. Any unilateral measures would lead to far-reaching global repercussions and no country can stand to gain by harming others," he wrote.

"The US claims it has suffered losses in international trade and is using so-called “reciprocity” to justify raising tariffs on all its trading partners. This approach disregards the balance of interests achieved through years of multilateral trade negotiations and ignores the fact the US has long reaped substantial benefits from international trade."

Australia's two-way trade with China totalled $325 billion in 2023-24.

Idaho Legislature Clears Way For Ivermectin To Be Sold Over The Counter

Idaho is set to become the latest state in the United States to allow anti-parasite drug ivermectin to be sold without a prescription after the state Legislature passed a measure.

Senate Bill 1211 was easily approved in the state Legislature on Friday and delivered that same day to Gov. Brad Little’s desk.

The bill, according to its text, “adds to existing law to provide that ivermectin may be sold or purchased without a prescription or consultation with a health care professional,” meaning it can be sold over the counter.

The bill passed 29–9 in the state Senate and 66–1 in the House.

Little has not publicly commented on whether he will sign the bill or not. The Epoch Times contacted the governor’s office for comment Sunday.

Sen. Tammy Nichols, a Republican, presented the bill on the floor on April 3. “We’re not mandating use, we’re not prescribing treatment, and we are not mandating that it be sold,” Nichols told KTVB-7. “What we’re doing with this bill is simple. We’re removing a barrier.”

A co-sponsor of the bill, Senate President Pro Tempore Kelly Anthon, a Republican, said that the drug has a wide range of applications.

“This is a drug that has had really immeasurable impacts on improving the lives of billions and billions of people throughout the world since it was discovered. It’s been called, in many places, a wonder drug,” Anthon told lawmakers in an Idaho Senate committee in on-camera remarks last week. “It’s been able to serve in treating and in many ways curing human diseases—treating parasites, worms in humans. And in most countries, it is legal over the counter.”

Judicial Watch Sues for Emails of Anti-Trump FBI Executive Accused of Harassing Whistleblowers

Judicial Watch announced today that it filed a Freedom of Information Act (FOIA) lawsuit against the U.S. Department of Justice (DOJ) for emails of Dena Perkins, a section chief of the Federal Bureau of Investigation (FBI), regarding whistleblower retaliation (Judicial Watch Inc. v. U.S. Department of Justice (No, 1:25-cv-00891)).

Perkins was identified by Sen. Chuck Grassley, chairman of the Senate Judiciary Committee, as an official who retaliated against whistleblowers who were considered pro-Donald Trump:

A third FBI whistleblower said, “On January 6, 2021, I took leave and went to see the President speak on the Ellipse. Later, my wife and I were among a crowd southwest of the Capitol. Even though we were involved in no violence, never set foot on the steps leading to the Capitol building, and never entered it, I self-reported my presence to the FBI after seeing the violence in news reports. The FBI did nothing at first, but more than a year later suspended my security clearance. Under the supervision of Jeff Veltri and Dena Perkins, investigators questioned my co-workers about whether I ever vocalized support for President Trump or objections to the COVID-19 vaccine. I was forced to take early retirement to pay bills and have essentially been sidelined from employment opportunities due to FBI abuse of the clearance system to target me for my political beliefs.”

A fourth FBI whistleblower and a registered Democrat said, “As a Security Division employee, I witnessed abuses committed against multiple employees by FBI senior leaders, particularly by Jeff Veltri and Dena Perkins. I also saw Security Division retaliate against five of its own employees for protesting these unlawful practices. Because I spoke out against these abuses, Perkins and Timothy Dunham suspended my security clearance, costing me my job and continuing employment, totaling approximately $700,000 in lost wages and retirement benefits.”

A fifth FBI whistleblower said, “Although some FBI leaders who abused the clearance process like Dena Perkins and Jeff Veltri have already left, they weren’t alone. Timothy Dunham approved Perkins’s wrongdoing and engaged in his own. While most Security Division employees are fantastic, some FBI leaders still remain within the Security Integrity and Investigations Section who’ll continue this abuse of the process.”

From FBI whistleblower Marcus Allen, “Jeff Veltri and Dena Perkins caused the suspension of my security clearance because I questioned whether the FBI Director was truthful to Congress and whether the FBI was obeying the law and Constitution in the January 6, 2021 investigations. Their actions left me without pay for over two years while other FBI officials prevented me from having other income. Although the FBI ultimately reinstated my clearance and settled my lawsuit, my career at the FBI was over and the financial and emotional damage to me and my family will never be completely restored.”

Army Secretary Replaces Patel as Interim Head of A.T.F.

The unusual move has placed a civilian military leader in charge of a domestic law enforcement entity.

Kash Patel, the F.B.I. director, has been removed as the interim head of the Bureau of Alcohol, Tobacco, Firearms and Explosives and replaced by Daniel Driscoll, the Army secretary, four people with knowledge of the switch said on Wednesday. The highly unusual move places a civilian military leader in charge of a domestic law enforcement entity.

White House officials decided to make the switch in late February, just after Mr. Patel was named the A.T.F.’s director, because the responsibilities of running two agencies were seen as too time-consuming, according to an official briefed on the situation. Mr. Driscoll was selected because he was one of the few Senate-confirmed Trump appointees available to take over, the person said.

Mr. Driscoll, an Iraq war veteran who is close to Vice President JD Vance, learned over the past week that he was being handed the reins of the small, embattled federal agency responsible for enforcing the nation’s gun laws, officials said.

Mr. Driscoll was traveling in Germany on Wednesday and was not immediately available for comment. But a Defense Department official confirmed that Mr. Driscoll had assumed interim leadership of the A.T.F. with very little notice in recent days. The official did not know exactly when Mr. Driscoll had assumed his additional duties.

A Justice Department spokesman did not immediately respond to a request for comment.

The decision was announced to the A.T.F.’s supervisors on Wednesday morning. It left many of the agency’s staff members stunned and concerned that the switch would mean a significant recalibration of their mission at a time when hundreds of firearms investigators have been diverted to support immigration enforcement efforts.

While the appointment of Mr. Patel, a former Trump campaign surrogate, to run the A.T.F. was viewed with skepticism, the offloading of a component agency of the Justice Department to a Pentagon official is something entirely new.

The move comes at a moment of chaos at the largely leaderless and rudderless A.T.F.

Mr. Patel has spent most of his time running the F.B.I. and the Justice Department has proposed merging the A.T.F. with the Drug Enforcement Administration, a plan that has left the gun agency’s career leadership demoralized. That move, however, is unlikely to take place anytime soon.

Some fear that the plan to merge the D.E.A. and the A.T.F. might be a pretext for gutting both agencies, two of the smallest and most underfunded entities in the Justice Department. The replacement of Mr. Patel is unlikely to improve morale.

This week, Attorney General Pam Bondi, under pressure from gun rights groups, announced plans to eliminate the A.T.F.’s “zero tolerance” policy, put in place four years ago, that strips the federal licenses of firearms dealers found to have repeatedly violated federal laws and regulations, people briefed on the move said.

Ms. Bondi also ordered Mr. Patel to review two other major policies enacted under the Biden administration, with an eye toward scrapping both. One is a ban on so-called pistol braces used to convert handguns into rifle-like weapons, and the second is a rule requiring background checks on private gun sales.

City of Moreton Bay throws homeless people's tents into garbage trucks

The City of Moreton Bay council has begun throwing away rough sleepers' tents and other possessions as it cracks down on "illegal" homeless campers.

On Wednesday morning council rangers and police officers began dismantling tents at Eddie Hyland Park, north of Brisbane.

Homeless woman Carol Ross said rangers gave her one hour to remove her personal belongings from her tent before they loaded it onto the back of a garbage truck.

With her tent gone, Ms Ross said she did not know where she was going to spend the night.

"It's just depressing," she said.

"I don't know where I'm going to go."

A council spokesperson said eight of the homeless people at Eddie Hyland Park had previously been served with compliance notices.

The notices threaten fines of up to $8,065 for people who refuse to move from council land within two weeks of receiving the notice.

However, despite the two weeks having already elapsed, the spokesperson said council had not issued any fines to date.

General Patton's Accident Site, Mannheim, Germany

On the morning of December 9, 1945, General George S. Patton started out on a pheasant hunting trip in the vicinity of Mannheim, Germany. While driving through Mannheim, General Patton's vehicle collided with a US Army truck and he sustained serious, life-threatening injuries in the accident. On December 12, 1945, General Patton died from these injuries at the US Army hospital at Heidelberg.

Years later, then-PFC Horace Woodring, Patton's driver during the accident, provided accounts of his memory of the crash. PFC Woodring's versions of the event were consisent through the years and his narratives did not vary, especially with regard to the accident location.

Trump targets two first term critics, a law firm and the American Bar Association

President ==Donald Trump said on Wednesday that he would use the power of the Justice Department to go after two officials who were highly critical of him during his first term in office, including one whose anonymously written New York Times op-ed claiming he was part of the “resistance” to Trump’s presidency captivated the nation for years.

The announcement by Trump that he was targeting former Department of Homeland Security official Miles Taylor, who penned the op-ed, and former Cybersecurity and Infrastructure Security Agency Director Chris Krebs, whose rejection of Trump’s claims of widespread voter fraud during the 2020 election led to his ousting, comes as the president continues to seek retribution on his perceived enemies in ways big and small.

Executive orders signed by Trump on Wednesday strip Taylor and Krebs of any existing security clearance they may still hold since leaving office and orders the Justice Department to probe both former officials.

The president did not specify any alleged wrongdoing by the men that necessitated investigations by the department. But, speaking in the White House, Trump made clear he thinks he knows what the results should be.

“I think what he did, and he wrote a book, ‘Anonymous,’ said all sorts of lies, bad things– and I think it’s, I think it’s like a traitor, like, it’s like spying,” Trump said of Taylor. “I think it’s a very important case, and I think he’s guilty of treason, if you want to know the truth, but we’ll find out.”

Taylor rose to prominence in 2020 after he revealed that he was the author of the famous 2018 New York Times op-ed titled “I Am Part of the Resistance Inside the Trump Administration.” In it, he wrote that “many of the senior officials in his own administration are working diligently from within to frustrate parts of his agenda and his worst inclinations.” Taylor went on to publish a book critical of Trump, who insisted he did not remember Taylor during his time in the administration.

Taylor responded on Twitter, saying, “I said this would happen. Dissent isn’t unlawful. It certainly isn’t treasonous. America is headed down a dark path. Never has a man so inelegantly proved another man’s point.”

Krebs was fired by Trump weeks after the 2020 election after he rejected Trump’s claims of widespread voter fraud. On Wednesday, the president zeroed in on those comments, blasting him over his assessment of the contest.

“I think he said this is the safest election we’ve ever had, and yet, every day you read in the papers about more and more fraud that’s discovered,” Trump said. “He’s the fraud. He’s a disgrace. So, we’ll find out whether or not it was a safe election, and if it wasn’t, he’s got a big price to pay, and he’s a bad guy.”

Krebs declined CNN’s request for comment.

The retaliatory actions come the same day Trump took aim at another law firm whose work has drawn his ire. Through an executive order that, among other things, immediately suspends security clearances for employees of Susman Godfrey LLP, the president added the firm to a growing list of law firms on the receiving end of his anger.

The firm represented Dominion Voting Systems in a major defamation lawsuit it brought against Fox News over the network’s 2020 election lies. The right-wing news outlet settled the case in 2023 for a staggering $787 million.

Also on Wednesday, the Justice Department took aim at the American Bar Association, saying employees will no longer be allowed to spend money to engage with group.

Deputy Attorney General Todd Blanche said in an internal memo obtained by CNN that department attorneys cannot travel to, or speak at, ABA events in their official capacity. Career employees, however, are still able to maintain their ABA membership.

The move comes after the ABA publicly sided with several firms that the Trump administration has attacked through earlier executive orders born out of political retaliation that restrict their ability to do business with the federal government.

This afternoon, President Donald Trump signed a Presidential Memorandum that instructs the Department of Justice and “other aspects of [his] government” to investigate Chris Krebs and his acts as the former Director of the Cybersecurity and Infrastructure Security Agency (CISA). At the signing, President Trump’s White House staff secretary Will Scharf stated:

“This is a man who weaponized his position against free speech in the election context and the context of COVID-19. This is a similar Presidential Memorandum to the one you just signed. It addresses his access to government existent clearances he might have and further instructs your Department of Justice, other aspects of your government, to investigate some of the malign acts he participated in while he was still head of CISA.”

Before signing the memorandum, President Trump rehashed the consequences of the stolen 2020 election, including the deaths from the botched Afghanistan withdrawal, the Russia-Ukraine war, and October 7th.

President Trump called it “a very corrupt election” and said “they used COVID to cheat.” He called Krebs a “wise-guy” and referenced his absurd statement almost immediately following the 2020 Election, calling it the “most secure in U.S. history.”

As an added bonus, it appears Michigan’s governor, Gretchen Whitmer, was present in the Oval Office for the signing of this declaration. Very interesting!

On November 12, 2020, Chris Krebs said that “government and industry representatives from the election security community issued a joint statement reflecting a consensus perspective that the 2020 election was the most secure in U.S. history.”
